Mustadrak al-Hakim — Hadith 8179

أخبرنا أبو عبد الله محمد بن يعقوب، حدثنا علي بن الحسن الهِلَالي، أخبرنا أبو مَعمَر، حدثنا وُهيب، عن يونس بن عُبيد، عن الحسن، عن مَعقِل بن يسار قال: قال عمر: مَن عندَه في الجدِّ عن رسولِ الله ﷺ؟ قلت: عندي، قال: ما عندَك؟ قلت: أعطاه السُّدسَ، قال: معَ من؟ قلت: لا أدري، قال: لا دَرَيتَ (3)
هذا حديث صحيح على شرط الشيخين، ولم يخرجاه.

It is narrated from Sayyiduna Ma'qil bin Yasar (may Allah be pleased with him) that Sayyiduna Umar (may Allah be pleased with him) asked: "Does anyone have a saying of the Messenger of Allah (peace and blessings be upon him) concerning (the inheritance of) the grandfather?" I said: I have. He asked: What is it? I said: He (peace and blessings be upon him) gave him one-sixth (1/6). He asked: "Along with whom (among the other heirs)?" I said: I do not know. So he said (in regret): "Then may you never know."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(3) رجاله ثقات، واختلف على الحسن - وهو البصري - فيه، فكان مرةً يرويه عن معقل بن يسار، ومرة عن عمران بن حصين، ومرة عن عمر، والحسن لم يسمع من عمر ولا من عمران، وسمع من معقل عند البخاري، وقال أبو حاتم الرازي: لم يصح للحسن سماع من معقل بن يسار، قلنا: كان الحسن يدلّس، ولم نقف على تصريح له بسماع هذا الحديث من معقل، والله أعلم.
Grading: Its narrators are trustworthy, but there is a disagreement on al-Hasan (al-Basri) in it. Sometimes he narrates it from Ma'qil bin Yasar, sometimes from 'Imran bin Husayn, and sometimes from 'Umar.
Technical note / Defect ('illah): Yet al-Hasan's hearing is established neither from 'Umar nor from 'Imran; his hearing from Ma'qil is, however, established according to al-Bukhari. But Abu Hatim al-Razi said: "Al-Hasan's hearing from Ma'qil bin Yasar is not authentic." We (the editors) say: al-Hasan used to commit tadlis, and we have not found an explicit statement of his hearing this hadith from Ma'qil. And Allah knows best.
أبو معمر: هو عبد الله بن عمرو بن أبي الحجّاج، ووهيب: هو ابن خالد بن عجلان.
Technical note / Defect ('illah): Abu Ma'mar is 'Abdullah bin 'Amr bin Abi al-Hajjaj, and Wuhayb is Ibn Khalid bin 'Ajlan.
وأخرجه النسائي (6301)، والبيهقي 6/ 244 من طريق عبد الله بن سوّار العنبري، عن وهيب بن خالد بهذا الإسناد.
Reference / Source: Al-Nasa'i (6301) and al-Bayhaqi (6/ 244) narrated it via 'Abdullah bin Sawwar al-'Anbari, from Wuhayb bin Khalid, with this same chain.
وأخرجه النسائي (6300)، وأبو الحسن القطان في زوائده على "سنن ابن ماجه" (2723)، والطبراني 20/ (465) من طريق هشيم، عن يونس بن عبيد. به وهو كذلك في "سنن سعيد بن منصور" (38) عن هشيم، لكن جعله عن الحسن: أن عمر، فذكره بصورة الإرسال.
Reference / Source: Al-Nasa'i (6300), Abu al-Hasan al-Qattan in his additions to "Sunan Ibn Majah" (2723), and al-Tabarani (20/ 465) narrated it via Hushaym, from Yunus bin 'Ubayd, with this same chain.
Technical note / Defect ('illah): The same narration is also in "Sunan Sa'id bin Mansur" (38) from Hushaym, but there he made it "from al-Hasan that 'Umar", presenting it in mursal form.
وخالف وُهيبًا وهُشيمًا شعبةُ عند أبي القاسم البغوي في "الجعديات" (1348)، والطبراني 20/ (464)، والدارقطني (4135)، والبيهقي 6/ 235، ويزيدُ بن زريع عند الطبراني (461)، والبيهقي 6/ 235، فروياه عن يونس بن عبيد، عن الحسن، عن معقل: أن رسول الله ﷺ أعطى الجدةَ السدس. جعلاه للجدّة. وفي الطريق إلى شعبة محمدُ بن حميد وشيخه إبراهيم بن المختار، وكلاهما ضعيف، وقال البيهقي: تفرد به محمد بن حميد وليس بالقوي، والمحفوظ حديث معقل في الجد. قلنا إن قصد أن محمد بن حميد تفرّد به من حديث شعبة فنعم، وإلا فقد توبع متابعة قاصرة من طريق يزيد بن زريع كما عرفتَ.
