Mustadrak al-Hakim — Hadith 8186

أخبرنا أبو عبد الله بن يعقوب الحافظ وأبو يحيى السَّمَرقندي، قالا: حدثنا محمد بن نصر الإمام، حدثنا يحيى بن يحيى، أخبرنا عبَّاد بن العوّام، عن عمر بن عامر عن حمَّاد، عن إبراهيم، عن ابن مسعود: أنه قال في مِيراث ابن الملاعَنة: مِيراثُه كلُّه لأمِّه (1).
هذا حديث رواتُه كلُّهم ثِقات، وهو مرسل، وله شاهدٌ:

It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) concerning the inheritance of the son of a woman who underwent li'an that he said: "All of his inheritance is for his mother."
All the narrators of this hadith are reliable (thiqah), and it is mursal; however, it has a supporting narration (shahid).

(1) خبر صحيح، وهذا إسناد حسن. ورواية إبراهيم - وهو ابن يزيد النخعي - عن ابن مسعود مقبولة كما بيناه عند الرواية السالفة برقم (8163)، وقد توبع. حماد: هو حماد بن أبي سليمان.
Grading: This report is sahih and this chain is hasan.
Technical note / Defect ('illah): The narration of Ibrahim (Ibn Yazid al-Nakha'i) from Ibn Mas'ud is accepted (even though it is mursal), as we explained at the previous narration number (8163), and he has also been corroborated. Hammad is Hammad bin Abi Sulayman.
وأخرجه ابن أبي شيبة 11/ 336 عن عباد بن العوام، بهذا الإسناد. وزاد: فإن لم يكن له أم فهو لعَصَبته.
Reference / Source: Ibn Abi Shaybah (11/ 336) narrated it from 'Abbad bin al-'Awwam with this same chain, and added: "If he has no mother, then it (the inheritance) is for her ('asabah) residuary heirs."
وأخرجه الدارمي (2998) من طريق سالم بن نوح، عن عمر بن عامر، به بلفظ: ميراثه لأمه، تَعقِل عنه عَصَبةُ أمِّه.
Reference / Source: Al-Darimi (2998) narrated it via Salim bin Nuh, from 'Umar bin 'Amir, likewise, with the wording: "His inheritance is for his mother, and his mother's 'asabah pay the blood money on his behalf."
وأخرجه ابن أبي شيبة 11/ 336 من طريق الأعمش، والدارمي (2993) من طريق أبي معشر زياد بن كليب التميمي، كلاهما عن إبراهيم النخعي، به.
Reference / Source: Ibn Abi Shaybah (11/ 336) narrated it via al-A'mash, and al-Darimi (2993) via Abu Ma'shar Ziyad bin Kulayb al-Tamimi; both from Ibrahim al-Nakha'i, likewise.
وأخرجه عبد الرزاق (12479)، وابن أبي شيبة 11/ 337، والطبراني في "الكبير" (9662)، والبيهقي 6/ 258 من طريق قتادة، عن ابن مسعود. وقتادة لم يدرك ابن مسعود.
Reference / Source: 'Abd al-Razzaq (12479), Ibn Abi Shaybah (11/ 337), al-Tabarani in "al-Kabir" (9662) and al-Bayhaqi (6/ 258) narrated it via Qatadah, from Ibn Mas'ud.
Technical note / Defect ('illah): And Qatadah did not meet Ibn Mas'ud (so it is munqati').
وأخرج سعيد بن منصور (120)، وابن أبي شيبة 11/ 348، والدارمي (3145)، وابن المنذر في "الأوسط" (6854)، والبيهقي 6/ 258 من طريق محمد بن سالم، وعبد الرزاق (12482)، وابن أبي شيبة 11/ 339، والدارمي (3004)، وابن المنذر (6853)، والطبراني (9663) من طريق محمد بن عبد الرحمن بن أبي ليلى، كلاهما عن الشعبي، عن علي وعبد الله قالا: عَصَبة ابن الملاعَنة أمُّه، ترث ماله أجمع، فإن لم تكن له أم فعَصَبتها عصبتُه. وطريقه الأول فيه محمد بن سالم متفق على ضعفه، وطريقه الثاني فيه ابن أبي ليلى سيئ الحفظ، ورواية الشعبي عن ابن مسعود مرسلة.
Reference / Source: Sa'id bin Mansur (120), Ibn Abi Shaybah (11/ 348), al-Darimi (3145), Ibn al-Mundhir in "al-Awsat" (6854) and al-Bayhaqi (6/ 258) narrated via Muhammad bin Salim; and 'Abd al-Razzaq (12482), Ibn Abi Shaybah (11/ 339), al-Darimi (3004), Ibn al-Mundhir (6853) and al-Tabarani (9663) via Muhammad bin 'Abd al-Rahman bin Abi Layla. Both of them (Muhammad bin Salim and Ibn Abi Layla) narrate from al-Sha'bi, from 'Ali and 'Abdullah (bin Mas'ud) (may Allah be pleased with them), who both said: "The 'asabah of the son of the woman who underwent li'an is his mother; she inherits all his wealth. If he has no mother, then her 'asabah are his 'asabah."
Technical note / Defect ('illah): Its first route contains Muhammad bin Salim, whose weakness is agreed upon; its second route contains Ibn Abi Layla, who is "sayyi' al-hifz" (of poor memory); moreover, al-Sha'bi's narration from Ibn Mas'ud is "mursal".
