Mustadrak al-Hakim — Hadith 8201

أخبرنا أبو عبد الله محمد بن يعقوب الشَّيباني، حدثنا الشيخ الشهيد الإمام ابن الإمام أبو زكريا يحيى بن محمد بن يحيى الذُّهْلي، حدثنا مُسدَّد، حدثنا حماد بن زيد، عن بُدَيل بن مَيسَرة، عن علي بن أبي طلحة، عن راشد بن سعد، عن أبي عامر الهَوْزَني، عن المِقْدام الكِنْدي قال: قال رسول الله ﷺ: "أنا مَوْلى من لا مولى له، أَرِثُ مالَه وأفُكُّ عانَه، والخالُ وارثُ من لا وارثَ له، يَرِثُ مالَه ويَفُكُّ عانَه" (1)
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna al-Miqdam al-Kindi (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "I am the guardian of one who has no guardian; I will inherit his wealth and free him of his burden (ransom or captivity), and the maternal uncle is the heir of one who has no heir; he will inherit his wealth and free him of his burden (ransom)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(1) حديث صحيح، وهذا إسناد حسن من أجل علي بن أبي طلحة، وقد توبع. أبو عامر الهوزني: هو عبد الله بن لُحي، والمقدام الكندي: هو ابن مَعْدي كَرِبَ ﵁. وحسّن الحديث أبو زرعة الرازي كما في "العلل" لابن أبي حاتم (1636).
Grading: This hadith is sahih, and this chain is "hasan" because of 'Ali bin Abi Talhah, and he has been corroborated.
Technical note / Defect ('illah): Abu 'Amir al-Hawzani is 'Abdullah bin Luhayy, and al-Miqdam al-Kindi is Ibn Ma'dikarib (may Allah be pleased with him). Abu Zur'ah al-Razi also declared this hadith hasan, as in Ibn Abi Hatim's "al-'Ilal" (1636).
وأخرجه أحمد 28/ (17203)، وأبو داود (2900)، وابن ماجه (2634)، والنسائي (6321) من طرق عن حماد بن زيد، بهذا الإسناد. لكن بلفظ: "والخال مولى من لا مولى له"، وهو ما أشار إليه أبو زرعة أيضًا كما في "العلل" (1640)، إلَّا في رواية ابن ماجه فكرواية المصنف.
Reference / Source: Ahmad (28/ 17203), Abu Dawud (2900), Ibn Majah (2634) and al-Nasa'i (6321) narrated it via various routes from Hammad bin Zayd with this same chain, but with the wording: "And the maternal uncle is the mawla (heir) of one who has no mawla." Abu Zur'ah also pointed to this (al-'Ilal 1640), except in the narration of Ibn Majah, which is like the author's narration.
وأما اللفظ الذي ذكره المصنف فهو في رواية شعبة التي أخرجها أحمد (17175) و (17176) و (17204)، وأبو داود (2899)، وابن ماجه (2738)، والنسائي (6322)، وابن حبان (6035) عن بديل بن ميسرة، به.
Note / Clarification: The wording the author mentioned is in the narration of Shu'bah, narrated by Ahmad (17175, 17176, 17204), Abu Dawud (2899), Ibn Majah (2738), al-Nasa'i (6322) and Ibn Hibban (6035) from Budayl bin Maysarah, with this same chain.
وخالف محمدُ بن الوليد الزُّبيدي عليَّ بن أبي طلحة عند أبي عوانة (5636)، وابن حبان (6036)، والطبراني في "الكبير" 20/ (627)، وفي "مسند الشاميين" (1856)، فرواه عن راشد بن سعد، عن عبد الرحمن بن عائذ الثمالي، عن المقدام. فجعل عبد الرحمن بن عائذ مكان أبي عامر الهوزني، وكلاهما ثقة.
Technical note / Defect ('illah): Muhammad bin al-Walid al-Zubaydi contradicted 'Ali bin Abi Talhah [in Abu 'Awanah (5636), Ibn Hibban (6036), al-Tabarani's "al-Kabir" (20/ 627) and "Musnad al-Shamiyyin" (1856)]; he narrated it from Rashid bin Sa'd, from 'Abd al-Rahman bin 'A'idh al-Thumali, from al-Miqdam. So he put 'Abd al-Rahman bin 'A'idh in place of Abu 'Amir al-Hawzani, and both of them (Abu 'Amir and 'Abd al-Rahman) are thiqah.
وخالفهما معاوية بن صالح عند أحمد (17199) و (17200)، والنسائي (6320) و (6386)، فرواه عن راشد بن سعد عن المقدام، لم يذكر الوساطة بينه وبين المقدام، ووقع تصريحه بسماعه من المقدام في رواية النسائي الثانية، فإن صح ذلك يكون سعد بن راشد قد سمعه من المقدام بعد أن سمعه بالوساطة.
Technical note / Defect ('illah): Both of them were contradicted by Mu'awiyah bin Salih [in Ahmad (17199, 17200) and al-Nasa'i (6320, 6386)]; he narrated it from Rashid bin Sa'd, (directly) from al-Miqdam, without mentioning an intermediary. In al-Nasa'i's second narration he explicitly states that he heard it from al-Miqdam; if that is authentic, it would mean that Sa'd bin Rashid first heard it through an intermediary and later heard it directly from al-Miqdam.
