(1) صحيح لغيره، وهذا إسناد منقطع، فإن الزهري لم يسمعه من قبيصة بن ذؤيب، كان يُدخل أحيانًا بينه وبين قبيصة رجلًا، لذلك قال النسائي بإثر الرواية (6308): الزهري لم يسمعه من قبيصة، وقال الدارقطني في "العلل" 1/ 248 - 249: الزهري لم يسمعه من قبيصة، وإنما سمعه من عثمان عنه. قلنا: عثمان هذا هو عثمان بن إسحاق بن خرشة، سمّاه الإمامُ مالك كما سيأتي.
Grading: This hadith is "sahih li-ghayrihi" (authentic due to supporting evidence), though this chain is munqati' (broken); for al-Zuhri did not hear it from Qabisah bin Dhu'ayb, and he would sometimes place a man between himself and Qabisah. For this reason al-Nasa'i said after narration (6308): "Al-Zuhri did not hear it from Qabisah." And al-Daraqutni said in "al-'Ilal" (1/ 248-249): "Al-Zuhri did not hear it from Qabisah; rather, he heard it from 'Uthman, from him."
Important point: We say: this 'Uthman is "'Uthman bin Ishaq bin Kharashah"; Imam Malik named him, as will come.
وعثمان لم يرو عنه غير الزهري، ووثقه ابن معين.
Technical note / Defect ('illah): No one other than al-Zuhri narrated from 'Uthman, and Ibn Ma'in declared him trustworthy.
وأعلّ بعضُ أهل العلم الحديثَ بالانقطاع بين قبيصة بن ذؤيب وأبي بكر، قال البخاري في "التاريخ الكبير" 6/ 212: عثمان بن إسحاق بن خرشة عن قبيصة بن ذؤيب عن أبي بكر في الجدة، مرسل. وكذا أعله بالانقطاع ابن حزم والمنذري وعبد الحق الإشبيلي وابن القطان الفاسي؛ لأن قبيصة ولد عام الفتح على الأرجح، فلم يسمع من أبي بكر. وقال الحافظ ابن حجر في "التلخيص الحبير": إسناده لثقة رجاله، إلَّا أنَّ صورته مرسل، فإن قبيصة لا يصح له سماع من الصدّيق، ولا يمكن شهوده للقصة.
Technical note / Defect ('illah): Some scholars declared this hadith defective due to a break between Qabisah bin Dhu'ayb and Abu Bakr (may Allah be pleased with him). Al-Bukhari said in "al-Tarikh al-Kabir" (6/ 212): "'Uthman bin Ishaq bin Kharashah, from Qabisah bin Dhu'ayb, from Abu Bakr - concerning the grandmother - is mursal." Likewise Ibn Hazm, al-Mundhiri, 'Abd al-Haqq al-Ishbili and Ibn al-Qattan al-Fasi declared it broken; because Qabisah, according to the preponderant view, was born in the year of the Conquest (of Makkah), so he did not hear from Abu Bakr al-Siddiq. Al-Hafiz Ibn Hajar said in "al-Talkhis al-Habir": "Its chain is (sound) because its narrators are trustworthy, but in form it is mursal, for Qabisah's hearing from al-Siddiq is not established, nor is it possible that he witnessed the incident."
وخالفهم آخرون من أهل العلم، فصححوه؛ كالترمذي وابن حبان والحاكم، وانتقاه ابن الجارود (959)، لأنَّ قبيصة من كبار التابعين، ولأنه ربما سمع القصة من محمد بن مسلمة أو من المغيرة بن شعبة. لذا قال ابن الملقن في "البدر المنير" (7/ 208 - 209: على كل حال هو حجة، لأنه إما مرسل صحابي، أو لأنه يجوز أن يكون سمعه بعد ذلك من المغيرة أو محمد بن مسلمة، وتصحيح الترمذي وابن حبان والحاكم له، وقبلهم الإمام مالك كافٍ، وقد قال ابن المنذر: أجمع أهل العلم على أنَّ للجدة السدس إذا لم تكن أمٌّ، وهذا عاضدٌ له أيضًا.
Important point: Other scholars, however, differed with them and declared it sahih, such as al-Tirmidhi, Ibn Hibban and al-Hakim, and Ibn al-Jarud selected it in "al-Muntaqa" (959). This is because Qabisah is one of the senior Tabi'in, and perhaps he heard the incident from Muhammad bin Maslamah or from al-Mughirah bin Shu'bah. Hence Ibn al-Mulaqqin said in "al-Badr al-Munir" (7/ 208-209): "In any case it is a proof, because it is either the mursal of a Companion, or it is possible that he later heard it from al-Mughirah or Muhammad bin Maslamah. Its authentication by al-Tirmidhi, Ibn Hibban and al-Hakim, and before them (its acceptance by) Imam Malik, is sufficient." Moreover, Ibn al-Mundhir said: "The scholars are unanimous that the grandmother gets a sixth when there is no mother", and this consensus also supports the hadith.
قلنا: والحديث أخرجه سعيد بن منصور في "السنن" (80)، وابن أبي شيبة 11/ 320، وأخرجه أبو يعلى (120) عن عبيد الله بن عمر القواريري، ثلاثتهم (سعيد وابن أبي شيبة والقواريري) عن سفيان بن عيينة، عن الزهري، عن قبيصة. وذكر بعضهم قصة عمر بن الخطاب في آخره. وأخرجه الترمذي (2100) عن محمد بن أبي عمر، عن سفيان بن عيينة قال: حدثنا الزهري، قال مرةً: قال قبيصة، وقال مرةً: عن رجل عن قبيصة بن ذؤيب قال فذكره. وزاد في آخره: ثم جاءت الجدّة الأخرى التي تخالفها إلى عمر. قال سفيان وزادني فيه معمر عن الزهري - ولم أحفظه عن الزهري، ولكن حفظته من معمر - أنَّ عمر قال: إن اجتمعتما فهو لكما، وأيتكما انفردت به فهو لها.
