وقد حدَّثَناه عبد الرحمن بن حَمْدان، حدثنا أبو حاتم الرازي، حدثنا محمد بن مِهْران، حدثنا يحيى بن سُلَيم الطائفي (1)، عن إسماعيل بن أُميّة، عن نافع، عن ابن عمر، عن النبيِّ ﷺ قال: "الولاء لُحْمةٌ من النَّسَب، لا يُباعُ ولا يُوهَب" (1)

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "Al-wala' (the bond of patronage) is a part of lineage; it can neither be sold nor given to anyone as a gift."

(1) وقع في النسخ الخطية: محمد بن مسلم، وهو في ظننا تحريف قديم تتابع عليه النساخ، فإنَّ إسماعيل بن أمية لا يروي عنه إلَّا يحيى بن سليم الطائفي، ولا يعرف هذا الخبر من هذا الطريق إلَّا من رواية يحيى هذا، وقد وهم فيه كما سيأتي.
Note / Clarification: In the manuscripts (the narrator's name) is written as "Muhammad bin Muslim"; in our view this is an old distortion (error) which the copyists kept following; for (the context shows that he is) Isma'il bin Umayyah, from whom no one narrates (this) except Yahya bin Sulaym al-Ta'ifi, and this report is not known through this route except from the narration of Yahya, and Yahya made an "error" (wahm) in it, as will come.

(1) إسناده ضعيف لاضطراب يحيى بن سليم فيه، فقد اختلف عليه في إسناده ومتنه كما سيأتي.
Grading: Its chain is da'if (weak) because of "idtirab" (inconsistency) on the part of Yahya bin Sulaym in it; there is disagreement on him in both its chain and its text, as will come.
قال الدارقطني في "العلل" 13/ 63: رواه يحيى بن سليم الطائفي عن إسماعيل بن أمية عن نافع عن ابن عمر: قال رسول الله ﷺ: "إنما الولاء لحمة من النسب، لا يباع ولا يوهب"، حدث به محمد بن زياد الزيادي عن يحيى بن سليم الطائفي كذلك، ووهم في قوله: عن إسماعيل بن أمية. قلنا: طريق الزيادي عن يحيى بن سليم أخرجها الطبراني في "الأوسط" (1318)، والبيهقي 1/ 293.
Technical note / Defect ('illah): Al-Daraqutni said in "al-'Ilal" (13/ 63): "Yahya bin Sulaym al-Ta'ifi narrated it from Isma'il bin Umayyah, from Nafi', from Ibn 'Umar, that the Messenger of Allah (peace and blessings be upon him) said: 'Wala' is but a bond of lineage; it is neither sold nor given away.' Muhammad bin Ziyad al-Ziyadi narrated it thus from Yahya bin Sulaym al-Ta'ifi, and he erred in saying 'from Isma'il bin Umayyah'." We say: al-Ziyadi's route from Yahya bin Sulaym was narrated by al-Tabarani in "al-Awsat" (1318) and al-Bayhaqi (1/ 293).
ثم قال الدارقطني: وخالفه يعقوب بن كاسب فرواه عن يحيى بن سليم، عن عبيد الله بن عمر، عن نافع، عن ابن عمر، وهذا أشبه عن يحيى بن سليم. قلنا: وطريق يعقوب بن حميد بن كاسب عن يحيى بن سليم أخرجها البيهقي 10/ 293، والرافعي في "التدوين في أخبار قزوين" 2/ 130. وقال البيهقي عقبه: هذا وهم من يحيى بن سليم أو ممّن دونه في الإسناد والمتن جميعًا، فإن الحفاظ إنما رووه عن عبيد الله بن عمر عن عبد الله بن دينار عن ابن عمر عن النبي ﷺ أنه نهى عن بيع الولاء وعن هبته.
