Mustadrak al-Hakim — Hadith 8203

أخبرنا أبو عبد الله الشَّيباني وأبو يحيى السَّمَر قندي، قالا: حدثنا محمد بن نصر الإمام، حدثنا إسحاق بن إبراهيم، أخبرنا مَخْلَد بن يزيد الجَزَري، عن ابن جُرَيج، عن عمرو بن مُسلِم، عن طاووس، عن عائشة، عن رسول الله ﷺ قال: "اللهُ ورسوله مَولَى مَن لا مَولى له، والخالُ وارثُ مَن لا وارثَ له" (3)
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyidah Aishah (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) said: "Allah and His Messenger are the guardian of one who has no guardian, and the maternal uncle is the heir of one who has no heir."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

(3) صحيح لغيره، وهذا إسناد ضعيف، عمرو بن مسلم - وهو الجَنَدي اليماني - ليس بذاك القوي، وقد تفرَّد برفعه من حديث عائشة ﵂، واختُلف على ابن جريج في رفعه ووقفه كما سيأتي، وقد صرَّح بسماعه له من عمرو بن مسلم عند إسحاق بن راهويه. وهو في "مسنده" برقم (1234).
Grading: This hadith is "sahih li-ghayrihi", while this chain is weak.
Technical note / Defect ('illah): 'Amr bin Muslim (al-Janadi al-Yamani) is not that strong a narrator, and he is alone in narrating this hadith as marfu' from 'A'ishah. Also, there is disagreement on Ibn Jurayj over whether it is marfu' or mawquf (as will come). However, with Ishaq bin Rahawayh he (Ibn Jurayj) explicitly states that he heard it from 'Amr bin Muslim. It is in his (Ishaq's) "Musnad" at number (1234).
وخالف عبد الحميد بن محمد الحرّاني إسحاقَ بن راهويه عند النسائي (6319)، فرواه عن مخلد بن يزيد عن ابن جريج عن عمرو بن مسلم، عن طاووس، عن عائشة من قولها.
Technical note / Defect ('illah): 'Abd al-Hamid bin Muhammad al-Harrani contradicted Ishaq bin Rahawayh [in al-Nasa'i (6319)]; he narrated it from Makhlad bin Yazid, from Ibn Jurayj, from 'Amr bin Muslim, from Tawus, from 'A'ishah as "mawquf" (as her own statement).

