Mustadrak al-Hakim — Hadith 8192

ما أخبرَناه أبو عبد الله الصَّفَّار، حدثنا محمد بن إسماعيل السُّلَمي، حدثنا محمد بن بكَّار بن بلال، حدثنا محمد بن راشد عن سليمان بن موسى، عن عمرو بن شعيب، عن أبيه، عن جدِّه، أنَّ النبيَّ ﷺ: قال: "مَن ادَّعى ولدًا من أَمَةٍ لا يَملِكُها، أو من حرَّةٍ عاهَرَ بها، فإنه لا يَلْحَقُ به ولا يَرِثُ، وهو ولدُ زِنًى لأهل أُمِّه مَن كانوا" (1).
Amr bin Shu'ayb narrates from his father, from his grandfather, that the Prophet (peace and blessings be upon him) said: "Whoever claims a child born of a slave woman whom he did not own, or (claims a child) of a free woman with whom he committed fornication, that child will not be attached to him (the claimant) nor will he inherit from him. He is a child of fornication and will be counted among his mother's family, whoever they may be."

(1) إسناده حسن، وقد اختلف على عمرو بن شعيب في وصله وإرساله، والوصل أرجح.
Grading: Its chain is hasan. There is a disagreement on 'Amr bin Shu'ayb over whether this hadith is "connected" (mawsul) or "mursal", and "connection" (wasl) is more preponderant.
وأخرجه مطولًا ابن ماجه (2746) عن محمد بن يحيى، عن محمد بن بكار، بهذا الإسناد.
Reference / Source: Ibn Majah (2746) narrated it at length from Muhammad bin Yahya, from Muhammad bin Bakkar, with this same chain.
وأخرجه كذلك أحمد 11/ (6699) و (7042)، وأبو داود (2265) و (2266) من طرق عن محمد بن راشد، به.
Reference / Source: Likewise, Ahmad (11/ 6699, 7042) and Abu Dawud (2265, 2266) narrated it via various routes from Muhammad bin Rashid with this same chain.
وأخرجه ابن ماجه (2745) من طريق المثنى بن الصباح، والترمذي (2113) من طريق ابن لهيعة، كلاهما عن عمرو بن شعيب، به. والمثنى ضعيف، وابن لهيعة لم يسمع من عمرو بن شعيب فيما قاله أبو حاتم الرازي. وأخرجه مطولًا ومختصرًا عبد الرزاق (13851) و (19138)، وابن أبي شيبة 11/ 364 من طريق ابن جريج، وعبد الرزاق (13852) عن سفيان بن عيينة، عن يعقوب بن عطاء، كلاهما عن عمرو بن شعيب، عن النبي ﷺ مرسلًا. ويعقوب بن عطاء ضعيف.
Reference / Source: Ibn Majah (2745) narrated it via al-Muthanna bin al-Sabbah, and al-Tirmidhi (2113) via Ibn Lahi'ah; both from 'Amr bin Shu'ayb with this same chain.
Grading: Al-Muthanna is weak, and Ibn Lahi'ah did not hear from 'Amr bin Shu'ayb, as Abu Hatim al-Razi said.
Reference / Source: Also, 'Abd al-Razzaq (13851, 19138) and Ibn Abi Shaybah (11/ 364) narrated it at length and in brief via Ibn Jurayj; and 'Abd al-Razzaq (13852) via Sufyan bin 'Uyaynah, from Ya'qub bin 'Ata'; both from 'Amr bin Shu'ayb, from the Prophet (peace and blessings be upon him) as "mursal".
Technical note / Defect ('illah): Ya'qub bin 'Ata' is weak.
ورواه عبد الجبار بن العلاء عند الخطيب في "تاريخه" 6/ 159 عن سفيان بن عيينة، عن يعقوب بن عطاء، عن عمرو بن شعيب، عن أبيه، عن جده، به موصولًا!
Reference / Source: 'Abd al-Jabbar bin al-'Ala' narrated it (in al-Khatib's "Tarikh" 6/ 159) from Sufyan bin 'Uyaynah, from Ya'qub bin 'Ata', from 'Amr bin Shu'ayb, from his father, from his grandfather, as "connected" (mawsul)!
وفي الباب عن ابن عمر في حديث طويل عند ابن حبان (5996)، وفيه: "فمن عَهَر بامرأة لا يملكها، أو بامرأة قوم آخرين فولدت فليس بولده، لا يرث ولا يورث". وإسناده حسن.
Corroborating chains and supporting reports: On this topic there is a long hadith from Ibn 'Umar (may Allah be pleased with them) in Ibn Hibban (5996), in which it says: "Whoever commits fornication with a woman he does not own, or with a woman of other people, and she gives birth, then (the child) is not his child; he neither inherits nor is inherited from."
Grading: Its chain is hasan.
