أخبرنا أبو عبد الله محمد بن علي الصنعاني بمكة حرسها الله تعالى، حدثنا إسحاق بن إبراهيم، أخبرنا عبد الرزاق، أخبرنا ابن جُرَيج، أخبرني ابن طاووس، عن أبيه، عن ابن عباس: أنَّ عمر بن الخطاب أَوصَى عند الموت، فقال: الكَلالةُ ما قلتُ، قال ابن عباس: وما قلتَ؟ قال: قال: مَن لا ولدَ له (1). هذا حديث صحيح على شرط الشيخين ولم يُخرجاه، وهو في الأصل مُسنَد، فإنَّ في خطبته: وما راجعتُ رسولَ الله ﷺ في شيء ما راجعتُه فيه (2). It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) made a bequest at the time of his death and said: Concerning kalalah, the view is what I said. Ibn Abbas (may Allah be pleased with them both) asked: What did you say? He said: "One who has no child (is kalalah)."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it. In origin it is musnad (traced back to the Prophet), because Umar (may Allah be pleased with him) said in his sermon that he had not referred to the Messenger of Allah (peace and blessings be upon him) on any matter as often as he did on the matter of kalalah.
