لَا يَرِثُ الْمَيِّتُ مِنَ الْمَيِّتِ إِذَا لَمْ يُعْرَفْ أَيُّهُمَا مَاتَ قَبْلَ صَاحِبِهِ

أخبرَناه أبو عبد الله وأبو يحيى قالا حدثنا محمد بن نصر، حدثنا يحيى بن يحيى، أخبرنا خارجة، عن ثَور، عن سليمان بن موسى، عن عطاء، عن ابن عباس: أنه كان لا يُورِّثُ الميّتَ من الميّت إذا لم يُعرف أيُّهما ماتَ قبل صاحبه (3).

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that he would not make one deceased person the heir of another deceased person when it was not known which of them died before the other.

(3) إسناده ضعيف جدًّا خارجة - وهو ابن مصعب الخراساني - متروك. ثور: هو ابن يزيد بن زياد الحمصي وسليمان بن موسى هو المعروف بالأشدق، وعطاء: هو ابن أبي رباح.
Grading: Its chain is "very weak" (da'if jiddan); Kharijah (Ibn Mus'ab al-Khurasani) is "matruk" (abandoned).
Technical note / Defect ('illah): Thawr is Ibn Yazid bin Ziyad al-Himsi; Sulayman bin Musa is the one known as al-Ashdaq; and 'Ata' is Ibn Abi Rabah.