Technical note / Defect ('illah): Then al-Daraqutni said: "Ya'qub bin Kasib contradicted him, narrating it from Yahya bin Sulaym, from 'Ubaydullah bin 'Umar, from Nafi', from Ibn 'Umar; and this is more likely (ashbah) to be from Yahya bin Sulaym." We say: the route of Ya'qub bin Humayd bin Kasib was narrated by al-Bayhaqi (10/ 293) and al-Rafi'i in "al-Tadwin" (2/ 130). Al-Bayhaqi said after it: "This is an error (wahm) of Yahya bin Sulaym, or of someone below him, in both 'the chain and the text'. For the huffaz narrated it from 'Ubaydullah bin 'Umar, from 'Abdullah bin Dinar, from Ibn 'Umar, that the Prophet (peace and blessings be upon him) forbade selling wala' and giving it away."
وجاء في "العلل" لابن أبي حاتم: (1645): سئل أبو زرعة عن حديث يعقوب بن حميد بن كاسب عن يحيى بن سليم الطائفي عن عبيد الله بن عمر عن نافع عن ابن عمر: أنَّ النبي ﷺ قال: "الولاء لحمة كلحمة النسب، لا يباع ولا يوهب"، قال أبو زرعة: الصحيح: عبيد الله عن عبد الله بن دينار عن ابن عمر عن النبي ﷺ: أنه نهى عن بيع الولاء وعن هبته.
Technical note / Defect ('illah): In "al-'Ilal" of Ibn Abi Hatim (1645): Abu Zur'ah was asked about the hadith of Ya'qub bin Humayd bin Kasib, from Yahya bin Sulaym, from 'Ubaydullah bin 'Umar, from Nafi', from Ibn 'Umar, which says: "Wala' is a bond like the bond of lineage; it is neither sold nor given away." Abu Zur'ah said: "What is correct is: 'Ubaydullah, from 'Abdullah bin Dinar, from Ibn 'Umar, from the Prophet (peace and blessings be upon him), that he forbade selling wala' and giving it away."
وأخرجه ابن ماجه (2747)، والترمذي في "العلل الكبير" (318) عن محمد بن عبد الملك بن أبي الشوارب، عن يحيى بن سليم، عن عبيد الله بن عمر، عن نافع، عن ابن عمر، قال: نهى رسول الله ﷺ عن بيع الولاء وعن هبته. قال الترمذي عقبه: والصحيح عن عبد الله بن دينار، وعبد الله بن دينار قد تفرَّد بهذا الحديث عن ابن عمر، ويحيى بن سليم أخطأ في حديثه. وقال البيهقي 10/ 293: وقد رواه محمد بن عبد الملك بن أبي الشوارب عن يحيى بن سليم على الوهم في إسناده دون متنه.
Reference / Source: Ibn Majah (2747) and al-Tirmidhi in "al-'Ilal al-Kabir" (318) narrated it from Muhammad bin 'Abd al-Malik bin Abi al-Shawarib, from Yahya bin Sulaym, from 'Ubaydullah bin 'Umar, from Nafi', from Ibn 'Umar, that the Messenger of Allah (peace and blessings be upon him) forbade selling wala' and giving it away.
Grading: Al-Tirmidhi said after it: "What is correct is from 'Abdullah bin Dinar, and 'Abdullah bin Dinar is alone in narrating this hadith from Ibn 'Umar, while Yahya bin Sulaym erred in his hadith (chain)." Al-Bayhaqi (10/ 293) said: "Muhammad bin 'Abd al-Malik narrated it from Yahya bin Sulaym with the 'error' in its chain, not in its text."
قلنا: لم ينفرد يحيى بن سليم بمتنه على اللفظ الأول، فقد تابعه سفيان الثوري عن عبيد الله ابن عمر، أخرجه ابن جميع الصيداوي في "معجم الشيوخ" ص 311 - 312 عن عبد الرحمن بن أحمد بن مليك، عن محمد بن إسحاق، عن زياد بن أيوب، عن جرير ويحيى القطان، عن الثوري، عن عبيد الله بن عمر، عن نافع عن ابن عمر، عن النبي ﷺ قال: "الولاء لحمة كلحمة النسب". لكن عبد الرحمن بن أحمد بن مليك لم نقف له على ترجمة، وهو غريب بهذا اللفظ عن سفيان الثوري، والمحفوظ ما رواه أصحاب سفيان (كأبي نعيم وعبد الله بن نمير ووكيع وعبد الرحمن بن مهدي) عنه عن عبد الله بن دينار عن ابن عمر بلفظ: نهى النبي ﷺ عن بيع الولاء وعن هبته. أخرجه كذلك البخاري (6756)، ومسلم (1506)، وابن ماجه (2747)، والترمذي (1236)، والنسائي (6383)، وابن حبان (4949) وغيرهم.
