Mustadrak al-Hakim — Hadith 8212

أخبرني أبو الحسين محمد بن أحمد الخيّاط بقَنْطرةِ بَرَدَان، حدثنا أبو قِلَابة، حدثنا أبو عاصم، أخبرنا ابن جُرَيج، أخبرني عمرو بن دينار، عن عِكْرمة، عن ابن عباس: أن رجلًا مات، فقال النبيُّ ﷺ: "التمِسُوا وارثًا"، فلم يُوجَدْ إِلَّا مولًى له هو الذي أعتقَه، فقال رسول الله ﷺ: "أعطوه إيّاه" (3)
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه. إلَّا أنَّ حمّاد بن سَلَمة وسفيان بن عُيَينة روياه عن عمرو بن دينار عن عَوسَجة مولي ابن عباس عن ابن عباس. أمّا حديثُ حمّاد:
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a man died, and the Prophet (peace and blessings be upon him) said: "Look for an heir of his." But no heir was found except a freed slave (mawla) of his, so the Messenger of Allah (peace and blessings be upon him) said: "Give the inheritance to him."
This hadith is sahih (authentic) on the condition of Imam Bukhari, but the two Shaykhs (Bukhari and Muslim) did not record it. However, Hammad bin Salamah and Sufyan bin Uyaynah narrated it from Amr bin Dinar, from Awsajah the freed slave of Ibn Abbas, from Ibn Abbas.

(3) إسناده ضعيف، فقد اختلف على عمرو بن دينار في وصله وإرساله كما سيأتي، وشيخه عوسجة لم يرو عنه غير عمرو بن دينار، وقال البخاري في "التاريخ الكبير": لم يصحَّ حديثه، وقال الإمام أحمد: لا أعرفه، وقال أبو حاتم والنسائي وتبعهما ابن حجر في "التقريب": ليس بمشهور، وقال الذهبي في "المغني": لا يعرف، وذكره العقيلي في "الضعفاء"، وقال عن حديثه (1403): لا يتابع عليه. ووثقه أبو زرعة، وذكره ابن حبان في "الثقات"، وحسن الترمذي حديثه هذا.
Grading: Its chain is da'if (weak).
Technical note / Defect ('illah): Because there is a disagreement on 'Amr bin Dinar over whether it is connected or mursal (as will come). No one other than 'Amr bin Dinar narrated from his shaykh 'Awsajah. Al-Bukhari said in "al-Tarikh al-Kabir": "His hadith is not authentic"; Ahmad said: "I do not know him"; Abu Hatim, al-Nasa'i and Ibn Hajar (al-Taqrib) said: "He is not well known"; al-Dhahabi (al-Mughni) said: "He is unknown"; al-'Uqayli mentioned him among the weak narrators and said about his hadith (1403): "He is not corroborated in it." (However,) Abu Zur'ah declared him trustworthy, Ibn Hibban mentioned him in "al-Thiqat", and al-Tirmidhi graded this hadith of his hasan.
وإسناد المصنف وقع فيه وهم، إما من أبي قلابة - واسمه عبد الملك بن محمد بن عبد الله الرقاشي - ففيه بعض الكلام، أو ممن دونه؛ حيث جعل عكرمةَ مكانَ عوسجة، قال البيهقي في "سننه" 6/ 242: رواه بعض الرواة عن عمرو عن عكرمة عن ابن عباس، وهو غلطٌ لا شك فيه. قلنا: رواه سليمان بن سيف الحراني - وهو ثقة حافظ - عند النسائي (6377) عن أبي عاصم عن ابن جريج، فقال فيه: عن عوسجة، بدل عكرمة، وهو الصواب.