Reference / Source: We say: this hadith was narrated by Sa'id bin Mansur in "al-Sunan" (80), Ibn Abi Shaybah (11/ 320) and Abu Ya'la (120) from 'Ubaydullah bin 'Umar al-Qawariri; all three from Sufyan bin 'Uyaynah, from al-Zuhri, from Qabisah. Some of them mentioned the story of 'Umar bin al-Khattab at its end. Al-Tirmidhi (2100) narrated it from Muhammad bin Abi 'Umar, from Sufyan bin 'Uyaynah; Sufyan once said "al-Zuhri narrated to us" and once "from a man, from Qabisah". And he added at the end: "Then the other grandmother, who differed from her (in kinship), came to 'Umar." Sufyan said that Ma'mar told him this addition from al-Zuhri - and he had not memorized it from al-Zuhri but memorized it from Ma'mar - that 'Umar said: "If you two are together, it (the sixth) is shared by you both, and whichever of you is alone, it is hers."
وأخرجه النسائي (6311) عن محمد بن عبد الله بن يزيد المقرئ عن سفيان، قال: سمعت الزهري يحدث عن رجل، عن قبيصة بن ذؤيب، فذكره.
Reference / Source: Al-Nasa'i (6311) narrated it from Muhammad bin 'Abdullah bin Yazid al-Muqri', from Sufyan, who said: I heard al-Zuhri narrating from a man, from Qabisah bin Dhu'ayb, and he mentioned the hadith.
وأخرجه أحمد 29/ (17978)، والنسائي (6307) من طريق معمر، وابن ماجه (2724)، والنسائي (6310) من طريق يونس بن يزيد، والنسائي (6305) من طريق صالح بن كيسان، و (6306) من طريق الأوزاعي، و (6307) و (6308) من طريق إسحاق بن راشد، و (6309) من طريق شعيب بن أبي حمزة، كلهم عن الزهري، عن قبيصة. ووقع في رواية إسحاق بن راشد: أنَّ الجدة أم الأم أتت أبا بكر. والصواب أنَّ الحديث لم يعيِّن من هي الجدة، وقد روى الزهري الحديث على الشك: أم الأم، أو أم الأب.
Reference / Source: Ahmad (29/ 17978) and al-Nasa'i (6307) narrated it via Ma'mar; Ibn Majah (2724) and al-Nasa'i (6310) via Yunus bin Yazid; al-Nasa'i (6305) via Salih bin Kaysan, (6306) via al-Awza'i, (6307, 6308) via Ishaq bin Rashid, and (6309) via Shu'ayb bin Abi Hamzah. All of them narrate it from al-Zuhri, from Qabisah. In the narration of Ishaq bin Rashid it says that "the maternal grandmother (the mother's mother) came to Abu Bakr", whereas the correct position is that the hadith does not specify which grandmother she was, and al-Zuhri narrated it with doubt: "the mother's mother or the father's mother".
ووقع في رواية صالح بن كيسان عن الزهري التصريح بإخبار قبيصة للزهري بهذا الحديث، قال النسائي كما "تحفة الأشراف" للمزي 8/ 362: حديث صالح خطأ، لأنه قال: إنَّ قبيصة أخبره، والزهري لم يسمعه من قبيصة.
Technical note / Defect ('illah): In the narration of Salih bin Kaysan from al-Zuhri it is explicitly stated that Qabisah told al-Zuhri this hadith; but Imam al-Nasa'i said (as in al-Mizzi's "Tuhfat al-Ashraf" 8/ 362): "The hadith of Salih is a mistake, because he said that Qabisah informed him, while al-Zuhri did not hear it from Qabisah."
ورواه مالك بن أنس في "الموطأ" 2/ 513، ومن طريقه أحمد (17980)، وأبو داود (2894)، وابن ماجه (2724)، والترمذي (2101)، والنسائي (6312)، وابن حبان (6031) عن الزهري، عن عثمان بن إسحاق بن خرشة، عن قبيصة بن ذؤيب، فذكره. وقال الترمذي: حسن صحيح، وهو أصح من حديث ابن عيينة.
Reference / Source: Malik bin Anas narrated it in "al-Muwatta'" (2/ 513), and via him Ahmad (17980), Abu Dawud (2894), Ibn Majah (2724), al-Tirmidhi (2101), al-Nasa'i (6312) and Ibn Hibban (6031), from al-Zuhri, from 'Uthman bin Ishaq bin Kharashah, from Qabisah bin Dhu'ayb. Imam al-Tirmidhi said: This hadith is hasan sahih, and it is more authentic than the hadith of Ibn 'Uyaynah.
قلنا وتابع مالكًا على ذكر عثمان بن إسحاق بين الزهري وقبيصة: أبو أويس عبد الله بن عبد الله بن أويس فيما قاله الدارقطني في "العلل" 1/ 248، وقال: يشبه أن يكون الصواب ما قاله مالك وأبو أويس.
Corroborating chains and supporting reports: We (the editors) say: Imam Malik was corroborated in mentioning 'Uthman bin Ishaq between al-Zuhri and Qabisah by Abu Uways ('Abdullah bin 'Abdullah bin Uways), as al-Daraqutni stated in "al-'Ilal" (1/ 248), and he said: "It seems that the correct version is what Malik and Abu Uways said."
