Majma al-Zawaid — Hadith 7516

وَعَنْ جَابِرٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ ، فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ عَمْرُو بْنُ عُثْمَانَ الرَّقِّيُّ ، وَهُوَ مَتْرُوكٌ ، وَقَدْ وَثَّقَهُ ابْنُ حِبَّانَ .
Sayyiduna Jabir (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "There is no marriage without a guardian. If (the guardians) dispute among themselves, then the ruler is the guardian of one who has no guardian."
Imam al-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains a narrator, Amr bin Uthman al-Raqqi, who is matruk (abandoned), though Ibn Hibban declared him thiqah (trustworthy).
