Mustadrak al-Hakim — Hadith 8173

فحدَّثَناه أبو العباس محمد بن يعقوب، حدثنا يحيى بن أبي طالب حدثنا يزيد بن هارون، أخبرنا سفيان الثَّوري (1). وأما حديثُ ابن عُيينة:
It is narrated from Tawus (may Allah have mercy on him), in mursal form, that the Messenger of Allah (peace and blessings be upon him) said: "Give the inheritance to those with fixed shares, then whatever remains belongs to the nearest male relative."

وأخرجه الطحاوي في "شرح معاني الآثار" 4/ 390 عن علي بن شيبة، عن يزيد بن هارون، بهذا الإسناد.
Reference / Source: Al-Tahawi narrated it in "Sharh Ma'ani al-Athar" (4/ 390) from 'Ali bin Shaybah, from Yazid bin Harun, with this same chain.
وأخرجه الباغندي في "فرائض الثَّوري" (4)، والطحاوي 4/ 390 من طريق أبي نعيم، والنسائي (6298) من طريق أبي داود الحفري عمر بن سعد، والطحاوي 4/ 390 من طريق ابن المبارك، ثلاثتهم عن سفيان الثوري به. قال النسائي عقبه: سفيان الثوري أحفظ من وُهيب، ووهيب ثقة مأمون، وكأنَّ حديث الثوري أشبه بالصواب. قلنا: ذكرنا في تخريج الرواية السابقة أنَّ جمعًا من الثقات رووه عن عبد الله بن طاووس موصولًا، ولم ينفرد وهيب بوصله.
Reference / Source: Al-Baghandi narrated it in "Fara'id al-Thawri" (4) and al-Tahawi (4/ 390) via Abu Nu'aym; al-Nasa'i (6298) via Abu Dawud al-Hafari ('Umar bin Sa'd); and al-Tahawi (4/ 390) via Ibn al-Mubarak. All three (Abu Nu'aym, al-Hafari, Ibn al-Mubarak) narrate it from Sufyan al-Thawri with this same chain.
Technical note / Defect ('illah): Al-Nasa'i said after it: "Sufyan al-Thawri is a greater hafiz than Wuhayb, though Wuhayb is thiqah and reliable; yet al-Thawri's hadith seems closer to what is correct." We (the editors) say: we mentioned in the takhrij of the previous narration that a group of trustworthy narrators narrated it from 'Abdullah bin Tawus as "connected" (mawsul), so Wuhayb is not alone in narrating it as connected.
