Mustadrak al-Hakim — Hadith 8172

أخبرنا أبو عمرو عثمان بن أحمد الدَّقّاق ببغداد، حدثنا أحمد بن حيَّان بن مُلاعِب، حدثنا علي بن عاصم، حدثنا عبد الله بن طاووس، عن أبيه، عن ابن عبّاس قال: قال النبيُّ ﷺ: "أَلحِقُوا المالَ بالفرائض، فما بقيَ فلأَولى رَجُلٍ ذَكَر" (1).
هذا حديث صحيح الإسناد، فإنّ علي بن عاصم صَدُوق، ولم يخرجاه. وقد أرسله سفيان الثَّوري وسفيان بن عُيَينة وابن جُرَيج ومَعمَر بن راشد عن عبد الله بن طاووس. أما حديث الثَّوري:
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "Give the inheritance to those with fixed shares (ashab al-fara'id), then whatever remains is for the nearest male relative."
This hadith has a sahih (authentic) chain of narration, because Ali bin Asim is saduq (truthful), although the two Shaykhs (Bukhari and Muslim) did not record it; whereas Sufyan al-Thawri, Sufyan bin Uyaynah, Ibn Jurayj and Ma'mar bin Rashid narrated it from Abdullah bin Tawus in mursal form.

(1) حديث صحيح، وهذا إسناد حسن في المتابعات من أجل علي بن عاصم. وهو ابن صهيب الواسطي - وبه أعلّه الذهبي في "التخليص"، لكنه قد توبع. واختلف على عبد الله بن طاووس في وصله وإرساله كما أشار المصنف، وروايته المرسلة لا تُعلُّ الموصولة، فالذين رووه عنه موصولًا جمع من الثقات بعضهم مخرَّج في "الصحيحين".
Grading: This hadith is sahih, and this chain is "hasan" in corroborations because of 'Ali bin 'Asim (Ibn Suhayb al-Wasiti).
Technical note / Defect ('illah): Al-Dhahabi declared it defective in "al-Talkhis" because of 'Ali bin 'Asim, but he has been corroborated. Also, there is a disagreement on 'Abdullah bin Tawus over whether this hadith is "connected" (mawsul) or "mursal", as the author (al-Hakim) indicated; however, the mursal narration does not render the connected one defective, because those trustworthy (thiqah) narrators who narrated it as connected are a group, some of whom are narrators of the two Sahihs.
وأخرجه أحمد 4/ 2657 و 5/ (2993)، والبخاري (6732) و (6735) و (6737)، ومسلم (1615) (2)، والترمذي (2098)، والنسائي (6297) من طريق وهيب بن خالد، والبخاري (6746)، ومسلم (1615) (3)، وابن حبان (6028) من طريق روح بن القاسم، ومسلم (1615) (4) من طريق يحيى بن أيوب، وابن الجارود في "المنتقى" (955) من طريق المغيرة بن سلمة، والبزار في "مسنده" (4887)، وابن الأعرابي في "المعجم" (962)، والطبراني (10901)، والدارقطني (4072) من طريق زياد بن سعد، والدارقطني (4068) من طريق زَمعة بن صالح، ستتهم عن عبد الله بن طاووس، بهذا الإسناد. وقال الترمذي: حديث حسن. وقال البزار: هذا الإسناد لا أعلم فيه علة.
Reference / Source: Ahmad (4/ 2657, 5/ 2993), al-Bukhari (6732, 6735, 6737), Muslim (1615 - 2), al-Tirmidhi (2098) and al-Nasa'i (6297) narrated it via Wuhayb bin Khalid; al-Bukhari (6746), Muslim (1615 - 3) and Ibn Hibban (6028) via Rawh bin al-Qasim; Muslim (1615 - 4) via Yahya bin Ayyub; Ibn al-Jarud in "al-Muntaqa" (955) via al-Mughirah bin Salamah; al-Bazzar in his "Musnad" (4887), Ibn al-A'rabi in "al-Mu'jam" (962), al-Tabarani (10901) and al-Daraqutni (4072) via Ziyad bin Sa'd; and al-Daraqutni (4068) via Zam'ah bin Salih. These six narrators (Wuhayb, Rawh, Yahya, al-Mughirah, Ziyad, Zam'ah) narrate it from 'Abdullah bin Tawus with this same chain. Al-Tirmidhi said: This hadith is hasan. And al-Bazzar said: I know of no defect in this chain.