Technical note / Defect ('illah): Wuhayb and Hushaym were contradicted by Shu'bah [in al-Baghawi (1348), al-Tabarani (20/ 464), al-Daraqutni (4135) and al-Bayhaqi (6/ 235)] and by Yazid bin Zuray' [in al-Tabarani (461) and al-Bayhaqi (6/ 235)]; both of them narrated it from Yunus bin 'Ubayd, from al-Hasan, from Ma'qil: "The Messenger of Allah (peace and blessings be upon him) gave the grandmother a sixth." So they made it about the grandmother. In the chain up to Shu'bah are Muhammad bin Humayd and his shaykh Ibrahim bin al-Mukhtar, and both are weak. Al-Bayhaqi said: "Muhammad bin Humayd is alone in it and he is not strong; what is preserved (mahfuz) is the hadith of Ma'qil concerning the grandfather." We say: if he means that Muhammad bin Humayd is alone in narrating it as the hadith of Shu'bah, then yes; otherwise it has a "partial corroboration" (mutaba'ah qasirah) via Yazid bin Zuray', as you have seen.
ورواه عبدُ الأعلى بن عبد الأعلى عند ابن أبي شيبة 10/ 172 و 11/ 291، وأحمد 33/ (20310)، والطبراني (462)، وخالد بن عبد الله عند أبي داود (2897)، وعامرُ بن صالح عند الطبراني (463)، ثلاثتهم عن يونس بن عبيد، عن الحسن: أن عمر بن الخطاب سأل عن فريضة رسول الله ﷺ في الجدّ، فقام معقل بن يسار المزني، فقال: قضى فيها رسولُ الله، قال: ماذا؟ قال: السدس، قال: مع من؟ قال: لا أدري قال: لا، دريت، فما تغني إذًا. قال البيهقي في "معرفة السنن" 9/ 139: وهذه الرواية أبيَنُ في الانقطاع؛ لأنَّ الحسن لم يشهد سؤال عمر، ويشبه أن يكون الشافعي وقف على ذلك، لذلك قال: لا يثبته أهل الحديث كل الثَّبت.
Details of the narration: It was narrated by 'Abd al-A'la bin 'Abd al-A'la [Ibn Abi Shaybah (10/ 172, 11/ 291), Ahmad (33/ 20310), al-Tabarani (462)], Khalid bin 'Abdullah [Abu Dawud (2897)] and 'Amir bin Salih [al-Tabarani (463)]; all three from Yunus bin 'Ubayd, from al-Hasan: "'Umar bin al-Khattab asked about the ruling of the Messenger of Allah (peace and blessings be upon him) on the grandfather's inheritance, so Ma'qil bin Yasar al-Muzani stood up and said: The Messenger of Allah gave a ruling on it. 'Umar asked: What? He said: A sixth. 'Umar asked: Along with whom? He said: I do not know. 'Umar said: You did not know; then what use is (your knowledge)?" Al-Bayhaqi said in "Ma'rifat al-Sunan" (9/ 139): "This narration is clearer in its break, because al-Hasan did not witness 'Umar's question. It seems that al-Shafi'i came to know of that, and for that reason he said: The people of hadith do not consider it fully established."
ورواه علي بن زيد بن جدعان، عن الحسن، عن عمران بن حصين: أنَّ عمر بن الخطاب نشد الناس: من سمع النبي ﷺ قضى في الجد بشيء؟ فقام رجل، فقال: أنا أشهد أنه أعطاه الثلث، قال: مع من؟ قال: لا أدري قال: لا. دريت أخرجه الحميدي (855)، وأحمد 33/ (19994)، والنسائي (6302)، وابن الأعرابي في "معجمه" (1305) من طرق عن سفيان بن عيينة، فجعله من مسند عمران بن حصين، وذكر الثلث مكان السدس. وعلي بن زيد بن جدعان ضعيف، وفي سماع الحسن من عمران بن حصين خلاف، والجمهور على أنه لم يسمع منه.
Details of the narration: 'Ali bin Zayd bin Jud'an narrated it from al-Hasan, from 'Imran bin Husayn: "'Umar bin al-Khattab adjured the people: Who heard the Prophet (peace and blessings be upon him) give any ruling concerning the grandfather? So a man stood up and said: I bear witness that he gave him a third. 'Umar asked: Along with whom? He said: I do not know. 'Umar said: You did not know." Al-Humaydi (855), Ahmad (33/ 19994), al-Nasa'i (6302) and Ibn al-A'rabi in his "Mu'jam" (1305) narrated it via routes from Sufyan bin 'Uyaynah; he made it from the Musnad of 'Imran bin Husayn and mentioned a third in place of a sixth.
