Mustadrak al-Hakim — Hadith 8185

حدثنا أبو العباس محمد بن يعقوب، حدثنا أبو عُتبة أحمد بن الفَرَج، حدثنا بَقيَّة بن الوليد، حدثني أبو سَلَمة الحِمصي سليمان بن سُلَيم (1)، عن عمر (2) ابن رُوبَة، عن عبد الواحد بن عبد الله النَّصْري (3)، عن واثلة بن الأسقَع، عن النبي ﷺ قال: "تَحُوزُ المرأة ثلاثةَ مَوارِيث: عَتيقَها ولَقِيطَها والولدَ الذي لا عَنَت عليه" (4).
هذا حديث صحيح الإسناد، ولم يُخرجاه.
It is narrated from Sayyiduna Wathilah bin al-Asqa' (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "A woman acquires three kinds of inheritance: that of the slave she freed, that of the abandoned foundling (laqit) she found, and that of the son concerning whom li'an (separation after an accusation of adultery) took place."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(4) إسناده ضعيف من أجل عمر بن روبة، فقد قال البخاري: فيه نظر، وقال أبو حاتم صالح الحديث ولا تقوم به الحجة، وساق له ابن عدي في "الكامل" 5/ 50 هذا الحديث من منكراته، وقال: أنكروا عليه أحاديثه عن عبد الواحد النصري. وذكر العقيلي عمر هذا في "ضعفائه"، بينما أورده ابن حبان في "ثقاته". وبقية بن الوليد - مع ضعفه وتدليسه - توبع. وقال البيهقي: في "معرفة السنن" 9/ 153: لم يُثبت البخاري ولا مسلم هذا الحديث لجهالة بعض رواته.
Grading: Its chain is "da'if" (weak) because of 'Umar bin Ru'bah.
Technical note / Defect ('illah): Al-Bukhari said: "fihi nazar" (he is questionable); Abu Hatim said: "He is salih al-hadith, but he is not taken as proof." Ibn 'Adi in "al-Kamil" (5/ 50) counted this hadith among his munkar narrations and said: "His narrations from 'Abd al-Wahid al-Nasri were objected to." Al-'Uqayli mentioned him among the weak narrators, whereas Ibn Hibban mentioned him among the trustworthy ones. Baqiyyah bin al-Walid - despite his weakness and tadlis - has been corroborated. Al-Bayhaqi said in "Ma'rifat al-Sunan" (9/ 153): "Neither al-Bukhari nor Muslim accepted this hadith as established, because some of its narrators are unknown."
وأخرجه أحمد 25 (16011)، والنسائي (6326) و (6387) من طرق عن بقية بن الوليد، بهذا الإسناد.
Reference / Source: Ahmad (25/ 16011) and al-Nasa'i (6326, 6387) narrated it via various routes from Baqiyyah bin al-Walid with this same chain.
وأخرجه أحمد 25/ (16004) و 28 / (16981)، وأبو داود (2906)، وابن ماجه (2742)، والترمذي (2115)، والنسائي (6327) من طرق عن محمد بن حرب الخولاني، عن عمر بن روبة به، وقال الترمذي: حسن غريب لا نعرفه إلَّا من حديث محمد بن حرب على هذا الوجه.
Reference / Source: Ahmad (25/ 16004, 28/ 16981), Abu Dawud (2906), Ibn Majah (2742), al-Tirmidhi (2115) and al-Nasa'i (6327) narrated it via routes from Muhammad bin Harb al-Khawlani, from 'Umar bin Ru'bah, likewise. Al-Tirmidhi said: "This hadith is hasan gharib; we know it only from the hadith of Muhammad bin Harb in this way."
وأخرجه سعيد بن منصور في "سننه؟ (479)، وابن أبي شيبة 11/ 408 من طريق إسماعيل بن عياش، عن عمر بن روبة، به موقوفًا.
Reference / Source: Sa'id bin Mansur in "al-Sunan" (479) and Ibn Abi Shaybah (11/ 408) narrated it via Isma'il bin 'Ayyash, from 'Umar bin Ru'bah, as "mawquf".
ويشهد للقسم الثالث - وهو أن الملاعنة ترث ابنها - حديث عبد الله بن عمرو عند أبي داود (2908)، وسنده حسن، وانظر التعليق عليه هناك.
Corroborating chains and supporting reports: The third part - that the woman who undergoes li'an inherits from her son - is supported by the hadith of 'Abdullah bin 'Amr in Abu Dawud (2908), and its chain is "hasan". See the comment on it there.
قال الخطابي في "معالم السنن" 4/ 99: أما اللقيط فإنه في قول عامة الفقهاء حرٌّ، وإذا كان حرًا فلا ولاء عليه لأحد، والميراث إنما يُستحق بنسب أو ولاء، وليس بين اللقيط وملتقطِه واحدٌ منهما، وكان إسحاق بن راهويه يقول: ولاء اللقيط لملتقطِه، ويحتج بحديث واثلة، وهذا الحديث غير ثابت عند أهل النقل، وإذا لم يثبت الحديث لم يلزم القول به، وكان ما ذهب إليه عامة العلماء أَولى. وقال بعضهم: لا يخلو اللقيط من أن يكون حرًا فلا ولاء عليه، أو يكون ابن أَمَة قوم، فليس لملتقطه أن يسترقه.
General principle: Imam al-Khattabi said in "Ma'alim al-Sunan" (4/ 99): "As for the laqit (a foundling picked up somewhere), according to the view of the generality of jurists he is 'free', and since he is free, no one has a right of wala' over him. Inheritance is due only through lineage or wala' (the tie of manumission), and between the foundling and the one who picks him up (al-multaqit) there is neither of these. Ishaq bin Rahawayh used to say that the foundling's wala' belongs to the one who picks him up, and he argued from the hadith of Wathilah, yet this hadith is not established according to the people of transmission; and when a hadith is not established, holding to it is not binding, so the view of the generality of scholars is preferable. Some scholars said: the foundling is either free, in which case no one has wala' over him, or he is the child of some people's slave-woman, in which case (too) the one who picks him up may not enslave him."
