Mustadrak al-Hakim — Hadith 8189

حدثنا أبو العباس محمد بن يعقوب عَوْدًا على بَدْءٍ، حدثنا الرَّبيع بن سليمان، حدثنا الشافعي، أخبرنا محمد بن الحسن عن أبي يوسف، عن عبد الله بن دينار عن ابن عمر، أنَّ النبي ﷺ قال: "الوَلاءُ لُحْمَةٌ كلُّحْمةِ النَّسَب، لا يُباع ولا يُوهَبُ" (1)
هذا حديث صحيح الإسناد، ولم يُخرجاه.
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "Al-wala' (the bond between a freed slave and his former master) is a strong bond like the bond of lineage; it can neither be sold nor given away as a gift (hibah)."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) حديث صحيح من غير ذكر لُحمة النسب، وهذا إسناد لا بأس برواته، لكن سقط منه ذكر عبيد الله بن عمر بين أبي يوسف - وهو يعقوب بن إبراهيم بن حبيب الأنصاري القاضي صاحب أبي حنيفة - وبين عبد الله بن دينار، وقد رواه محمد بن الحسن في كتاب "الولاء" على الصواب بذكر عبيد الله بن عمر، وأبو يوسف لم يسمع من ابن دينار شيئًا فيما قاله الدارقطني في "الغرائب" كما في "أطرافه" لابن طاهر 3/ 387.
Grading: This hadith is sahih without the mention of "luhmat al-nasab" (a bond like that of lineage). The narrators of this chain are acceptable (la ba'sa bihim), but the mention of "'Ubaydullah bin 'Umar" has dropped from it between Abu Yusuf (Ya'qub bin Ibrahim bin Habib al-Ansari al-Qadi, the student of Abu Hanifah) and 'Abdullah bin Dinar.
Technical note / Defect ('illah): Muhammad bin al-Hasan narrated it correctly in the book "al-Wala'", mentioning 'Ubaydullah bin 'Umar; and Abu Yusuf did not hear anything from Ibn Dinar, as al-Daraqutni stated in "al-Ghara'ib" (as in Ibn Tahir's "Atraf" 3/ 387).
وقال الدارقطني في "العلل" 13/ 63: والمحفوظ عن عبد الله بن دينار عن ابن عمر: أَن النَّبي ﷺ نهى عن بيع الولاء وعن هبته. وقال البيهقي في "بيان خطأ من أخطأ على الشافعي" ص 293: رواية الجماعة عن عبيد الله بن عمر عن عبد الله بن دينار عن ابن عمر عن النبي ﷺ: أنه نهى عن بيع الولاء وعن هبته وكذلك رواه مالك والثوري وشعبة وسفيان بن عيينة وسليمان بن بلال والضحاك بن عثمان وإسماعيل بن جعفر وغيرهم عن عبد الله بن دينار.
Technical note / Defect ('illah): Al-Daraqutni said in "al-'Ilal" (13/ 63): "What is preserved from 'Abdullah bin Dinar, from Ibn 'Umar, is that the Prophet (peace and blessings be upon him) forbade selling wala' (the right of inheritance through manumission) and giving it away." Al-Bayhaqi said in "Bayan Khata' man Akhta'a 'ala al-Shafi'i" (p. 293): "The narration of the group from 'Ubaydullah bin 'Umar, from 'Abdullah bin Dinar, from Ibn 'Umar, is that the Prophet (peace and blessings be upon him) forbade selling wala' and giving it away (and this is correct); and likewise Malik, al-Thawri, Shu'bah, Sufyan bin 'Uyaynah, Sulayman bin Bilal, al-Dahhak bin 'Uthman, Isma'il bin Ja'far and others narrated it from 'Abdullah bin Dinar."
قلنا: ورواية الشافعي التي عند المصنف في "الأم" له 5/ 268، ومن طريق الشافعي أخرجه ابن المنذر في "الأوسط" (6945)، والبيهقي في "السنن الكبرى" 10/ 292، وفي "معرفة السنن" (20494)، وفي "بيان خطأ من أخطأ على الشافعي" ص 291 - 292. وقال البيهقي عقبه في "المعرفة": كذا رواه الشافعي عن محمد بن الحسن الفقيه عن أبي يوسف القاضي، وكأنه رواه محمدُ بن الحسن للشافعي من حفظه، فنزل عن ذكر عبيد الله بن عمر في إسناده. وقد رواه محمد بن الحسن في كتاب "الولاء" عن أبي يوسف، عن عبيد الله بن عمر، عن عبد الله بن دينار، عن ابن عمر، عن النبي ﷺ باللفظ الذي رواه الشافعي عنه، وهذا اللفظ بهذا الإسناد غير محفوظ، ورواية الجماعة عن عبد الله بن دينار عن ابن عمر: أن النبي ﷺ نهى عن بيع الولاء وعن هبته.