Corroborating chains and supporting reports: We say: Yahya bin Sulaym is not alone in narrating the text with the first wording; rather, Sufyan al-Thawri corroborated him, narrating from 'Ubaydullah bin 'Umar. Ibn Jumay' al-Saydawi narrated it in "Mu'jam al-Shuyukh" (pp. 311-312) from 'Abd al-Rahman bin Ahmad bin Mulayk, from Muhammad bin Ishaq, from Ziyad bin Ayyub, from Jarir and Yahya al-Qattan, from Sufyan al-Thawri, from 'Ubaydullah bin 'Umar, from Nafi', from Ibn 'Umar, from the Prophet (peace and blessings be upon him), who said: "Wala' is a bond like the bond of lineage."
Technical note / Defect ('illah): However, we have not found a biography of 'Abd al-Rahman bin Ahmad bin Mulayk, and it is a "gharib" (unusual) narration from Sufyan al-Thawri with this wording. What is "preserved" (mahfuz) is what the students of Sufyan (such as Abu Nu'aym, 'Abdullah bin Numayr, Waki' and 'Abd al-Rahman bin Mahdi) narrated from him, from 'Abdullah bin Dinar, from Ibn 'Umar, with the wording: "The Prophet (peace and blessings be upon him) forbade selling wala' and giving it away."
Reference / Source: It was narrated thus by al-Bukhari (6756), Muslim (1506), Ibn Majah (2747), al-Tirmidhi (1236), al-Nasa'i (6383), Ibn Hibban (4949) and others.
وأخرجه ابن عدي في ترجمة الحسن بن أبي الحسن المؤذن من "الكامل" 2/ 332 - ومن طريقه الخطيب في "موضح الأوهام" 2/ 30 - من طريق عَبد الله بن عمر، عن نافع، عن عبد الله بن دينار، عن ابن عمر مرفوعًا بلفظ: "إنما الولاء نسب، لا يصلح بيعه ولا شراؤه". وقال ابن عدي عقبَه: قوله: "عن نافع عن عبد الله" لا أدري وهم فيه أو تعمّد، فأراد يقلب الإسناد، وإِنما أراد يقول: عن نافع وعبد الله بن دينار؟ وقال ابن عدي عن الحسن المؤذن: منكر الحديث عن الثقات ويقلب الأسانيد. وعبد الله بن عمر وهو العمري ليّن الحديث أيضًا.
Reference / Source: Ibn 'Adi narrated it in "al-Kamil" (2/ 332) in the biography of al-Hasan bin Abi al-Hasan al-Mu'adhdhin - and via him al-Khatib in "Mudih al-Awham" (2/ 30) - via 'Abdullah bin 'Umar, from Nafi', from 'Abdullah bin Dinar, from Ibn 'Umar as marfu', with the wording: "Wala' is but lineage; neither its sale nor its purchase is valid."
Technical note / Defect ('illah): Ibn 'Adi said after it: As for his saying "from Nafi', from 'Abdullah", I do not know whether he erred in it or did it deliberately in order to invert (qalb) the chain; or perhaps he meant to say: "from Nafi' and 'Abdullah bin Dinar" (i.e. from both)? Ibn 'Adi said about al-Hasan al-Mu'adhdhin: "He narrates munkar reports from trustworthy narrators and inverts chains." Also 'Abdullah bin 'Umar (al-'Umari) (in the chain) is "layyin al-hadith" (weak).
وأخرجه ابن عدي 4/ 165 من طريق عبد الله بن نافع، عن أبيه، أنَّ ابن عمر كان يقول: إنما الولاء نسب، لا يصلح بيع الولاء ولا هبته، وقد قضي رسول الله ﷺ أن الولاء لمن أعتق. فوقفه، وعبد الله بن نافع ضعيف.