Grading: 'Ali bin Zayd bin Jud'an is weak, and there is disagreement about al-Hasan's hearing from 'Imran bin Husayn; the majority hold that he did not hear from him.
وأخرجه الحميدي (856) قال: حدثنا سفيان، فقال آخر: عن الحسن، عن عمران بن حصين، وقام إليه آخر فقال: أنا أشهد أنه أعطاه السدس، قال: مع من؟ قال: لا أدري قال: لا دريت.
Reference / Source: Al-Humaydi (856) narrated it, saying: Sufyan narrated to us, and another (narrator) said: from al-Hasan, from 'Imran bin Husayn, that another man stood up and said: I bear witness that he gave him a sixth. 'Umar asked: Along with whom? He said: I do not know. 'Umar said: You did not know.
وخالف ابنَ جدعان قتادةُ، فرواه عن الحسن عن عمران بن حصين: أنَّ رجلًا أتى النبي ﷺ، فقال: إنَّ ابن ابني مات، فما لي من ميراثه؟ فقال: "لك السدس" فلما أدبر دعاه، فقال: "لك سدس آخر" فلما أدبر دعاه، فقال: "إنَّ السدس الآخر طُعمة". قال قتادة: فلا يدرون مع أي شيء ورثه. قال قتادة: أقل شيء ورث الجد السدس. أخرجه الطيالسي (3551)، وابن أبي شيبة 11/ 290، وأحمد في "المسند" 33/ (1988) و (19915) - وإسحاق الكوسج في "مسائل أحمد" 8/ 4198 و 4200 وأبو داود (2896)، والترمذي (2099) - وقال: حسن صحيح. والبزار (3551)، والنسائي (6303)، وابن الجارود في "المنتقى" (961)، والروياني في "مسنده" (77)، والطحاوي في "شرح المشكل" (4506)، والطبراني 18/ (295)، والدارقطني (4110)، والبيهقي 6/ 244 وغيرهم من طريق قتادة. وقال الكوسج عقبه: قلت: لأحمد: ما تفسير هذا؟ قال: ما ترى، هو أمر مظلم. وأخرج ابن أبي شيبة 11/ 291، وأحمد (20309)، وابن ماجه (2722)، والنسائي (6299)، والطحاوي (4507)، والطبراني 20/ (536) من طريق عمرو بن ميمون: أنه شهد عمر قال - وقد كان جَمَعَ أصحابَ رسول الله ﷺ في حياته وصحّته فناشدهم الله -: من سمع رسول الله ﷺ ذكر في الجدِّ شيئًا؟ فقام معقل بن يسار فقال: سمعت رسول الله ﷺ أُتي بفريضة فيها جدٌّ، فأعطاه ثلثًا أو سدسًا، قال: وما الفريضة؟ قال: لا أدري قال: ما منعك أن تدري؟! وإسناده حسن.
Technical note / Defect ('illah): Ibn Jud'an was contradicted by Qatadah, who narrated it from al-Hasan, from 'Imran bin Husayn: A man came to the Prophet (peace and blessings be upon him) and said: My son's son has died, so what is my share of his inheritance? He said: "You get a sixth." When he turned to leave, he called him back and said: "You get another sixth." When he turned to leave (again), he called him back and said: "The other sixth is a tu'mah (an extra provision)." Qatadah said: They do not know along with which heir he gave him this. And Qatadah said: The least share the grandfather inherits is a sixth.

Al-Kawsaj said: I asked Imam Ahmad about its explanation, and he said: "As you see, it is an obscure (muzlim) matter."
Corroborating chains and supporting reports: Ibn Abi Shaybah (11/ 291), Ahmad (20309), Ibn Majah (2722), al-Nasa'i (6299), al-Tahawi (4507) and al-Tabarani (20/ 536) narrated via 'Amr bin Maymun that he was present with 'Umar when he gathered the Companions and adjured them by Allah: Who heard the Messenger of Allah (peace and blessings be upon him) mention anything concerning the grandfather? Ma'qil bin Yasar said: I heard that an inheritance case involving a grandfather was brought to the Prophet (peace and blessings be upon him), and he gave him a third or a sixth. 'Umar asked: What was the case (i.e. who else was there)? He said: I do not know. 'Umar said: What prevented you from knowing?! Its chain is hasan.
