(3) إسناده صحيح. الحسن بن عفّان: هو الحسن بن علي بن عفّان العامري. وأخرجه ابن أبي حاتم في "تفسيره" 5/ 1743 من طريق الحسن بن عبيد الله، عن القاسم، عن ابن عباس وقيل له: إنَّ ابن مسعود لا يُورِّث الموالي دون ذوي الأرحام، ويقول: إنَّ ذوي الأرحام بعضهم أَولى ببعض في كتاب الله، فقال ابن عباس: هيهاتَ هيهاتَ أين ذهب؟! إنما كان المهاجرون يتوارثون دون الأعراب فنزلت: ﴿وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ فِي كِتَابِ اللَّهِ﴾ يعني: أنه يورِّث المولى.
Grading: Its chain is sahih. Al-Hasan bin 'Affan is al-Hasan bin 'Ali bin 'Affan al-'Amiri.
Reference / Source: Ibn Abi Hatim narrated it in his "Tafsir" (5/ 1743) via al-Hasan bin 'Ubaydullah, from al-Qasim, from Ibn 'Abbas, that it was said to him: "Ibn Mas'ud (may Allah be pleased with him) does not make freed slaves (mawali) heirs when there are blood relatives (dhawu al-arham), and he says that in the Book of Allah blood relatives are more entitled to one another." Ibn 'Abbas said: "Far from it, far from it! Where has he gone?! (The point is that) the Muhajirun used to inherit from one another to the exclusion of the Bedouins, so this verse was revealed: {And those of (blood) relationship are nearer to one another in the Book of Allah}; that is, this (verse) makes the mawla an heir."
وأخرج البخاري (2292) و (4580) و (6747)، وأبو داود (2922) من طريق طلحة بن مصرّف، عن سعيد بن جبير، عن ابن عباس ﴿وَلِكُلٍّ جَعَلْنَا مَوَالِيَ﴾ قال: وَرَثةً ﴿وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ﴾ [النساء: 33] قال: كان المهاجرون لما قَدِمُوا المدينةَ يَرِثُ المهاجرُ الأنصاريَّ دون ذوي رَحِمِه للأخوّة التي آخى النبيُّ ﷺ بينهم، فلما نزلت ﴿وَلِكُلٍّ جَعَلْنَا مَوَالِيَ﴾ نُسخت، ثمَّ قال: ﴿وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ﴾ إِلّا النَّصرَ والرِّفادةَ والنَّصيحةَ، وقد ذهب الميراثُ، ويُوصي له.
Reference / Source: Al-Bukhari (2292, 4580, 6747) and Abu Dawud (2922) narrated via Talhah bin Musarrif, from Sa'id bin Jubayr, from Ibn 'Abbas: {And for all, We have made mawali}; he said: mawali means "heirs". And about {and those with whom your oaths have made a pledge} [al-Nisa': 33] he said: "When the Muhajirun came to Madinah, because of the brotherhood which the Prophet (peace and blessings be upon him) established between them, the Muhajir would inherit from the Ansari rather than his blood relatives; then when {And for all, We have made mawali} was revealed, this was abrogated. Then he said: {and those with whom your oaths have made a pledge}: (what remains for them now is) only help, support (rifadah) and sincere counsel; inheritance has gone, but a bequest may be made for him."
وأخرج أبو داود (2924) من طريق علي بن حسين، عن أبيه، عن يزيد النحوي، عن عكرمة، عن ابن عباس: ﴿وَالَّذِينَ آمَنُوا وَهَاجَرُوا﴾ [الأنفال: 74] ﴿وَالَّذِينَ آمَنُوا وَلَمْ يُهَاجِرُوا﴾ [الأنفال: 72] فكان الأعرابي لا يرثُ المهاجر، ولا يرثه المهاجر، فنسختها فقال: ﴿وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ﴾.
Reference / Source: Abu Dawud (2924) narrated via 'Ali bin Husayn, from his father, from Yazid al-Nahwi, from 'Ikrimah, from Ibn 'Abbas, concerning {those who believed and emigrated} [al-Anfal: 74] and {those who believed but did not emigrate} [al-Anfal: 72]: "The Bedouin did not inherit from the Muhajir, nor did the Muhajir inherit from him; then this was abrogated, and He said: {And those of (blood) relationship are nearer to one another}."