Important point: We (the editors) say: the narration of al-Shafi'i which the author (al-Hakim) has is found in his (al-Shafi'i's) book "al-Umm" (5/ 268).
Reference / Source: Via al-Shafi'i, Ibn al-Mundhir narrated it in "al-Awsat" (6945), and al-Bayhaqi in "al-Sunan al-Kubra" (10/ 292), "Ma'rifat al-Sunan" (20494) and "Bayan Khata' man Akhta'a 'ala al-Shafi'i" (pp. 291-292).
Technical note / Defect ('illah): Al-Bayhaqi said after it in "al-Ma'rifah": "Al-Shafi'i narrated it thus from Muhammad bin al-Hasan the jurist, from Abu Yusuf al-Qadi; and it seems that Muhammad bin al-Hasan narrated it to al-Shafi'i from memory, and so he omitted mentioning 'Ubaydullah bin 'Umar in its chain. For Muhammad bin al-Hasan narrated it in his book 'al-Wala'' from Abu Yusuf, from 'Ubaydullah bin 'Umar, from 'Abdullah bin Dinar, from Ibn 'Umar, from the Prophet (peace and blessings be upon him), with the same wording that al-Shafi'i narrated from him."
Grading: (But) this wording with this chain is "not preserved" (ghayr mahfuz); the narration of the group (of trustworthy narrators) from 'Abdullah bin Dinar, from Ibn 'Umar, is: "The Prophet (peace and blessings be upon him) forbade selling wala' and giving it away."
وأخرجه ابن حبان (4950) عن أبي يعلى عن بشر بن الوليد، عن يعقوب بن إبراهيم، عن عبيد الله بن عمر، عن عبد الله بن دينار، عن ابن عمر قال: قال رسول الله ﷺ: "الولاء لحمة كلحمة النسب، لا يباع ولا يوهب". فذكر فيه عبيد الله بن عمر، وبشر بن الوليد مختلف فيه كما في ترجمته من "اللسان" لابن حجر.
Reference / Source: Ibn Hibban (4950) narrated it from Abu Ya'la, from Bishr bin al-Walid, from Ya'qub bin Ibrahim, from 'Ubaydullah bin 'Umar, from 'Abdullah bin Dinar, from Ibn 'Umar, who said: The Messenger of Allah (peace and blessings be upon him) said: "Wala' is a bond like the bond of lineage; it is neither sold nor given away." So he mentioned 'Ubaydullah bin 'Umar in it.
Technical note / Defect ('illah): There is disagreement about Bishr bin al-Walid (the narrator), as in his biography in Ibn Hajar's "Lisan al-Mizan".
وأخرجه ابن عدي في "الكامل" 6/ 8 من طريق غسان بن عبيد، عن شعبة، عن عبد الله بن دينار، عن ابن عمر، أنَّ النبي ﷺ قال: "الولاء لحمة كالنسب لا يباع ولا يوهب". وغسان بين عبيد مختلف فيه أيضًا، وقد تفرد من بين أصحاب شعبة بذكره بهذا اللفظ، والمحفوظ عن شعبة أنه كرواية الجماعة عن ابن دينار، أخرج روايته أحمد 9/ (5496) و 10/ (5850)، والبخاري (2535)، ومسلم (1506)، وأبو داود (2919)، وابن ماجه (2747)، والترمذي (1236)، والنسائي (6210) و (6381)، وابن حبان (4948) وغيرهم من طرق عنه.
Reference / Source: Ibn 'Adi narrated it in "al-Kamil" (6/ 8) via Ghassan bin 'Ubayd, from Shu'bah, from 'Abdullah bin Dinar, from Ibn 'Umar, that the Prophet (peace and blessings be upon him) said: "Wala' is a bond like lineage; it is neither sold nor given away."
Technical note / Defect ('illah): There is also disagreement about Ghassan bin 'Ubayd, and he is alone among the students of Shu'bah in narrating it with this wording. What is "preserved" (mahfuz) from Shu'bah is like the narration of the group from Ibn Dinar.
