بَابُ مَا جَاءَ فِي الْوَلِيِّ وَالشُّهُودِ .

عَنْ جَابِرٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لَا يُنْكَحُ النِّسَاءُ إِلَّا مِنَ الْأَكْفَاءِ ، وَلَا يُزَوَّجَهُنَّ إِلَّا الْأَوْلِيَاءُ ، وَلَا مَهْرَ دُونَ عَشَرَةِ دَرَاهِمَ " .
رَوَاهُ أَبُو يَعْلَى ، وَفِيهِ مُبَشِّرُ بْنُ عُبَيْدٍ ، وَهُوَ مَتْرُوكٌ .

Sayyiduna Jabir (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "Women are to be married only to their equals (kufu'), only the guardians are to marry them off, and there is no dowry less than ten dirhams."
Imam Abu Ya'la recorded it; its chain contains a narrator, Mubashshir bin Ubayd, and he is matruk (abandoned).

وَعَنِ ابْنِ عَبَّاسٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " أَيُّمَا امْرَأَةٍ تَزَوَّجَتْ بِغَيْرِ إِذْنِ وَلِيٍّ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ ، فَإِنْ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ أَبُو يَعْقُوبُ غَيْرُ مُسَمَّى ، فَإِنْ كَانَ هُوَ التَّوْأَمَ ، فَقَدْ وَثَّقَهُ ابْنُ حِبَّانَ ، وَضَعَّفَهُ ابْنُ مَعِينٍ ، وَإِنْ كَانَ غَيْرَهُ فَلَمْ أَعْرِفْهُ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Prophet (peace and blessings be upon him) said: "Any woman who marries without the permission of a guardian, her marriage is void, her marriage is void. If the man has had intercourse with her, then he has made her private part lawful, and for that reason the woman will receive the dowry; and the ruler is the guardian of one who has no guardian."
Imam al-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains a narrator, Abu Ya'qub (who is mentioned by his kunyah and) whose name is not mentioned. If he is "al-Taw'am", then Ibn Hibban declared him thiqah (trustworthy) and Yahya bin Ma'in declared him da'if (weak); and if he is someone else, then I do not know him. The remaining narrators of this report are thiqat (trustworthy).
Imam al-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains a narrator, Abu Ya'qub (who is mentioned by his kunyah and) whose name is not mentioned. Sayyiduna Abdullah bin Amr (may Allah be pleased with him) reports that the Prophet (peace and blessings be upon him) said: "Any woman who is married without the permission of her guardian, that woman's marriage will be void. Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Prophet (peace and blessings be upon him) said: "There is no marriage without the permission of a rightly-guiding (that is, sensible or sincere) guardian, or of the ruler."
Imam al-Tabarani recorded it in al-Mu'jam al-Awsat, and its narrators are the narrators of the Sahih.

Sayyiduna Abu Hurayrah (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "A woman cannot be married without the permission of a guardian."

وَرَوَاهُ فِي الْأَوْسَطِ فَقَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " الْبَغَايَا اللَّاتِي يُزَوِّجْنَ أَنْفُسَهُنَّ ، لَا يَجُوزُ نِكَاحٌ إِلَّا بِوَلِيٍّ وَشَاهِدَيْنِ وَمَهْرٍ مَا قَلَّ أَوْ كَثُرَ " .
وَفِي إِسْنَادِهِمَا الرَّبِيعُ بْنُ بَدْرٍ ، وَهُوَ مَتْرُوكٌ .
وَفِي إِسْنَادِهِمَا الرَّبِيعُ بْنُ بَدْرٍ ، وَهُوَ مَتْرُوكٌ .
Imam al-Tabarani also recorded this report in al-Mu'jam al-Awsat; he states: The Prophet (peace and blessings be upon him) said: "Immoral women marry themselves off. A marriage is not valid without a guardian, two witnesses and a dowry, whether it (the dowry) is small or large." The chain of both contains a narrator, al-Rabi' bin Badr, and he is matruk (abandoned).
وَعَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَشَاهِدَيْ عَدْلٍ " .

رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ مِنْ طَرِيقِ مُحَمَّدِ بْنِ عَبْدِ الْمَلِكِ عَنْ أَبِي الزُّبَيْرٍ ، فَإِنْ كَانَ هُوَ الْوَاسِطِيُّ الْكَبِيرُ فَهُوَ ثِقَةٌ وَإِلَّا فَلَمْ أَعْرِفْهُ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .

رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ عُثْمَانُ بْنُ عَبْدِ الرَّحْمَنِ الْوَقَّاصِيُّ ، وَهُوَ مَتْرُوكٌ .

Sayyidah Aishah Siddiqah (may Allah be pleased with her) narrates: The Prophet (peace and blessings be upon him) said: "There is no marriage without a guardian (wali) and two upright witnesses."
Imam al-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains a narrator, Uthman bin Abd al-Rahman al-Waqqasi, who is matruk (abandoned).

وَعَنْ أَبِي مُوسَى قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لَا نِكَاحَ إِلَّا بِوَلِيِّ وَشَاهِدَيْنِ " .
قُلْتُ : رَوَاهُ أَبُو دَاوُدَ ، وَغَيْرُهُ خَلَا قَوْلَهُ : " وَشَاهِدَيْنِ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَالْأَوْسَطِ إِلَّا أَنَّهُ قَالَ : " وَشُهُودٍ " . وَفِيهِ أَبُو بِلَالٍ الْأَشْعَرِيُّ ، وَهُوَ ضَعِيفٌ .
قُلْتُ : رَوَاهُ أَبُو دَاوُدَ ، وَغَيْرُهُ خَلَا قَوْلَهُ : " وَشَاهِدَيْنِ " .

Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "There is no marriage without a guardian (wali) and two witnesses." (Allamah al-Haythami says:) I say:

وَعَنْ عِمْرَانَ بْنِ حُصَيْنٍ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَشَاهِدَيْ عَدْلٍ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ عَبْدُ اللَّهِ بْنُ مُحْرِزٍ ، وَهُوَ مَتْرُوكٌ .

Sayyiduna Imran bin Husayn (may Allah be pleased with him) reports this saying of the Prophet (peace and blessings be upon him): "There is no marriage without a guardian (wali) and two upright witnesses."

وَعَنِ ابْنِ عَبَّاسٍ قَالَ : لَيْسَ لِلنِّسَاءِ مِنْ عُقْدَةِ النِّكَاحِ شَيْءٌ جَعَلَتْ مَيْمُونَةُ أَمْرَهَا إِلَى أُمِّ الْفَضْلِ فَجَعَلَتْهُ أُمُّ الْفَضْلَ إِلَى الْعَبَّاسِ فَأَنْكَحَهَا رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَالْأَوْسَطِ ، وَفِيهِ يَعْقُوبُ بْنُ حُمَيْدِ بْنِ كَاسِبٍ ، وَهُوَ ثِقَةٌ ، وَفِيهِ ضَعْفٌ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ . وَرَوَاهُ أَبُو يَعْلَى بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ : إِنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - خَطَبَ مَيْمُونَةَ فَجُعِلَ أَمْرُهَا إِلَى الْعَبَّاسِ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْكَبِيرِ ، وَالْأَوْسَطِ ، وَفِيهِ يَعْقُوبُ بْنُ حُمَيْدِ بْنِ كَاسِبٍ ، وَهُوَ ثِقَةٌ ، وَفِيهِ ضَعْفٌ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ . وَرَوَاهُ أَبُو يَعْلَى بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ : إِنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - خَطَبَ مَيْمُونَةَ فَجُعِلَ أَمْرُهَا إِلَى الْعَبَّاسِ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) says: Women have no say in contracting a marriage. Sayyidah Maymunah (may Allah be pleased with her) entrusted her matter to (her sister) Sayyidah Umm al-Fadl (may Allah be pleased with her), and Sayyidah Umm al-Fadl (may Allah be pleased with her) entrusted it to (her husband) Sayyiduna al-Abbas (may Allah be pleased with him), and Sayyiduna al-Abbas (may Allah be pleased with him) married Sayyidah Maymunah (may Allah be pleased with her) to the Prophet (peace and blessings be upon him).
Imam al-Tabarani recorded it in al-Mu'jam al-Kabir and al-Mu'jam al-Awsat; its chain contains a narrator, Ya'qub bin Humayd bin Kasib, who is thiqah (trustworthy) though there is some weakness in him, and the rest of its narrators are thiqat (trustworthy).
Imam Abu Ya'la recorded it similarly, except that he recorded the words: "The Prophet (peace and blessings be upon him) proposed to Sayyidah Maymunah (may Allah be pleased with her), and the matter of her marriage was entrusted to Sayyiduna al-Abbas (may Allah be pleased with him)."