Technical note / Defect ('illah): An "error" (wahm) occurred in the author's chain, either from Abu Qilabah ('Abd al-Malik bin Muhammad bin 'Abdullah al-Raqashi) - about whom there is some criticism - or from someone below him; in that he put "'Ikrimah" in place of 'Awsajah. Al-Bayhaqi said in "al-Sunan" (6/ 242): "Some narrators narrated it from 'Amr, from 'Ikrimah, from Ibn 'Abbas, and this is undoubtedly a mistake." We say: Sulayman bin Sayf al-Harrani (a thiqah hafiz) narrated it with al-Nasa'i (6377) from Abu 'Asim, from Ibn Jurayj, and he said in it "'Awsajah" instead of 'Ikrimah, and this is correct.
ورواه أيضًا غير واحد عن ابن جريج بذكر عوسجة على الصواب، كعبد الرزاق في "مصنفه" (16191) - ومن طريقه الطبراني (12209) - وروح بن عبادة عند أحمد 5/ (3369).
Reference / Source: More than one narrator narrated it from Ibn Jurayj with the correct mention of 'Awsajah; such as 'Abd al-Razzaq in his "Musannaf" (16191) - and via him al-Tabarani (12209) -; and Rawh bin 'Ubadah with Ahmad (5/ 3369).
وكذلك رواه على الصواب حماد بن سلمة وسفيان بن عيينة - كما سيأتي عند المصنف في الحديثين التاليين - ووهيب بن خالد عند الطحاوي في "مشكل الآثار" (3881)، ومحمد بن مسلم الطائفي عند الطحاوي (3883)، والطبراني (12211).
Reference / Source: Likewise, Hammad bin Salamah and Sufyan bin 'Uyaynah narrated it correctly (as will come with the author in the next two hadiths); as did Wuhayb bin Khalid with al-Tahawi in "Mushkil al-Athar" (3881), and Muhammad bin Muslim al-Ta'ifi with al-Tahawi (3883) and al-Tabarani (12211).
وخالفهم حماد بن زيد وروح بن القاسم، فروياه عند البيهقي 6/ 242 عن عمرو بن دينار، عن عوسجة مرسلًا، ليس فيه ذكر ابن عباس. لكن رواه الطحاوي (3881) من طريق حماد بن زيد مقرونًا مع وهيب بن خالد فجعله موصولًا بذكر ابن عباس، لكن في السند إليه أيوب بن سليمان الأعور المصري، لم نقف على راو عنه غير عبد الغني بن أبي عقيل المصري، ولم نقف على من وثّقه، فهو مجهول، وقد يكون الطحاوي حَمَل رواية حماد المرسلة على رواية وهيب الموصولة، ولم يذكر ذلك، فالله تعالى أعلم. وانظر "علل الحديث" لابن أبي حاتم (1643).
Technical note / Defect ('illah): They were contradicted by Hammad bin Zayd and Rawh bin al-Qasim [in al-Bayhaqi (6/ 242)]; they narrated it from 'Amr bin Dinar, from 'Awsajah as "mursal", without mentioning Ibn 'Abbas. However, al-Tahawi (3881) narrated it via Hammad bin Zayd combined with Wuhayb bin Khalid, making it "connected" with mention of Ibn 'Abbas; but in the chain up to him is "Ayyub bin Sulayman al-A'war al-Misri", from whom we found no narrator other than 'Abd al-Ghani bin Abi 'Aqil al-Misri, nor did we find anyone who declared him trustworthy, so he is "majhul" (unknown). It may be that al-Tahawi carried Hammad's mursal narration over onto Wuhayb's connected narration without mentioning it. And Allah knows best. See Ibn Abi Hatim's "'Ilal al-Hadith" (1643).
وخالفهم عمر بن حبيب المكي عند الطبراني في "الكبير" (11195)، فرواه عن عمرو بن دينار عن ابن عباس، لم يذكر الوساطة بين عمرو وابن عباس وسنده ضعيف، فيه غير واحد متكلم فيه.
Technical note / Defect ('illah): They were contradicted by 'Umar bin Habib al-Makki [in al-Tabarani's "al-Kabir" (11195)]; he narrated it from 'Amr bin Dinar, from Ibn 'Abbas, without mentioning the intermediary between 'Amr and Ibn 'Abbas.
Grading: Its chain is weak; it contains more than one narrator who has been criticized.
