Mustadrak al-Hakim — Hadith 8188

وأخبرنا أبو يحيى، حدثنا محمد بن نصر، حدثنا محمد بن إسحاق، حدثنا يحيى بن أبي بُكير، عن إبراهيم بن طَهْمان عن سِمَاك، عن عِكرمة، عن ابن عباس قال: اختُصِمَ إلى علي بن أبي طالب في ولد مُلاعَنِة، فأعطَى ميراثَه أُمَّه، وجعلها عَصَبَتَه (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه، ومحمد بن إسحاق هذا: هو الصَّغَاني بلا شكٍّ فيه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a case was brought to Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) concerning the child of a woman with whom li'an had taken place. He (may Allah be pleased with him) gave his inheritance to his mother and made her his 'asabah.
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it; and Muhammad bin Ishaq in this chain is, without any doubt, "al-Saghani".

(1) إسناده حسن من أجل سماك، وهو - وإن كان في بعض رواياته عن عكرمة اضطراب - متابع. وأخرجه الدارمي (3011) عن محمد بن العلاء، والبيهقي 6/ 258 من طريق أبي الأزهر أحمد بن الأزهر، كلاهما عن يحيى بن أبي بكير، بهذا الإسناد.
Grading: Its chain is "hasan" because of Simak (bin Harb).
Technical note / Defect ('illah): Although there is some inconsistency (idtirab) in some of Simak's narrations from 'Ikrimah, here he is corroborated.
Reference / Source: Al-Darimi (3011) narrated it from Muhammad bin al-'Ala', and al-Bayhaqi (6/ 258) via Abu al-Azhar Ahmad bin al-Azhar; both from Yahya bin Abi Bukayr with this same chain.
وسيأتي عند المصنف برقم (8214) من طريق عبد الرحمن بن مهدي عن إبراهيم بن طهمان.
Note / Clarification: This hadith will come later with the author (al-Hakim) at number (8214) via 'Abd al-Rahman bin Mahdi, from Ibrahim bin Tahman.
وأخرج عبد الرزاق (12481) عن الحسن بن عمارة، عن الحكم بن عُتيبة، عن يحيى بن الجزار، عن علي، قال: عصبة ابن الملاعنة عصبة أمّه. وابن عمارة متروك الحديث.
Reference / Source: 'Abd al-Razzaq (12481) narrated from al-Hasan bin 'Umarah, from al-Hakam bin 'Utaybah, from Yahya bin al-Jazzar, from 'Ali (may Allah be pleased with him), who said: "The 'asabah of the child of the woman who underwent li'an are the 'asabah of his mother."
Grading: Al-Hasan bin 'Umarah is "matruk al-hadith" (abandoned in hadith).
وأخرج عبد الرزاق (12482)، وابن أبي شيبة 11/ 339، والدارمي (3004)، وابن المنذر (6853)، والطبراني (9663) من طريق محمد بن عبد الرحمن بن أبي ليلى، عن الشعبي، عن علي وعبد الله قالا: عصبة ابن الملاعنة عصبة أمه. وابن أبي ليلى يعتبر به في الشواهد والمتابعات.
Reference / Source: 'Abd al-Razzaq (12482), Ibn Abi Shaybah (11/ 339), al-Darimi (3004), Ibn al-Mundhir (6853) and al-Tabarani (9663) narrated it via Muhammad bin 'Abd al-Rahman bin Abi Layla, from al-Sha'bi, from 'Ali and 'Abdullah (bin Mas'ud), who said: "The 'asabah of the child of the woman who underwent li'an are the 'asabah of his mother."
Technical note / Defect ('illah): Ibn Abi Layla is taken into consideration in supporting reports and corroborations.
وأخرج سعيد بن منصور (120)، وابن أبي شيبة 11/ 348، والدارمي (3145)، وابن المنذر في "الأوسط" (6854)، والبيهقي 6/ 258 من طريق محمد بن سالم، عن الشعبي، عن علي وعبد الله، قالا: عصبة ابن الملاعنة أمُّه، ترث ماله أجمع، فإن لم تكن له أم فعصبتها عصبتُه. ومحمد بن سالم متفق على ضعفه. وقد سلف خبر عبد الله بن مسعود قبل حديث.
Reference / Source: Sa'id bin Mansur (120), Ibn Abi Shaybah (11/ 348), al-Darimi (3145), Ibn al-Mundhir in "al-Awsat" (6854) and al-Bayhaqi (6/ 258) narrated via Muhammad bin Salim, from al-Sha'bi, from 'Ali and 'Abdullah, who said: "The 'asabah of the child of the woman who underwent li'an is his mother; she inherits all his wealth. If he has no mother, then her 'asabah are his 'asabah."
Grading: Muhammad bin Salim's weakness is agreed upon. And the report of 'Abdullah bin Mas'ud has passed one hadith earlier.
