Ali bin Rabi'ah (may Allah have mercy on him) narrated that one day he went out to the great mosque, while Sayyiduna al-Mughirah bin Shu'bah (may Allah be pleased with him) was the governor of Kufah. Al-Mughirah (may Allah be pleased with him) came out to the mosque, ascended the pulpit, praised Allah and extolled Him, and then said: What is this wailing in Islam? They said: A man of the Ansar called Qarazah bin Ka'b has died, and wailing was done over him. Al-Mughirah (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) say: "Lying about me is not like lying about anyone else; so whoever lies about me, let him take his seat in the Fire." And I heard the Prophet (peace and blessings be upon him) say: "Whoever is wailed over will indeed be punished because of the wailing done over him."

The statement of Ibn Umar (may Allah be pleased with them both), that the one who is wailed over is punished because of his family's weeping over him, was mentioned in the presence of Sayyidah Aishah (may Allah be pleased with her), and she said: May Allah have mercy on Abu Abd al-Rahman! He heard something and did not retain it. What happened was that the funeral of a Jewish man passed by, and his family were weeping, and the Messenger of Allah (peace and blessings be upon him) said: "They are weeping, and he is being punished."

Amrah (may Allah have mercy on her) said: I asked Sayyidah (Aishah) (may Allah be pleased with her) about this, and she said: May Allah have mercy on him. The Messenger of Allah (peace and blessings be upon him) said, concerning a Jewish woman whose family were weeping: "They are weeping over her, and she is being punished in the grave."

Qutaybah bin Sa'id narrates from Malik bin Anas (may Allah have mercy on him) with the same chain, except that (in it) Amrah bint Abd al-Rahman (may Allah have mercy on her) informed him that Sayyidah Aishah (may Allah be pleased with her) said: May Allah Almighty forgive Abu Abd al-Rahman (may Allah be pleased with him); and he said: "she was being wept over."

Abdullah bin Ubaydullah bin Abi Mulaykah (may Allah have mercy on him) said: A daughter of Sayyiduna Uthman (may Allah be pleased with him) died in Makkah, and we came to attend her (funeral). Sayyiduna Ibn Umar and Sayyiduna Ibn Abbas (may Allah be pleased with them) were also present, and I was between them. He said: I was sitting beside one of them, and then the other came and sat beside me. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said to Amr bin Uthman: Will you not forbid the women from weeping? For the Messenger of Allah (peace and blessings be upon him) said: "The deceased is punished because of the weeping of his family." Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: Sayyiduna Umar (may Allah be pleased with him) also used to say something like that. Then he narrated: I came back with Sayyiduna Umar (may Allah be pleased with him) from Makkah, and when we reached al-Bayda', there was a caravan under a tree. He said: Go and see who these people of the caravan are. He said: I looked, and it was Sayyiduna Suhayb (may Allah be pleased with him). I told him, and he said: Call him to me. So I went to Sayyiduna Suhayb (may Allah be pleased with him) and said: Come to the Commander of the Believers. When Sayyiduna Umar (may Allah be pleased with him) was martyred, Sayyiduna Suhayb (may Allah be pleased with him) came in weeping, saying: Alas, my brother! Alas, my companion! Sayyiduna Umar (may Allah be pleased with him) said: O Suhayb! Do you weep over me, when the Messenger of Allah (peace and blessings be upon him) said: "The deceased is indeed punished because of some of the weeping of his family." Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: When Sayyiduna Umar (may Allah be pleased with him) died, I mentioned this to Sayyidah Aishah (may Allah be pleased with her), and she said: May Allah have mercy on him. The Messenger of Allah (peace and blessings be upon him) did not narrate it like this, that "Allah Almighty punishes the believer because of the weeping of his family"; rather, the Messenger of Allah (peace and blessings be upon him) said: "Allah Almighty increases the punishment of the disbeliever because of the weeping of his family." He said: Sayyidah Aishah (may Allah be pleased with her) said: The Qur'an is sufficient for you: "And no bearer of burdens will bear the burden of another." [Surah al-An'am: 164] He said: At that, Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: It is Allah who makes one weep and makes one laugh. Ibn Abi Mulaykah (may Allah have mercy on him) said: By Allah! Sayyiduna Ibn Umar (may Allah be pleased with them both) did not say anything (in reply).

Imam al-Shafi'i (may Allah have mercy on him) said: No narration is more likely to be preserved than what Sayyidah Aishah (may Allah be pleased with her) narrated from the Messenger of Allah (peace and blessings be upon him), because of the indication of the Book of Allah and the Sunnah. If it is asked: What is the evidence from the Book? It is this: "And no bearer of burdens will bear the burden of another" [Surah al-Isra: 15], and this: "And that there is nothing for a person except what he strives for" [Surah al-Najm: 39], and this saying: "So whoever does an atom's weight of good will see it, and whoever does an atom's weight of evil will see it" [Surah al-Zalzalah: 7-8], and this saying: "That every soul may be recompensed for what it strives for" [Surah Ta Ha: 15], that is, every soul will receive the recompense of what it did. And the evidence from the Sunnah is that the Messenger of Allah (peace and blessings be upon him) said to a man: "Is this your son?" He said: Yes. He (peace and blessings be upon him) said: "His sins will not be placed upon you, and your sins will not be placed upon him." So know that the Messenger of Allah (peace and blessings be upon him) conveyed the same as what Allah Almighty said: that each person's sins are upon himself, just as the deeds he does are his; they are not upon anyone else, nor are anyone else's upon him.
Imam al-Shafi'i (may Allah have mercy on him) said: Amrah preserved (the narrations of) Sayyidah Aishah (may Allah be pleased with her) better than Ibn Abi Mulaykah, and her narration is the more likely of the two to be preserved. If the hadith, contrary to what Ibn Abi Mulaykah narrated, is the saying of the Prophet (peace and blessings be upon him): "They are weeping over her, and she is being punished in the grave," then the matter is clear and needs no explanation, because she is being punished for disbelief while these people weep without knowing what is happening to her. And if the hadith is as Ibn Abi Mulaykah narrated, it is also correct, because a greater punishment than that is due upon the disbeliever; if he is being punished with less than it and his punishment is then increased, it is within what he has deserved. Whatever punishment a disbeliever receives is less than the greater (punishment due upon him), and whatever is added to his punishment is due to his own deserving, not due to the sin of someone else weeping over him. If it is said: Allah increases his punishment because of his family's weeping over him, it is answered: He increases him in what he deserved by his own deeds, and their weeping is (merely) a cause, not that he is punished because of their weeping over him. And it has reached me from Abu Ibrahim al-Muzani (may Allah have mercy on him) that he said: It has reached me that they used to leave instructions in their wills for weeping over them, or for wailing, or for both, and that is disobedience. So whoever ordered it, and it was done by his order, it is a sin for him, just as if he had ordered an act of obedience and it was done after him, it would be obedience for him. So just as he is rewarded for the obedience of which he is the cause, likewise it is possible that he is punished for the disobedience of which he is the cause, and success is only through Allah.
