أخبرنا أبو عبد الله محمد بن عبد الله الزاهد الأصبهاني، حدثنا أَسِيد بن عاصم، حدثنا الحسين بن حفص، حدثنا سفيان، عن أبي قيس الأَوْدي، عن هُزَيل بن شُرَحبيل، قال: أتيتُ أبا موسى وسلمان بن رَبِيعة في ابنةٍ، وابنةِ ابنٍ، وأختٍ لأب وأمّ، فقالا: للابنة النِّصفُ، وللأختِ النَّصفُ، وقالا: ائتِ ابنَ مسعود فإنه سيتابعُنا، فأتيتُ ابن مسعود فأخبرتُه بما قالا، فقال ابن مسعود: لقد ضَلَلتُ إذًا وما أنا من المُهتَدِين، ولكني أَقضي بما قَضَى به رسولُ الله ﷺ: للابنة النِّصفُ، ولابنة الابنِ السُّدسُ، وما بقيَ فللأخت (1).
هذا حديث صحيح على شرط الشيخين.

It is narrated from Huzayl bin Shurahbil that he said: I came to Sayyiduna Abu Musa and Salman bin Rabi'ah (may Allah be pleased with them both) with a question of inheritance concerning a daughter, a son's daughter and a full sister (from the same father and mother). They both said: The daughter gets half and the sister gets half. And they said: Go to Ibn Mas'ud; he will agree with us. So I went to Ibn Mas'ud (may Allah be pleased with him) and told him what the two of them had said. Ibn Mas'ud (may Allah be pleased with him) said: "Then I would have gone astray and would not be among the rightly guided. Rather, I will judge according to what the Messenger of Allah (peace and blessings be upon him) judged: the daughter gets half (1/2), the son's daughter gets one sixth (1/6) (so that two thirds are completed), and whatever remains is for the sister."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim).

حدثنا أبو العباس محمد بن يعقوب، حدثنا بَحْر بن نَصر، حدثنا عبد الله بن وهب، أخبرني ابن أبي الزِّناد، عن أبيه، عن خارجة بن زيد بن ثابت، عن أبيه قال: مِيراثُ الإخوة من الأب والأمِّ أنَّهم لا يَرِثُون معَ الولد الذَّكر، ولا معَ ولدِ الابن ولا معَ الأبِ شيئًا (2).
هذا حديث صحيح على شرط الشيخين ولم يُخرجاه، وقد اتَّفقا على غير حديثٍ مثل هذا من فَتَوى زيد بن ثابت ﵀.

Kharijah bin Zayd bin Thabit narrates from his father, Sayyiduna Zayd bin Thabit (may Allah be pleased with him): The ruling on the inheritance of brothers from the same mother and father (full brothers) is that they do not inherit anything in the presence of a son, nor in the presence of a son's son, nor in the presence of the father.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it. Yet the two of them agreed on several fatwas of Sayyiduna Zayd bin Thabit (may Allah be pleased with him) of this kind.

أخبرنا أحمد بن كامل القاضي، حدثنا عبد الله بن رَوْح المَدائني، حدثنا شَبَابة بن سَوَّار، حدثنا ابن أبي ذئب، عن شُعْبة مولى ابن عباس، عن ابن عباس: أنه دخل على عثمان بن عفّان فقال: إِنَّ الأَخَوَينِ لا يَرُدَّان الأمَّ عن الثُّلث؛ قال الله ﷿: ﴿فَإِنْ كَانَ لَهُ إِخْوَةٌ فَلِأُمِّهِ السُّدُسُ﴾ [النساء:11]، فالأخَوانِ بلسانِ قومِك ليسا بإخوة! فقال عثمانُ بن عفّان: لا أستطيعُ أن أردَّ ما كان قَبْلِي ومَضَى في الأمصار، وتوارثَ به الناسُ (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that he went to Sayyiduna Uthman bin Affan (may Allah be pleased with him) and said: Two brothers do not reduce the mother's share from one third (1/3) to one sixth (1/6), for Allah, the Mighty and Majestic, has said: "If he has brothers, then for his mother is one sixth" [Surah al-Nisa: 11], and in the language of your people two brothers are not called "ikhwah" (brothers, plural)! Sayyiduna Uthman bin Affan (may Allah be pleased with him) said: "I do not have the power to change what (was decided) before me, what has been implemented in the cities, and according to which people have been inheriting from one another."
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

حدثنا أبو العباس محمد بن يعقوب، حدثنا بَحْر بن نصر، حدثنا عبد الله بن وهب، أخبرني عبد الرحمن بن أبي الزِّناد، عن أبيه، عن خارجة بن زيد بن ثابت، عن أبيه أنه كان يقول: الإخوةُ في كلام العرب أَخَوانِ (2) فصاعدًا (3).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.
