وَعَنِ ابْنِ عَبَّاسٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " أَيُّمَا امْرَأَةٍ تَزَوَّجَتْ بِغَيْرِ إِذْنِ وَلِيٍّ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ ، فَإِنْ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ أَبُو يَعْقُوبُ غَيْرُ مُسَمَّى ، فَإِنْ كَانَ هُوَ التَّوْأَمَ ، فَقَدْ وَثَّقَهُ ابْنُ حِبَّانَ ، وَضَعَّفَهُ ابْنُ مَعِينٍ ، وَإِنْ كَانَ غَيْرَهُ فَلَمْ أَعْرِفْهُ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ أَبُو يَعْقُوبُ غَيْرُ مُسَمَّى ، فَإِنْ كَانَ هُوَ التَّوْأَمَ ، فَقَدْ وَثَّقَهُ ابْنُ حِبَّانَ ، وَضَعَّفَهُ ابْنُ مَعِينٍ ، وَإِنْ كَانَ غَيْرَهُ فَلَمْ أَعْرِفْهُ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Prophet (peace and blessings be upon him) said: "Any woman who marries without the permission of a guardian, her marriage is void, her marriage is void. If the man has had intercourse with her, then he has made her private part lawful, and for that reason the woman will receive the dowry; and the ruler is the guardian of one who has no guardian."
Imam al-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains a narrator, Abu Ya'qub (who is mentioned by his kunyah and) whose name is not mentioned. If he is "al-Taw'am", then Ibn Hibban declared him thiqah (trustworthy) and Yahya bin Ma'in declared him da'if (weak); and if he is someone else, then I do not know him. The remaining narrators of this report are thiqat (trustworthy).
