(3) صحيح موقوفًا من قول جابر، وهو المحفوظ كما قال الدارقطني، وهذا إسناد ليّن من أجل محمد بن عمرو - وهو اليافعي - ففيه ضعف، وقد خولف في رفعه كما سيأتي.
Grading: It is "sahih as mawquf" as the statement of Jabir (may Allah be pleased with him), and this is what is "preserved" (mahfuz), as al-Daraqutni said.
Technical note / Defect ('illah): This chain is "layyin" (weak) because of Muhammad bin 'Amr (al-Yafi'i), in whom there is weakness; and he was contradicted in narrating this hadith as marfu', as will come.
وأخرجه النسائي (6356)، والدارقطني (4081)، وابن عدي في "الكامل" 6/ 226، والبيهقي 6/ 218 من طريق يونس بن عبد الأعلى، والبيهقي 6/ 218 من طريق الحارث بن مسكين، كلاهما عن عبد الله بن وهب، بهذا الإسناد. وقال ابن عدي: لا يرويه عن ابن جريج غير محمد بن عمرو. يعني مرفوعًا. وخالف اليافعيَّ عبدُ الرزاق (9865) و (19310) - ومن طريقه أخرجه ابن المنذر في "الأوسط" (6862)، والدارقطني في "سننه" (4082) - فرواه عن ابن جريج قال: أخبرني أبو الزبير، أنه سمع جابر بن عبد الله، فذكره من قوله. وزاد فيه مع النصراني اليهوديَّ. قال الدارقطني عقبه: وهو المحفوظ وقال في "العلل" (3235): رواه محمد بن عمرو اليافعي عن ابن جريج عن أبي الزبير عن جابر عن النبي ﷺ مرفوعًا، وغيره يرويه عن ابن جريج عن أبي الزبير عن جابر موقوفًا، والموقوفُ أصحُّ.
Reference / Source: Al-Nasa'i (6356), al-Daraqutni (4081), Ibn 'Adi (al-Kamil 6/ 226) and al-Bayhaqi (6/ 218) narrated it via Yunus bin 'Abd al-A'la; and al-Bayhaqi (6/ 218) via al-Harith bin Miskin; both from 'Abdullah bin Wahb with this same chain. Ibn 'Adi said: "No one narrates it from Ibn Jurayj except Muhammad bin 'Amr" (meaning as marfu').
Technical note / Defect ('illah): Al-Yafi'i was contradicted by 'Abd al-Razzaq (9865, 19310) - and via him Ibn al-Mundhir (6862) and al-Daraqutni (4082) narrated it -; he narrated it from Ibn Jurayj, who said: Abu al-Zubayr informed me that he heard Jabir bin 'Abdullah (may Allah be pleased with them), and he reported it as his (Jabir's) statement (mawquf). He also added the Jew alongside the Christian in it. Al-Daraqutni said after it: "And this is what is preserved." He said in "al-'Ilal" (3235): "Muhammad bin 'Amr al-Yafi'i narrated it from Ibn Jurayj, from Abu al-Zubayr, from Jabir, from the Prophet (peace and blessings be upon him) as marfu', while others narrate it from Ibn Jurayj, from Abu al-Zubayr, from Jabir as mawquf, and the mawquf is more authentic."
وأخرج نحوه البيهقي 7/ 172 من طريق عبد المجيد بن عبد العزيز، عن ابن جريج، عن أبي الزبير: أنه سمع جابر بن عبد الله يُسأل عن نكاح المسلم اليهوديةَ والنصرانيةَ، فقال: تزوجناهن زمن الفتح بالكوفة مع سعد بن أبي وقّاص، ونحن لا نكاد نجد المسلمات كثيرًا، فلما رجعنا طلقناهن، وقال: لا يرثن مسلمًا، ولا يرثهنّ، ونساؤهم لنا حِلّ، ونساؤنا عليهم حرام.
Reference / Source: Al-Bayhaqi (7/ 172) narrated something similar via 'Abd al-Majid bin 'Abd al-'Aziz, from Ibn Jurayj, from Abu al-Zubayr, that he heard Jabir bin 'Abdullah being asked about a Muslim marrying a Jewish or Christian woman, and he said: "We married them at the time of the conquest, in Kufah, with Sa'd bin Abi Waqqas, as we could hardly find many Muslim women; then when we returned we divorced them. And he said: They do not inherit from a Muslim, nor does he inherit from them; their women are lawful for us, and our women are unlawful for them."