وأخرجه أبو حنيفة في "مسنده" بشرح علي القاري ص 180، وكذا الدارقطني في "سننه" (4073) من طريق هشام بن حجير، كلاهما (أبو حنيفة وهشام) عن طاووس، عن ابن عباس موصولًا.
Reference / Source: Imam Abu Hanifah narrated it in his "Musnad" (with the commentary of 'Ali al-Qari, p. 180), and al-Daraqutni in "al-Sunan" (4073) via Hisham bin Hujayr. Both (Abu Hanifah and Hisham) narrate it from Tawus, from Ibn 'Abbas as "connected" (mawsul).
وأخرجه سعيد بن منصور في "سننه" (289) من طريق هشام بن حجير، به فوقفه علي ابن عباس.
Reference / Source: Sa'id bin Mansur narrated it in "al-Sunan" (289) via Hisham bin Hujayr, and made it "mawquf" on Ibn 'Abbas.
قلنا رواية هشام بن حجير التي عند سعيد بن منصور والدارقطني كلاهما من طريق سفيان بن عيينة عنه، ونرى ذلك من ضعف ابن حجير، فإنه ليس بذاك القوي، والله أعلم.
Technical note / Defect ('illah): We (the editors) say: the narration of Hisham bin Hujayr found with Sa'id bin Mansur and al-Daraqutni is, in both cases, via Sufyan bin 'Uyaynah from him; and in our view this (discrepancy) is due to the weakness of Ibn Hujayr, for he is not that strong. And Allah knows best.
قال ابن حجر في "الفتح" 21/ 307: المراد بالفرائض هنا الأنصِباء المقدَّرة في كتاب الله تعالى، وهي النصف ونصفه ونصف نصفه، والثلثان ونصفهما ونصف نصفهما والمراد بأهلها: من يستحقها بنص القرآن.
General principle: Ibn Hajar said in "al-Fath" (21/ 307): "What is meant by al-fara'id here is the shares fixed in the Book of Allah the Exalted, namely: a half, its half (a quarter) and half of its half (an eighth); and two-thirds, its half (a third) and half of its half (a sixth). And 'its people' means those entitled to them by the text of the Qur'an."
وقوله: "فلأولى رجل" قال الخطابي: معنى "أَولى" هاهنا أقرب، والوَلْيُ: القرب، يريد أقرب العصبة إلى الميت كالأخ والعم، فإنَّ الأخ أقرب من العم، وكالعم وابن العم، فالعم أقرب من ابن العم، وعلى هذا المعنى. ولو كان قوله: "أَولى" بمعنى أحق لبقي الكلامُ مبهمًا، لا يُستفادُ منه بيان الحكم، إذ كان لا يدرى من الأحق ممن ليس بأحق، فعُلم أن معناه: أقرب النسب، على ما فسرناه، والله أعلم.
Note / Clarification: His (peace and blessings be upon him) saying "fa-li-awla rajul" (then it is for the nearest male): al-Khattabi said that "awla" here means "aqrab" (nearest). "Al-waly" means nearness. What is meant is the closest of the 'asabah (residuary heirs) to the deceased, such as a brother and a paternal uncle (for the brother is closer than the uncle), and such as a paternal uncle and a paternal cousin (for the uncle is closer than the cousin). Had "awla" been taken to mean "more entitled" (ahaqq), the statement would have remained vague and no ruling could be derived from it, since it would not be known who is more entitled than whom. So it is known that its meaning is "nearest in lineage", as we have explained. And Allah knows best.
وقال النووي: أجمعوا على أن الذي يبقى بعد الفروض للعصبة يقدَّم الأقرب فالأقرب، فلا يرثُ عاصب بعيد مع عاصب قريب، والعَصَبة: كل ذكر يُدْلي بنفسه بالقرابة ليس بينه وبين الميت أنثى، فمتى انفرد أخذ جميع المال، وإن كان مع ذوي فروض غير مُستغرِقين أخذ ما بقي وإن كان مع مُستغرِقين فلا شيء له.
General principle: Al-Nawawi said: "They are unanimous that what remains after the fixed shares goes to the 'asabah (male agnatic relatives), with the nearest given precedence, then the next nearest. So a distant residuary does not inherit alongside a near residuary. And an 'asabah is every male who is related by himself, with no female between him and the deceased. When he is alone he takes the whole estate; if he is with holders of fixed shares who do not exhaust the estate, he takes what remains; and if he is with those who exhaust it, he gets nothing."
