أخبرنا أبو يحيى السَّمرقَندي، حدثنا محمد بن نصر الإمام، حدثنا إسحاق بن إبراهيم، أخبرنا معاذ بن هشام، عن أبيه، عن قَتَادة قال: حدثنا أبو حسّان، عن الأسوَد بن هلال: أنه سَمِعَ معاذَ بن جَبَل - يقول وهو على المنبر - وَرَّثَ مالَ رجل ترك ابنتَه وأختَه، فجعلَ لابنتِه النِّصفَ ولأختِه النِّصفَ، ورسولُ الله ﷺ حيٌّ بين أظهُرِهم (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) that he said on the pulpit (while delivering a sermon) that he had distributed the inheritance of a man who left a daughter and a sister, and he fixed half for the daughter and (the remaining) half for the sister, while the Messenger of Allah (peace and blessings be upon him) was alive among them at that time.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(2) إسناده صحيح لكن من حديث الأسود بن يزيد النخعي عن معاذ بن جبل، وذكرُ الأسود بن هلال فيه وهمٌ ممَّن دون معاذ بن هشام الدستوائي، فقد رواه عنه بندار محمد بن بشار عند الشاشي (1371) بذكر الأسود بن يزيد، وكذلك رواه على الصواب أبانُ العطار عن قتادة عند أبي داود (2893)، وقد روي أيضًا من غير وجه عن الأسود بن يزيد عن معاذ كما هو الصحيح فيما ذكرناه عند تخريج الرواية السالفة برقم (8171).
Grading: Its chain is sahih, but as the hadith of al-Aswad bin Yazid al-Nakha'i from Mu'adh bin Jabal; the mention of "al-Aswad bin Hilal" in it is an "error" (wahm) by someone below Mu'adh bin Hisham al-Dastuwa'i.
Technical note / Defect ('illah): For Bundar Muhammad bin Bashshar narrated it from him (in al-Shashi 1371) mentioning al-Aswad bin Yazid; and likewise Aban al-'Attar narrated it correctly from Qatadah (in Abu Dawud 2893). It has also been narrated through several other routes from al-Aswad bin Yazid, from Mu'adh, and this is what is correct, as we mentioned in the takhrij of the previous narration number (8171).
أبو حسان: هو مسلم بن عبد الله الأعرج.
Note / Clarification: Abu Hassan is Muslim bin 'Abdullah al-A'raj.
