Mustadrak al-Hakim — Hadith 8184

أخبرنا أبو جعفر محمد بن محمد البغدادي، حدثنا إسماعيل بن إسحاق القاضي، حدثنا علي بن عبد الله المَدِيني، حدثنا يعقوب بن إبراهيم بن سعد، حدثنا أبي، عن ابن إسحاق، قال: حدثنا [محمد بن] (1) مسلم بن عبد الله بن شِهَاب، عن عُبيد الله بن عبد الله، عن ابن عباس أنه قال: أولُ من أعالَ الفرائضَ عمرُ وايمُ اللهِ، لو قدَّم من قدَّم اللهُ وأخَّر مَن أخَّر الله ما عالَتْ فريضةٌ. فقيل له: وأَيُّها قدَّم الله وأَيُّها أخَّر؟ فقال: كلُّ فريضة لم يُهبِطُها اللهُ ﷿ عن فريضةٍ إلَّا إلى فريضة، فهذا ما قدَّم الله ﷿، وكلُّ فريضة إذا زالت عن فَرْضِها لم يكن لها إِلَّا ما بقي، فتلك التي أخَّر الله ﷿ كالزوج والزوجة والأمِّ، والذي أَخَّر كالأخَوات والبنات، فإذا اجتمعَ مَن قدَّم الله ﷿ وأخر بُدِئَ بمَن قَدَّم فأُعطِي حقَّه كاملًا، فإن بَقِيَ شيءٌ كان لمن أخَّر، وإن لم يَبْقَ شيءٌ فلا شيءَ له (2).
هذا حديث صحيح على شرط مسلم ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that he said: "The first to rule for 'awl (proportional reduction) in the fixed shares (of inheritance) was Sayyiduna Umar (may Allah be pleased with him). By Allah! If people had given precedence to those whom Allah gave precedence and deferred those whom Allah deferred, no case of fixed shares would ever have needed 'awl." He was asked: Whom has Allah given precedence and whom has He deferred? He said: "Every heir whose share Allah, the Mighty and Majestic, never lowers from one fixed amount except to another fixed amount, these are the ones whom Allah has given precedence; and every heir whose fixed share, when it is removed (due to the presence of others), receives only what remains, these are the ones whom Allah has deferred. For example, the husband, the wife and the mother (are given precedence), and those deferred are the sisters and the daughters. So when the heirs given precedence by Allah and those deferred are gathered together, one begins with those whom He gave precedence and gives them their full right; then if anything remains, it is for those who were deferred, and if nothing remains, then there is nothing for them."
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

Grading: Its chain is "hasan" because of Muhammad bin Ishaq.
وأخرجه ابن حزم في "المحلى" 9/ 264 تعليقًا عن إسماعيل بن إسحاق القاضي، بهذا الإسناد، وسياقه أتم.
Reference / Source: Ibn Hazm narrated it in "al-Muhalla" (9/ 264) mu'allaq (without full chain) from Isma'il bin Ishaq al-Qadi with this same chain, and his wording is more complete.
وأخرجه البيهقي 6/ 253 من طريق يونس بن بكير، عن محمد بن إسحاق، به.
Reference / Source: Al-Bayhaqi (6/ 253) narrated it via Yunus bin Bukayr, from Muhammad bin Ishaq, with this same chain.
وأخرج سعيد بن منصور (36) عن سفيان بن عيينة، عن محمد بن إسحاق، به: قال ابن عباس: أترون الذي أحصى رملَ عالِجٍ عددًا جعل في مالٍ نصفًا وثلثًا وربعًا؟ إما هو نصفان، وثلاثة أثلاث، وأربعة أرباع.
Reference / Source: Sa'id bin Mansur (36) narrated from Sufyan bin 'Uyaynah, from Muhammad bin Ishaq: "Ibn 'Abbas said: Do you think that the One who has counted the grains of sand of 'Alij has placed in (one) estate a half, a third and a quarter? It is either two halves, or three thirds, or four quarters."
وأخرج عبد الرزاق (19022) عن معمر، عن الزهري، عن عبيد الله بن عبد الله قال: سمعت ابن عباس يقول: أحصى الله رملَ عالج، ولم يحصِ هذا؟! ما قال في مال ثلثان ونصف. يعني أن الفريضة لا تَعُول. وسنده صحيح.
Reference / Source: 'Abd al-Razzaq (19022) narrated from Ma'mar, from al-Zuhri, from 'Ubaydullah bin 'Abdullah, who said: "I heard Ibn 'Abbas say: Allah has counted the sand of 'Alij and did not count this?! He did not say two-thirds and a half in one estate." He meant that there is no "'awl" (proportional increase of shares) in inheritance.
Grading: Its chain is sahih.
وأخرج سعيد بن منصور (35) من طريق عمرو بن دينار، وابن أبي شيبة 11/ 282 من طريق عطاء بن أبي رباح، كلاهما عن ابن عباس قال: الفرائض لا تَعُول. وسنداه صحيحان.
Reference / Source: Sa'id bin Mansur (35) narrated via 'Amr bin Dinar, and Ibn Abi Shaybah (11/ 282) via 'Ata' bin Abi Rabah; both from Ibn 'Abbas, who said: "There is no 'awl in inheritance shares."
Grading: Both chains are sahih.
العَوْل: هو زيادة السِّهام على الفريضة، فيدخل النقصانُ على سهام أهل الفروض.
General principle: "'Awl" means: the shares exceeding the estate (the whole), as a result of which a reduction falls on the shares of the holders of fixed shares.