Reference / Source: Ibn 'Adi (4/ 165) narrated it via 'Abdullah bin Nafi', from his father, that Ibn 'Umar (may Allah be pleased with them) used to say: "Wala' is but lineage; neither the sale of wala' nor giving it away is valid, and the Messenger of Allah (peace and blessings be upon him) ruled that wala' belongs to the one who sets free."
Grading: So he made it mawquf, and 'Abdullah bin Nafi' is weak.
وأما من رواه من طريق نافع عن ابن عمر بلفظ رواية الجماعة:
Details of the narration: As for those who narrated it via Nafi', from Ibn 'Umar, with "the wording of the group's narration" (the details are as follows):
فأخرجه أبو عوانة (4807)، والخطيب البغدادي في "تاريخه" 6/ 306، وفي "الفصل للوصل" 1/ 579 من طريق سعيد بن يحيى بن سعيد، الأموي، عن أبيه، عبيد الله بن عمر، عن نافع وعبد الله بن دينار، عن ابن عمر، قال نهى رسول الله ﷺ عن بيع الولاء وعن هبته وقرن بنافع عبدَ الله بن دينار، ورجاله ثقات، وسئل أبو حاتم الرازي كما في "العلل" (1107) عن رواية سعيد الأموي هذه، فقال: أخذه نافع عن عبد الله بن دينار. وقال الدارقطني كما في "أطراف الغرائب" 3/ 465: لا نعلم رواه عن يحيى الأموي عن عبيد الله عن نافع وعبد الله بن دينار غير ابنه سعيد، ورواه علي بن عاصم عن عبيد الله بن عمر عنهما أيضًا، وتفرد به عنه أحمد بن عبيد بن ناصح. قلنا: وعلي بن عاصم وأحمد بن عبيد كلاهما ضعيف.
Reference / Source: Abu 'Awanah (4807) and al-Khatib al-Baghdadi in his "Tarikh" (6/ 306) and "al-Fasl li-l-Wasl" (1/ 579) narrated it via Sa'id bin Yahya bin Sa'id al-Umawi, from his father, from 'Ubaydullah bin 'Umar, from (both) Nafi' and 'Abdullah bin Dinar, from Ibn 'Umar, that the Messenger of Allah (peace and blessings be upon him) forbade selling wala' and giving it away. So he joined 'Abdullah bin Dinar with Nafi', and its narrators are trustworthy.
Technical note / Defect ('illah): Abu Hatim al-Razi was asked about this narration of Sa'id al-Umawi (as in "al-'Ilal" 1107), and he said: "Nafi' took it from 'Abdullah bin Dinar." Al-Daraqutni said (as in "Atraf al-Ghara'ib" 3/ 465): "We do not know anyone who narrated it from Yahya al-Umawi, from 'Ubaydullah, from Nafi' and 'Abdullah bin Dinar, other than his son Sa'id. 'Ali bin 'Asim also narrated it from 'Ubaydullah bin 'Umar, from both of them (Nafi' and 'Abdullah bin Dinar), but Ahmad bin 'Ubayd bin Nasih is alone in narrating it from him." We (the editors) say: 'Ali bin 'Asim and Ahmad bin 'Ubayd are both weak.
وأخرجه كذلك أبو عوانة (4809) من طريق أبي ضمرة أنس بن عياض، عن عبيد الله بن عمر، عن نافع وعبد الله بن دينار، عن ابن عمر أنه نهى عن بيع الولاء، وعن هبته، لكنه لم يرفعه، ورجاله في الجملة ثقات إن كان محمد بن أبان راويه عن أبي ضمرة هو القرشي، وإلَّا لم نعرفه، لكن قال ابن أبي حاتم الرازي في "العلل" (1130): سألت أبي وأبا زرعة عن حديث رواه أنس بن عياض، فذكر هذا الحديثَ، فقالا: هذا خطأ؛ وهم فيه أبو ضمرة، الناس يقولون: عبيد الله عن عبد الله بن دينار عن ابن عمر عن النبي ﷺ، ويروون عن نافع عن ابن عمر موقوفًا: الولاء لحمة؛ وهذا هو الصحيح.