Details of the narration: Shu'bah's (correct) narration was narrated by Ahmad (9/ 5496, 10/ 5850), al-Bukhari (2535), Muslim (1506), Abu Dawud (2919), Ibn Majah (2747), al-Tirmidhi (1236), al-Nasa'i (6210, 6381), Ibn Hibban (4948) and others via various routes from him.
وأخرجه البيهقي في "السنن" 10/ 293 من طريق الطبراني، عن يحيى بن عبد الباقي الأذني، عن أبي عمير بن النحاس - وهو عيسى بن محمد بن إسحاق - عن ضمرة، عن سفيان، عن عبد الله بن دينار، عن ابن عمر عن النبي ﷺ قال: "الولاء لحمة كلحمة النسب، لا يباع ولا يوهب". وقال الطبراني: لم يرو هذا الحديث عن سفيان إلَّا ضمرة. قلنا: ضمرة هو ابن ربيعة الفلسطيني، وهو ثقة، لكن قال البيهقي: قد رواه إبراهيم بن محمد بن يوسف الفريابي (وقد سلفت هذه الرواية عند المصنف برقم: 2887 م) عن ضمرة كما رواه الجماعة: نهى عن بيع الولاء وعن هبته، فكأن الخطأ وقع من غيره، والله أعلم. قلنا فيكون الخلاف في لفظه بين عيسى أبي عمير وبين إبراهيم بن محمد الفريابي وهو صدوق حسن الحديث، وروايته أَولى بالقبول لكونها موافقة لرواية الجماعة، لذلك وهَّم البيهقي في "بيان الخطأ" ص 294 رواية أبي عمير وقال: قد أجمع أصحاب الثوري على خلافه.
Reference / Source: Al-Bayhaqi narrated it in "al-Sunan" (10/ 293) via al-Tabarani, from Yahya bin 'Abd al-Baqi al-Adhani, from Abu 'Umayr bin al-Nahhas ('Isa bin Muhammad bin Ishaq), from Damrah, from Sufyan, from 'Abdullah bin Dinar, from Ibn 'Umar, that the Prophet (peace and blessings be upon him) said: "Wala' is a bond like the bond of lineage; it is neither sold nor given away." Al-Tabarani said: No one narrated it from Sufyan except Damrah.
Technical note / Defect ('illah): We say: Damrah is "Ibn Rabi'ah al-Filastini", and he is thiqah (trustworthy). But al-Bayhaqi said: Ibrahim bin Muhammad bin Yusuf al-Firyabi (this narration has passed with the author at number 2887 M) narrated it from Damrah just as "the group" narrated it (namely): "He forbade selling wala' and giving it away." So it appears that the error came from someone else (another narrator). And Allah knows best.
Important point: We say: thus the difference in wording is between 'Isa Abu 'Umayr and Ibrahim bin Muhammad al-Firyabi; and Ibrahim al-Firyabi is "saduq and hasan al-hadith", and his narration is more worthy of acceptance because it agrees with the narration of the group. For this reason al-Bayhaqi in "Bayan al-Khata'" (p. 294) declared the narration of Abu 'Umayr an "error" (wahm) and said: "The students of al-Thawri are unanimous in contradicting it."
وقد ذكر له الدارقطني في "العلل" 13/ 63 طريقًا آخر عن الثوري، فقال: رواه أَبو إسماعيل محمد بن إسماعيل الفارسي عن الثوري فقال: عن عبد الله بن دينار عن ابن عمر: قال رسول الله ﷺ:
Reference / Source: Al-Daraqutni mentioned another route for it from al-Thawri in "al-'Ilal" (13/ 63), saying: Abu Isma'il Muhammad bin Isma'il al-Farisi narrated it from al-Thawri and said: from 'Abdullah bin Dinar, from Ibn 'Umar: the Messenger of Allah (peace and blessings be upon him) said:
الولاء لحمة كالنسب، لا يباع ولا يوهب، ولم يروه عن الثوري بهذا اللفظ غيره، والمحفوظ: نهى عن بيع الولاء وعن هبته. قلنا: قال ابن حبان عن الفارسي: يُغرِب.
Note / Clarification: "Wala' is a bond like lineage; it is neither sold nor given away." No one other than him (al-Farisi) narrated it from al-Thawri with this wording.
Grading: And the preserved wording is: "He forbade selling wala' and giving it away."