Technical note / Defect ('illah): There is disagreement on Ibn Jurayj over whether this hadith is marfu' or mawquf, and also regarding its chain:
فرواه عبدُ الرزاق في "مصنفه" (16202) و (19124)، ومن طريقه إسحاق بن راهويه (1232)، وأبو عوانة في "صحيحه" (5641)، والدارقطني في "العلل - ط الريان" 9/ 476، ومحمدُ بن بكر البُرْساني عند الدارقطني أيضًا، وهشامُ بن سليمان المكي عند الطحاوي في "شرح معاني الآثار" 4/ 397، ثلاثتهم (عبد الرزاق والبرساني والمكي) عن ابن جريج، به موقوفًا على عائشة.
Details of the narration: It was narrated by 'Abd al-Razzaq in his "Musannaf" (16202, 19124) - and via him Ishaq bin Rahawayh (1232), Abu 'Awanah in his "Sahih" (5641) and al-Daraqutni in "al-'Ilal" (9/ 476) -; by Muhammad bin Bakr al-Bursani (with al-Daraqutni); and by Hisham bin Sulayman al-Makki (in al-Tahawi 4/ 397). All three ('Abd al-Razzaq, al-Bursani, al-Makki) narrate it from Ibn Jurayj as "mawquf" on 'A'ishah.
وخالفهم إسحاق بن إبراهيم السمرقندي عند أبي عوانة (5640)، فرواه عن ابن جريج به مرفوعًا.
Technical note / Defect ('illah): They were contradicted by Ishaq bin Ibrahim al-Samarqandi [in Abu 'Awanah (5640)]; he narrated it from Ibn Jurayj as "marfu'".
ورواه أبو عاصم النبيل الضحاكُ بن مخلد عن ابن جريج، فكان يرفعه أحيانًا، ويقفه أحيانًا، فأخرجه الترمذي (2104)، والنسائي (6318)، والبزار في "مسنده" (248)، وأبو عوانة (5638)، والطحاوي 4/ 397، وابن عدي في "الكامل" 5/ 119، والدارقطني في "السنن" (4112) و (4113)، والبيهقي 6/ 215 من طرق عن أبي عاصم النبيل، عن ابن جريج، به مرفوعًا. وقال الترمذي: حديث غريب، وقد أرسله بعضهم ولم يذكر فيه عن عائشة. وقال الدارقطني في "العلل": كان أبو عاصم ربما رفعه وربما وقفه، ورفعُه وهمٌ. وقال البيهقي: كان أبو عاصم يرفعه في بعض الروايات عنه ثم شكّ فيه، فالرفع غير محفوظ والله أعلم. وقال البزار: وهذا الحديث لا نعلم أسنده عن ابن جريج إلَّا أبو عاصم قلنا: قد سبق أنَّ غير واحد أسنده عن ابن جريج.
Details of the narration: Abu 'Asim al-Nabil (al-Dahhak bin Makhlad) narrated it from Ibn Jurayj; he would sometimes narrate it as marfu' and sometimes as mawquf. Thus al-Tirmidhi (2104), al-Nasa'i (6318), al-Bazzar (248), Abu 'Awanah (5638), al-Tahawi (4/ 397), Ibn 'Adi (5/ 119), al-Daraqutni (4112, 4113) and al-Bayhaqi (6/ 215) narrated it via various routes from Abu 'Asim al-Nabil as "marfu'". Al-Tirmidhi said: "The hadith is gharib; some narrated it as mursal and did not mention 'A'ishah in it." Al-Daraqutni said in "al-'Ilal": "Abu 'Asim would sometimes make it marfu' and sometimes mawquf, and his making it marfu' is an 'error' (wahm)." Al-Bayhaqi said: "Abu 'Asim made it marfu' in some narrations from him, then he had doubts about it; so the marfu' version is not preserved." Al-Bazzar said: "We do not know anyone who narrated it as musnad (connected) from Ibn Jurayj except Abu 'Asim." We (the editors) say: it has passed that more than one narrator narrated it as musnad from Ibn Jurayj.
وأخرجه الدارمي (3020)، وأبو عوانة (5642)، والطحاوي 4/ 397، والدارقطني (4114) و (4115)، والبيهقي 6/ 215 من طرق عن أبي عاصم النبيل، عن ابن جريج، به موقوفًا. زاد الدارقطني في روايته فقيل لأبي عاصم: عن النبي ﷺ؟ فسكت، فقال له الشاذكوني: حدِّثنا عن النبي ﷺ، فسكت. وقال البيهقي: هذا هو المحفوظ من قول عائشة موقوفًا عليها.
Reference / Source: Al-Darimi (3020), Abu 'Awanah (5642), al-Tahawi (4/ 397), al-Daraqutni (4114, 4115) and al-Bayhaqi (6/ 215) narrated it via Abu 'Asim al-Nabil, from Ibn Jurayj, as "mawquf". Al-Daraqutni added in his narration that Abu 'Asim was asked: "Is it from the Prophet (peace and blessings be upon him)?" and he remained silent; then al-Shadhakuni said to him: "Narrate it to us from the Prophet (peace and blessings be upon him) (as marfu')", and he remained silent.
Grading: Al-Bayhaqi said: "What is preserved is that it is the statement of 'A'ishah (mawquf)."
وأخرجه عبد الرزاق (16201) و (19123) - وعنه إسحاق بن راهويه (1232 م) - عن ابن جريج، قال: أخبرني ابن طاووس، عن رجل مصدَّق، عن النبي ﷺ. وهذا إسناد ضعيف لإبهام شيخ عبد الله بن طاووس فيه، وهو مرسل أيضًا.
Reference / Source: 'Abd al-Razzaq (16201, 19123) - and from him Ishaq bin Rahawayh (1232 M) - narrated it from Ibn Jurayj, who said: Ibn Tawus informed me, from a "trustworthy man" (rajul musaddaq), from the Prophet (peace and blessings be upon him).
Grading: This chain is weak because the shaykh of 'Abdullah bin Tawus in it is "unnamed" (mubham), and it is also "mursal".
وأخرجه عبد الرزاق (12488) و (16199) و (19122) عن معمر، عن ابن طاووس قال: أُخبرتُ عن رجل من أهل المدينة، أن النبي ﷺ قال، فذكره. وفي سنده مبهم كسابقه.
Reference / Source: 'Abd al-Razzaq (12488, 16199, 19122) narrated it from Ma'mar, from Ibn Tawus, who said: "I was informed from a man of the people of Madinah that the Prophet (peace and blessings be upon him) said", and he mentioned the hadith.
Technical note / Defect ('illah): Its chain too, like the previous narration, contains an "unnamed" (mubham) narrator.
وأخرجه عبد الرزاق (12489)، وإسحاق بن راهويه (1233) - واللفظ له كلاهما عن سفيان بن عيينة، عن ابن طاووس، قال: قال رسول الله ﷺ، مثله. قيل لسفيان: ابن طاووس عن من؟ قال: خالفني معمر في إسناده فتركته.
Reference / Source: 'Abd al-Razzaq (12489) and Ishaq bin Rahawayh (1233) - the wording is Ishaq's - narrated it from Sufyan bin 'Uyaynah, from Ibn Tawus, who said: "The Messenger of Allah (peace and blessings be upon him) said" the like of it. Sufyan was asked: "From whom does Ibn Tawus narrate it?" He said: "Ma'mar differed with me about its chain, so I left it (the chain) out."