وخالفهم ثور بن يزيد عند النسائي (6323)، فرواه عن راشد بن سعد: أن رسول الله ﷺ، فذكره معضلًا.
Technical note / Defect ('illah): All of them were contradicted by Thawr bin Yazid [in al-Nasa'i (6323)]; he narrated it from Rashid bin Sa'd, that the Messenger of Allah (peace and blessings be upon him) said it, narrating it as "mu'dal" (without mentioning the Companion).
وجعل الدارقطني في "العلل" (3422) رواية علي بن أبي طلحة هي الأشبه بالصواب.
Technical note / Defect ('illah): Al-Daraqutni in "al-'Ilal" (3422) considered the narration of 'Ali bin Abi Talhah to be the closest to what is correct.
وأخرجه أبو داود (2901)، وأبو عوانة (5637)، والبيهقي 6/ 214 من طريق يزيد بن حُجر، عن صالح بن يحيى بن المقدام، عن أبيه، عن جده. وهذا إسناد ضعيف مسلسل بالمجاهيل.
Reference / Source: Abu Dawud (2901), Abu 'Awanah (5637) and al-Bayhaqi (6/ 214) narrated it via Yazid bin Hujr, from Salih bin Yahya bin al-Miqdam, from his father, from his grandfather.
Grading: This chain is weak, with a series of unknown narrators in it.

وفي الباب عن عمر بسند حسن عند أهل "السنن" وغيرهم، انظر تخريجه في "مسند أحمد" 1/ (189) و (323).
Corroborating chains and supporting reports: On this topic there is a narration from 'Umar (may Allah be pleased with him) with a "hasan chain" in the authors of the Sunan and others. See its takhrij in "Musnad Ahmad" (1/ 189, 323).
قوله: "يفك عانَه" أي عانيَه، فحذف الياء. والعاني: هو الأسير.
Note / Clarification: The words of the hadith "yafukku 'anahu" were originally "'aniyahu", and the ya' was dropped (for lightness). "Al-'ani" means a captive (asir).
قال الترمذي في "جامعه": واختلف فيه أصحاب النبي ﷺ، فورَّث بعضهم الخال والخالة والعمّة، وإلى هذا الحديث ذهب أكثر أهل العلم في توريث ذوي الأرحام، وأما زيد بن ثابت فلم يورّثهم، وجعل الميراث في بيت المال.
General principle: Imam al-Tirmidhi says in his "Jami'": "The Companions of the Prophet (peace and blessings be upon him) differed on this issue. Some of them made the maternal uncle, the maternal aunt and the paternal aunt heirs, and most scholars follow this hadith in making blood relatives (dhawu al-arham) heirs. Zayd bin Thabit, however, did not make them heirs, and he placed the inheritance in the public treasury (bayt al-mal)."
وقال البغوي في "شرح السنة" 8/ 358: هذا الحديث حجّة لمن ذهب إلى توريث ذوي الأرحام، وهم أولاد البنات، والجد أب الأم، وأولاد الأخت، وبنات الأخ، وبنات العم، والعم للأم، والعمة، والخال والخالة، فاختلف الناس في توريثهم، فذهب جماعة منهم إلى أنه لا ميراث لهم، بل يُصرَف مالُ الميت الذي لم يُخلّف وارثًا إلى بيت مال المسلمين إرثًا لهم بأخوة الإسلام، وهو قول أبي بكر وزيد بن ثابت وابن عمر، وبه قال الزهري والأوزاعي ومالك والشافعي، وتأولوا حديث المقدام على أنه طعمة أَطعمها الخالَ عند عدم الوارث، وسمّاه وارثًا مجازًا.
General principle: Al-Baghawi said in "Sharh al-Sunnah" (8/ 358): "This hadith is a proof for those who hold that blood relatives (dhawu al-arham) inherit. The dhawu al-arham include: the children of daughters, the maternal grandfather (the mother's father), the children of a sister, the daughters of a brother, the daughters of a paternal uncle, the maternal half-brother of the father, the paternal aunt, the maternal uncle and the maternal aunt. People differed about their inheritance. A group held that they have no inheritance; rather, the wealth of a deceased who leaves no heir is spent in the public treasury of the Muslims, as an inheritance for them by virtue of the brotherhood of Islam. This is the view of Abu Bakr, Zayd bin Thabit and Ibn 'Umar (may Allah be pleased with them), and it is the position of al-Zuhri, al-Awza'i, Malik and al-Shafi'i. They interpreted the hadith of al-Miqdam to mean that it was merely a "tu'mah" (a provision) which he gave to the maternal uncle when there was no heir, and he called him an heir figuratively."
وذهب كثير من أهل العلم إلى توريثهم عند عدم الورثة، وهو قول عمر وعلي وعبد الله بن مسعود وإليه ذهب الشعبي، وبه قال الثّوري وأحمد وأصحاب الرأي.
General principle: Many scholars held that they are made heirs when there are no (other) heirs. This is the view of 'Umar, 'Ali and 'Abdullah bin Mas'ud (may Allah be pleased with them); al-Sha'bi followed it, and it is the view of al-Thawri, Ahmad and the people of opinion (ashab al-ra'y, the Hanafis).
