حدثنا أبو العباس محمد بن يعقوب، حدثنا يحيى بن أبي طالب، حدثنا يزيد بن هارون، حدثنا أبو أُميّة بن يَعلَى الثقفي، عن أبي الزِّناد، عن عمرو بن وُهَيب (2)، عن أبيه، عن زيد بن ثابت في المُشتركة (3) قال: هَبُوا أنَّ أباهم كان حِمارًا ما زادهم الأبُ إلَّا قُربًا، وأَشْرَكَ بينَهم في الثُّلث (4). هذا حديث صحيح الإسناد، ولم يُخرجاه. وشرحُه بالحديث الذي: [التعليق - من تلخيص الذهبي] ترقيم العلميه 7969 - صحيح
It is narrated from Sayyiduna Zayd bin Thabit (may Allah be pleased with him) concerning "the shared case (al-mushtarakah)" (in which the husband, the mother, maternal half-brothers and full brothers are the heirs) that he said in favour of the full brothers: "Suppose that their father was a donkey; the father's share (in their lineage) has only increased their closeness (to the deceased)." So he made the full brothers share with the maternal half-brothers in the one-third (1/3).
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(4) إسناده ضعيف، أبو أمية بن يعلى - واسمه إسماعيل - متروك الحديث، وعمرو بن وهيب لم نقف له على ترجمة، ووالده وهيب: هو مولى زيد بن ثابت وكاتبه، ترجم له البخاري في "التاريخ الكبير" 8/ 176 - 177 وابن أبي حاتم في "الجرح والتعديل" 9/ 34 ولم يذكرا فيه جرحًا ولا تعديلًا، وذكره ابن حبان في "ثقاته": 5/ 495، وذكروا في الرواة عنه اثنين. وأسند العقيلي في "الضعفاء" 1/ 257 عن عبد الرحمن بن أبي الزناد لما سُئل عن هذا الخبر، قال: ما أَعرِف عمرو بن وُهيب، وما كان أَبي يحدِّث عن زيد بن ثابت إلّا بأصول الفرائض. Grading: Its chain is weak. Technical note / Defect ('illah): Abu Umayyah bin Ya'la (whose name is Isma'il) is matruk al-hadith; and we found no biography for 'Amr bin Wuhayb. His father Wuhayb was the freed slave (mawla) and scribe of Zayd bin Thabit; al-Bukhari gave his biography in "al-Tarikh al-Kabir" (8/176-177) and Ibn Abi Hatim in "al-Jarh wa al-Ta'dil" (9/34), but they mentioned neither criticism nor praise of him. Ibn Hibban mentioned him in "al-Thiqat" (5/495), and they listed two narrators who narrated from him. Reference / Source: Al-'Uqayli in "al-Du'afa'" (1/257) narrated with his chain from 'Abd al-Rahman bin Abi al-Zinad that when he was asked about this report, he said: "I do not know 'Amr bin Wuhayb, and my father narrated from Zayd bin Thabit only the principles of the laws of inheritance." وأخرج الخبر البيهقي 6/ 256 عن أبي عبد الله الحاكم، بهذا الإسناد. Reference / Source: Al-Bayhaqi (6/256) recorded the report from Abu 'Abd Allah al-Hakim with this chain.