ورواه أبو حنيفة - كما في "مسنده" من رواية الحارثي 1/ 154 - 155 - عن أبي الزبير عن جابر، أن رسول الله ﷺ قال: "لا يرث المسلمُ النصرانيَّ إلَّا أن يكون عبده أو أمته". وهذه الرواية كرواية اليافعي عن ابن جريج، إلَّا أنَّ الحارثي هذا - وهو عبد الله بن محمد بن يعقوب بن الحارث بن خليل - ضعيف صاحب مناكير وغرائب.
Reference / Source: Abu Hanifah narrated it - as in his "Musnad" (in the narration of al-Harithi 1/ 154-155) - from Abu al-Zubayr, from Jabir, that the Messenger of Allah (peace and blessings be upon him) said: "A Muslim does not inherit from a Christian unless he is his slave or his slave-woman." This narration is like the narration of al-Yafi'i from Ibn Jurayj (marfu').
Grading: But this al-Harithi ('Abdullah bin Muhammad bin Ya'qub bin al-Harith bin Khalil) is a "weak" narrator who narrates munkar and gharib reports.
ورواه موقوفًا ابن أبي شيبة 11/ 373 عن أسباط بن محمد، عن أشعث، عن أبي الزبير، عن جابر، قال: لا يرث الرجل غير أهل مِلّته إلَّا أن يكون عبدَ رجل أو أمتَه. وسنده ضعيف لضعف الأشعث: وهو ابن سوّار.
Reference / Source: Ibn Abi Shaybah (11/ 373) narrated it as "mawquf" from Asbat bin Muhammad, from Ash'ath, from Abu al-Zubayr, from Jabir: "A man does not inherit from anyone other than the people of his own religion, unless it is a man's slave or slave-woman."
Grading: Its chain is weak because of the weakness of Ash'ath (Ibn Sawwar).
وخالف أسباطًا شريكٌ النخعيُّ عند الدارمي (3037)، والطبراني في "الأوسط" (8916)، والدارقطني (4083)، فرواه عن الأشعث، عن الحسن البصري، عن جابر مرفوعًا: "لا نرث أهلَ الكتاب ولا يرثونا إلَّا أن يرثَ الرجل عبده أو أمته، وتحل لنا نساؤهم ولا تحل لهم نساؤنا". فجعل مكان أبي الزبير الحسنَ البصري، ورفعه. وقال الطبراني: لم يرو هذا الحديث عن أشعث بن سوار إلَّا شريك. قلنا: شريك سيئ الحفظ والأشعث ضعيف، والحسن البصري لم يسمع من جابر.
Technical note / Defect ('illah): Asbat was contradicted by Sharik al-Nakha'i [in al-Darimi (3037), al-Tabarani's "al-Awsat" (8916) and al-Daraqutni (4083)]; he narrated it from Ash'ath, from al-Hasan al-Basri, from Jabir as "marfu'": "We do not inherit from the People of the Book, nor do they inherit from us, except that a man inherits from his slave or his slave-woman; their women are lawful for us, and our women are not lawful for them." So he put al-Hasan al-Basri in place of Abu al-Zubayr and made it marfu'. Al-Tabarani said: No one narrated it from Ash'ath bin Sawwar except Sharik. We (the editors) say: Sharik is "sayyi' al-hifz" (of poor memory), Ash'ath is "weak", and al-Hasan al-Basri did not hear from Jabir.
وروى ابن أبي ليلى عند الترمذي (2108) عن أبي الزبير عن جابر مرفوعًا: "لا يتوارث أهل ملتين، وقال الترمذي: حديث غريب لا نعرفه من حديث جابر إلَّا من حديث ابن أبي ليلى. قلنا: وابن أبي ليلى - وهو محمد بن عبد الرحمن بن أبي ليلى - سيئ الحفظ.
Reference / Source: Ibn Abi Layla narrated [in al-Tirmidhi (2108)] from Abu al-Zubayr, from Jabir as marfu': "The people of two (different) religions do not inherit from one another." Al-Tirmidhi said: "The hadith is gharib; we know it as the hadith of Jabir only through Ibn Abi Layla."
Technical note / Defect ('illah): We say: Ibn Abi Layla (Muhammad bin 'Abd al-Rahman) is "sayyi' al-hifz" (of poor memory).
وفي الباب عن علي موقوفًا عند سعيد بن منصور (142)، وابن أبي شيبة 11/ 372، وابن المنذر في "الأوسط" (6861). وسنده ضعيف، فيه الحارث الأعور.
Corroborating chains and supporting reports: On this topic there is a mawquf narration from 'Ali (may Allah be pleased with him) with Sa'id bin Mansur (142), Ibn Abi Shaybah (11/ 372) and Ibn al-Mundhir (6861).
Grading: Its chain is weak; it contains al-Harith al-A'war.