وأخرجه الطبراني في "الكبير" (11925)، و "الأوسط" (6948) - ومن طريقه الضياء في "المختارة" 12 / (166) - عن محمد بن علي المروزي، عن محمد بن عبد الله بن قهزاذ، عن علي بن الحسن بن شقيق عن أبي حمزة، عن عبد الكريم، عن عكرمة، عن ابن عباس بنحوه، وقال: لم يروه عن عبد الكريم إلَّا أبو حمزة، تفرد به علي بن الحسن. قلنا: أبو حمزة: هو محمد بن ميمون السكري، وعبد الكريم: هو أبو أمية بن أبي المخارق كما يفهم من تخريج الطبراني له في "الأوسط" برقم (6948) بإثر روايته التي كنّى بها عبدَ الكريم أبا أمية من رواية أبي حمزة السكري عنه.
Reference / Source: Al-Tabarani narrated it in "al-Kabir" (11925) and "al-Awsat" (6948) - and via him al-Diya' in "al-Mukhtarah" (12/ 166) - from Muhammad bin 'Ali al-Marwazi, from Muhammad bin 'Abdullah bin Quhzadh, from 'Ali bin al-Hasan bin Shaqiq, from Abu Hamzah, from 'Abd al-Karim, from 'Ikrimah, from Ibn 'Abbas, similarly. And he said: "No one narrated it from 'Abd al-Karim except Abu Hamzah, and 'Ali bin al-Hasan is alone in it."
Technical note / Defect ('illah): We say: Abu Hamzah is "Muhammad bin Maymun al-Sukkari"; and 'Abd al-Karim is "Abu Umayyah bin Abi al-Mukhariq", as is understood from al-Tabarani's narrating it in "al-Awsat" (6948) right after his narration in which he gave 'Abd al-Karim the kunyah "Abu Umayyah", from the narration of Abu Hamzah al-Sukkari from him.
وأخرج عبد الرزاق (16214) عن ابن عيينة، عن عمرو بن عبيد، عن الحسن قال: أراد رجل أن يشتري عبدًا فلم يُقضَ بينه وبين صاحبه بيع، فحلف رجل من المسلمين بعِتقه، فاشتراه فأعتقه، فذكره للنبي ﷺ قال: فكيف بصحبته؟ فقال النبي ﷺ: "هو لك إلَّا أن يكون له عَصَبة، فإن لم يكن له عصبة فهو لك".
Reference / Source: 'Abd al-Razzaq (16214) narrated from Ibn 'Uyaynah, from 'Amr bin 'Ubayd, from al-Hasan (al-Basri), who said: "A man wanted to buy a slave but the sale between him and the owner was not concluded, so a Muslim man swore an oath by his manumission; then he bought him and set him free. He mentioned this to the Prophet (peace and blessings be upon him) and said: So what about his companionship (i.e. my tie to him)? The Prophet (peace and blessings be upon him) said: He is yours (as your mawla) unless he has 'asabah (residuary heirs); if he has no 'asabah, then he is yours."
وفي الباب عن عمر عند ابن أبي شيبة 11/ 414 عن يزيد بن هارون، عن حماد بن سلمة، عن عمرو بن دينار، عن يحيى بن جعدة، عن عمر: أنَّ رجلًا مات ولم يترك عصبة، فقال عمر: يرثه: الذي كان يغضب لغضبه وجيرانُه. ورجاله ثقات إلَّا أنه منقطع بين يحيى وعمر فيما يغلب على ظنّنا.
Corroborating chains and supporting reports: On this topic there is a narration from 'Umar (may Allah be pleased with him) with Ibn Abi Shaybah (11/ 414), from Yazid bin Harun, from Hammad bin Salamah, from 'Amr bin Dinar, from Yahya bin Ja'dah, from 'Umar: a man died and left no 'asabah, so 'Umar said: "He is inherited by the one who used to become angry at his anger (i.e. a close ally) and by his neighbours."
Grading: Its narrators are trustworthy, but in our most likely opinion there is a break between Yahya and 'Umar.