Technical note / Defect ('illah): We say: Ibn Hibban said about (Abu Isma'il) al-Farisi: "yughrib" (he narrates odd, unusual reports).

وفي الباب عن عبد الله بن أبي أوفى عند أبي نعيم في "معرفة الصحابة" (4013)، وفي "تاريخ أصبهان" 2/ 8، ومن طريقه الخطيب في "تاريخ بغداد" 13/ 526، وفي سنده يحيى بن هاشم السمسار، وهو متروك متهم بالكذب. وتابعه عبيد بن القاسم عند الطبري في "تهذيب الآثار" كما في "البدر المنير" 9/ 717، وابن عدي في ترجمة عبيد بن القاسم الأسدي من "الكامل" 5/ 349، وهو أيضًا متروك متهم. وتحرَّف عبيد بن القاسم إلى عبثر بن القاسم على ابن الملقن في "البدر المنير"، فصحّحه لذلك!
Corroborating chains and supporting reports: On this topic there is a narration from 'Abdullah bin Abi Awfa with Abu Nu'aym in "Ma'rifat al-Sahabah" (4013) and "Tarikh Asbahan" (2/ 8), and via him with al-Khatib in "Tarikh Baghdad" (13/ 526).
Technical note / Defect ('illah): Its chain contains Yahya bin Hashim al-Simsar, who is "matruk" and accused of lying. He was corroborated by 'Ubayd bin al-Qasim [in al-Tabari's "Tahdhib al-Athar", as cited in "al-Badr al-Munir" (9/ 717); and in Ibn 'Adi's "al-Kamil" (5/ 349)]; and he ('Ubayd) too is "matruk and accused". In Ibn al-Mulaqqin's "al-Badr al-Munir" the name 'Ubayd bin al-Qasim was distorted into "'Abthar bin al-Qasim", and for that reason he declared it sahih!
وعن أبي هريرة عند ابن عدي في "الكامل" 7/ 189 من طريق يحيى بن أبي أُنيسة، عن الزهري، عن سعيد بن المسيب، عن أبي هريرة مرفوعًا. وقال عقبه: هذا ليس بمحفوظ عن الزهري. قلنا: يحيى بن أبي أنيسة قال الذهبي: تالف.
Corroborating chains and supporting reports: From Abu Hurayrah (may Allah be pleased with him): Ibn 'Adi narrated it in "al-Kamil" (7/ 189) via Yahya bin Abi Unaysah, from al-Zuhri, from Sa'id bin al-Musayyab, from Abu Hurayrah as marfu'.
Grading: Ibn 'Adi said after it: "This is not preserved from al-Zuhri." We say: al-Dhahabi said about Yahya bin Abi Unaysah: "talif" (ruined, i.e. extremely weak).
وعن الحسن البصري، لكن اختلف عليه في رفعه ووقفه فأخرجه مرفوعًا عنه البيهقي 6/ 240، و 10/ 292. وأخرجه موقوفًا عنه عبد الرزاق (16147)، وابن أبي شيبة 6/ 123 و 11/ 419، والدارمي (3204). والموقوف أصحُّ. ومراسيل الحسن وهَّنها العلماء، انظر "طبقات ابن سعد" 9/ 158، و"سنن الدارقطني" 1/ 314، و "الكفاية" للخطيب ص 386، لذلك قال الحافظ ابن حجر في "فتح الباري" 21/ 146: كانوا لا يعتمدون مراسيلَ الحسن، لأنَّه كان يأخذ عن كلِّ أحد.
Corroborating chains and supporting reports: It is also narrated from al-Hasan al-Basri, but there is disagreement over whether it is marfu' or mawquf. Al-Bayhaqi (6/ 240, 10/ 292) narrated it as marfu', while 'Abd al-Razzaq (16147), Ibn Abi Shaybah (6/ 123, 11/ 419) and al-Darimi (3204) narrated it as mawquf.
Grading: The mawquf narration is more authentic.
Technical note / Defect ('illah): The scholars have considered the mursal reports of al-Hasan al-Basri weak. See "Tabaqat Ibn Sa'd" (9/ 158), "Sunan al-Daraqutni" (1/ 314) and al-Khatib's "al-Kifayah" (p. 386). Hence al-Hafiz Ibn Hajar said in "Fath al-Bari" (21/ 146): "They did not rely on the mursal reports of al-Hasan, because he would take from everyone."
