وَعَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
قُلْتُ : رَوَاهُ ابْنُ مَاجَهْ خَلَا قَوْلَهُ : " وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ الْحَجَّاجُ بْنُ أَرْطَاةَ ، وَهُوَ مُدَلِّسٌ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
قُلْتُ : رَوَاهُ ابْنُ مَاجَهْ خَلَا قَوْلَهُ : " وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ الْحَجَّاجُ بْنُ أَرْطَاةَ ، وَهُوَ مُدَلِّسٌ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) reports that the Prophet (peace and blessings be upon him) said: "There is no marriage without a guardian, and the ruler is the guardian of one who has no guardian." (Allamah al-Haythami says:) I say:
Imam Ibn Majah recorded this report, but he did not record these words: "The ruler is the guardian of one who has no guardian."
Imam al-Tabarani recorded it; its chain contains a narrator, Hajjaj bin Artah, and he is a mudallis (one who conceals defects in the chain); the remaining narrators of this report are thiqat (trustworthy).
Imam Ibn Majah recorded this report, but he did not record these words: "The ruler is the guardian of one who has no guardian."