Reference / Source: Abu 'Awanah (4809) narrated it via Abu Damrah Anas bin 'Iyad, from 'Ubaydullah bin 'Umar, from Nafi' and 'Abdullah bin Dinar, from Ibn 'Umar, that he forbade selling wala' and giving it away; but he did not make it marfu' (rather he kept it mawquf).
Grading: Its narrators are on the whole trustworthy if Muhammad bin Aban, who narrates it from Abu Damrah, is "al-Qurashi"; otherwise we do not know him.
Technical note / Defect ('illah): However, Ibn Abi Hatim al-Razi says in "al-'Ilal" (1130): I asked my father and Abu Zur'ah about this hadith narrated by Anas bin 'Iyad, and they both said: "This is a mistake; Abu Damrah erred in it. People (the huffaz) narrate it as: 'Ubaydullah, from 'Abdullah bin Dinar, from Ibn 'Umar, from the Prophet (peace and blessings be upon him) (as marfu'); and they narrate from Nafi', from Ibn 'Umar, as mawquf: 'Wala' is a bond'; and this is what is correct."
وأخرجه الخطيب في تاريخه 5/ 478 من طريق عبد الرحمن بن مغراء، عن عبيد الله بن عمر، عن نافع، عن ابن عمر قال: نهى رسول الله ﷺ عن بيع الولاء وعن هبته وسنده ضعيف بمرة.
Reference / Source: Al-Khatib narrated it in his "Tarikh" (5/ 478) via 'Abd al-Rahman bin Maghra', from 'Ubaydullah bin 'Umar, from Nafi', from Ibn 'Umar, that the Messenger of Allah (peace and blessings be upon him) forbade selling wala' and giving it away.
Grading: Its chain is "extremely weak" (da'if bi-marrah).
وقد أخرج الخطيب هذا الحديث في "الفصل للوصل" 1/ 583 من طريق يحيى القطان، عن عبيد الله بن عمر، عن نافع، عن ابن عمر. وفي الطريق إليه بين ضعيف ومجهول.
Reference / Source: Al-Khatib narrated this hadith in "al-Fasl li-l-Wasl" (1/ 583) via Yahya al-Qattan, from 'Ubaydullah bin 'Umar, from Nafi', from Ibn 'Umar.
Grading: In the route (up to Yahya) there are weak and unknown narrators.
وأخرجه أيضًا 1/ 584 من طريق قبيصة بن عقبة، عن سفيان الثَّوري، عن عبيد الله، عن نافع، عن ابن عمر. وفي رواية قبيصة عن سفيان كلام، وقد سبقت الإشارة قريبًا إلى أنَّ أصحاب الثوري رووه عنه عن عبد الله بن دينار عن ابن عمر، وليس من طريق نافع عن ابن عمر.
Reference / Source: He also narrated it (1/ 584) via Qabisah bin 'Uqbah, from Sufyan al-Thawri, from 'Ubaydullah, from Nafi', from Ibn 'Umar.
Technical note / Defect ('illah): There is "criticism" regarding Qabisah's narration from Sufyan. And it has been pointed out shortly before that the students of al-Thawri narrated it from him "from 'Abdullah bin Dinar, from Ibn 'Umar", not via Nafi'.
وتابع نصرُ بن مزاحم قبيصةَ عن الثوري عند الخطيب أيضًا 1/ 584 و 584 - 585، لكن نصر متروك متهم بالكذب، فلا يفرح بمتابعته. قال الخطيب في "الفصل للوصل" 1/ 580: رواية عبيد الله عن عبد الله بن دينار فهي المحفوظة، وأما روايته إياه عن نافع فهي غريبة جدًّا.
Corroborating chains and supporting reports: Nasr bin Muzahim corroborated Qabisah in narrating from al-Thawri (al-Khatib 1/ 584, 585).
Grading: But Nasr is "matruk" and "accused" of lying, so his corroboration is no cause for rejoicing (it is not relied upon).
Technical note / Defect ('illah): Al-Khatib said in "al-Fasl li-l-Wasl" (1/ 580): "The narration of 'Ubaydullah from 'Abdullah bin Dinar is the 'preserved' one, whereas his narration from Nafi' is 'extremely gharib'."
