Chapter

1 hadith (8147 — 8147)

2 الْعِلْمُ ثَلَاثَةٌ : آيَةٌ مُحْكَمَةٌ سُنَّةٌ قَائِمَةٌ فَرِيضَةٌ عَادِلَةٌ

Knowledge is three: a decisive verse, an established Sunnah and a just obligation

3 تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ

Learn the Quran and teach it to people

2 hadith (8149 — 8150)

4 إِذَا تَحَدَّثْتُمْ فَتَحَدَّثُوا بِالْفَرَائِضِ

When you talk, talk about the laws of inheritance

5 hadith (8151 — 8155)

5 الِاثْنَانِ فَمَا فَوْقَهُمَا جَمَاعَةٌ

Two or more constitute a congregation

6 مِيرَاثُ الْإِخْوَةِ مِنَ الْأَبِ وَالْأُمِّ

Inheritance of full brothers and sisters

The Prophet (peace and blessings be upon him) said: The most knowledgeable of my Ummah in inheritance is Zayd bin Thabit (may Allah be pleased with him)

8 الْكَلَالَةُ مَنْ لَمْ يَتْرُكْ وَلَدًا وَلَا وَالِدًا

Kalalah is one who leaves neither child nor parent

Inheritance of paternal half-brothers

The case of the inheritance of a daughter and a sister

11 أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ فَمَا بَقِيَ فَلِأَوْلَى رَجُلٍ ذَكَرٍ

Give the fixed shares to those entitled to them, and what remains goes to the nearest male relative

12 قَضَاءُ أَبِي بَكْرٍ فِي الْجَدَّةِ

The judgement of Abu Bakr al-Siddiq (may Allah be pleased with him) concerning the grandmother

13 مُشَاوَرَةُ عُمَرَ فِي مِيرَاثِ الْجَدِّ وَالْإِخْوَةِ

Umar bin al-Khattab (may Allah be pleased with him) consulting about the inheritance of the grandfather and brothers

14 لِلْجَدَّتَيْنِ السُّدُسُ بَيْنَهُمَا بِالسَّوِيَّةِ

Two grandmothers share one sixth equally between them

15 أَوَّلُ مَنْ أَعَالَ الْفَرَائِضَ عُمَرُ

The first to apply proportional reduction (awl) in inheritance shares was Umar bin al-Khattab (may Allah be pleased with him)

16 عَصَبَةُ وَلَدِ الْمُلَاعَنَةِ أُمُّهُ

The heirs of the child of a woman who underwent lian are her relatives

17 الْوَلَاءُ لُحْمَةٌ كَلُحْمَةِ النَّسَبِ

Wala is a bond like the bond of lineage

18 لَا مُسَاعَاةَ فِي الْإِسْلَامِ

There is no musaah in Islam

19 مِيرَاثُ الْعَمَّةِ وَالْخَالَةِ

Inheritance of the paternal aunt and maternal aunt

20 وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ

The maternal uncle is the heir of one who has no heir

21 إِنَّ الْخَالَةَ أُمٌّ

The maternal aunt is like a mother

22 الْإِسْلَامُ يَزِيدُ وَلَا يَنْقُصُ

Islam increases and does not decrease

23 لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ

A Muslim does not inherit from a disbeliever, nor a disbeliever from a Muslim

24 لَا يَرِثُ الْمَيِّتُ مِنَ الْمَيِّتِ إِذَا لَمْ يُعْرَفْ أَيُّهُمَا مَاتَ قَبْلَ صَاحِبِهِ

The dead do not inherit from one another if it is not known which of them died first

25 مَنْ لَمْ يَتْرُكْ وَارِثًا إِلَّا عَبْدًا أَعْتَقَهُ فَالْمِيرَاثُ لَهُ

Whoever leaves no heir except a slave he freed, the inheritance goes to him

26 رَدُّ الصَّدَقَةِ مِيرَاثًا

Charity returning as inheritance

5 hadith (8215 — 8219)

27 إِذَا اسْتَهَلَّ الصَّبِيُّ وَرِثَ وَصُلِّيَ عَلَيْهِ

If a newborn cries out, he inherits and the funeral prayer is offered for him
