Mustadrak al-Hakim — Hadith 8196

كما حدَّثَناه أبو بكر بن إسحاق، أخبرنا محمد بن أحمد بن هارون العُوْدي، حدثنا سليمان بن داود الشَّاذَكُوني، حدثنا إسماعيل بن إبراهيم، حدثنا محمد بن عمرو بن عَلقَمة، عن شَريك بن أبي نَمِرٍ، أنَّ الحارث بن عبدٍ (2) أخبره: أنَّ رسولَ الله ﷺ سُئِلَ عن ميراث العمَّة والخالة، فسكتَ، فنزل عليه جبريلُ ﵇ فقال: "حدَّثني جبريلُ أن لا ميراثَ لهما" (3).
It is narrated from al-Harith bin Abd that the Messenger of Allah (peace and blessings be upon him) was asked about the inheritance of the paternal aunt and the maternal aunt, and he remained silent. Then Jibril (peace be upon him) descended upon him, and he (peace and blessings be upon him) said: "Jibril has told me that there is no inheritance for the two of them (the paternal aunt and the maternal aunt)."

(3) إسناده ضعيف جدًّا، سليمان بن داود الشاذكوني متروك متهم، وتفرَّد فيه بذكر الحارث بن عبد، والحارث هذا مجهول لا يعرف في غير هذا الحديث عند الحاكم كما قال ابن التركماني في "الجوهر النقي" 6/ 213، وقال ابن الملقن في "البدر المنير" 7/ 202: لا أعرف حاله. قلنا: وقد رواه غير واحد من الثقات عن محمد بن عمرو فلم يذكروا فيه الحارث، إنما أرسلوه عن شريك بن أبي نمر عن النبي ﷺ، وأعلَّه الذهبي في "التلخيص" بالشاذكوني وبالإرسال.
Grading: Its chain is "very weak" (da'if jiddan); Sulayman bin Dawud al-Shadhakuni is "matruk and accused", and he is alone in mentioning al-Harith bin 'Abd in it.
Technical note / Defect ('illah): Al-Harith is "majhul" (unknown) and is not known anywhere other than in this hadith with al-Hakim, as Ibn al-Turkumani said in "al-Jawhar al-Naqi" (6/ 213); and Ibn al-Mulaqqin said in "al-Badr al-Munir" (7/ 202): "I do not know his condition." We say: more than one trustworthy narrator narrated it from Muhammad bin 'Amr without mentioning al-Harith; rather, they narrated it as "mursal" from Sharik bin Abi Namir, from the Prophet (peace and blessings be upon him). Al-Dhahabi declared it defective in "al-Talkhis" because of al-Shadhakuni and because of its being mursal.
وأخرجه مرسلًا ابن أبي شيبة 11/ 263، وهشام بن عمار في "حديثه" (142)، والدارقطني (4100) و (4160) من طرق عن محمد بن عمرو، عن شريك بن عبد الله بن أبي نمر قال: سُئل النبي ﷺ، فذكره.
Reference / Source: Ibn Abi Shaybah (11/ 263), Hisham bin 'Ammar in his "Hadith" (142), and al-Daraqutni (4100, 4160) narrated it as "mursal". All of them via Muhammad bin 'Amr, from Sharik bin 'Abdullah bin Abi Namir, who said: The Prophet (peace and blessings be upon him) was asked, and he mentioned the hadith.
قال الدارقطني: وكذلك رواه عبد الوهاب الثقفي وغيره عن محمد بن عمرو، ورواه مسعدة بن اليسع عن محمد بن عمرو عن أبي سلمة عن أبي هريرة، ووهم فيه والأول أصحُّ.
Technical note / Defect ('illah): Al-Daraqutni said: "Likewise 'Abd al-Wahhab al-Thaqafi and others narrated it from Muhammad bin 'Amr. Mas'adah bin al-Yasa' narrated it from Muhammad bin 'Amr, from Abu Salamah, from Abu Hurayrah (i.e. made it connected), but he erred in it; the first (the mursal) is more authentic."
قلنا: ومسعدة بن اليسع تالف متهم، وقد أخرج حديث أبي هريرة الدارقطنيُّ في "سننه" (4159)، وقال عقبه: لم يسنده غير مسعدة عن محمد بن عمرو، وهو ضعيف والصواب مرسل.
Grading: We (the editors) say: Mas'adah bin al-Yasa' is "talif and accused". Al-Daraqutni narrated the hadith of Abu Hurayrah in his "Sunan" (4159) and said after it: "No one other than Mas'adah narrated it as musnad (connected) from Muhammad bin 'Amr, and he is weak; what is correct is that it is mursal."
