Mustadrak al-Hakim — Hadith 8175

فأخبرَناه أبو يحيى، حدثنا محمد بن نصر، أخبرنا عبد الرزاق، عن ابن جُرَيج (1). وأما حديثُ مَعمَر:
It is narrated from Tawus (may Allah have mercy on him), in mursal form, that the Messenger of Allah (peace and blessings be upon him) said: "Distribute the wealth according to its fixed shares, then whatever remains is for the nearest male relative."

وأخرجه عبد الرزاق (19037) - ومن طريقه البيهقي 6/ 234 - عن ابن جريج قال: قلت لابن طاووس: ترك أباه وأمه وابنته، كيف؟ قال: لابنته النصف، لا يزاد، والسدس للأب، والسدس للأم، ثم السدس الآخر للأب، قلت: فإن ترك أمه وابنته، فلابنته النصف ولأمه الثلث؟ قال: نعم، لا يزاد البنت على النصف، ثم أخبرني عن أبيه أن النبي ﷺ قال: "ألحقوا المال بالفرائض، فما تركت الفرائضُ من فضل، فلأَدنى رجل ذكر".
Reference / Source: 'Abd al-Razzaq (19037) - and via him al-Bayhaqi (6/ 234) - narrated it from Ibn Jurayj, who said: I said to Ibn Tawus: "(If someone) dies leaving his father, his mother and his daughter, how is (the inheritance divided)?" He said: "The daughter gets half, no more; the father a sixth and the mother a sixth; then the other sixth (as residuary) goes to the father." I said: "If he leaves his mother and his daughter, does the daughter get half and the mother a third?" He said: "Yes, the daughter is not given more than half." Then he informed me from his father that the Prophet (peace and blessings be upon him) said: "Give the estate to those with fixed shares, then whatever the fixed shares leave over is for the nearest male."
