Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: We used to go on military expeditions with the Messenger of Allah (peace and blessings be upon him), and we had no women with us. So we sought permission to castrate ourselves, but he (peace and blessings be upon him) forbade us from that, and granted us permission to marry a woman for a fixed period in exchange for a garment.
(b) In the hadith of Abu Abdullah: He (peace and blessings be upon him) granted us permission to marry a woman for a fixed period in exchange for a garment. Then Abdullah (may Allah be pleased with him) recited this verse: "O you who believe, do not make unlawful the good things which Allah has made lawful for you." [Surah al-Ma'idah: 87]

The Messenger of Allah (peace and blessings be upon him) forbade that, and then granted us permission "to marry a woman for a fixed period in exchange for a fixed thing."
Imam al-Shafi'i (may Allah have mercy on him) said: Ibn Mas'ud (may Allah be pleased with him) mentioned the permission for mut'ah marriage, but he did not specify anything showing whether it was before Khaybar or after it. The hadith of Sayyiduna Ali bin Abi Talib (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) "forbade mut'ah marriage", is the more fitting to be, and Allah knows best, the abrogator of it.

Note: The narration of Abu Bakr bin Abi Shaybah in Muslim indicates that this was before the conquest of Makkah or the conquest of Khaybar. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) died in 32 AH, and when he died he was over 60 years of age. The conquest of Khaybar took place in about 7 AH and the conquest of Makkah in 8 AH, and Sayyiduna Abdullah (may Allah be pleased with him) was then about 40 years old, and youth comes before that. And the Messenger of Allah (peace and blessings be upon him) forbade mut'ah with women at the time of Khaybar.

(b) In al-Bukhari, the narration of Ibn Uyaynah adds that this was at the time of Khaybar, and al-Humaydi narrates from Ibn Uyaynah that this prohibition (at Khaybar) concerns eating the meat of domestic donkeys, not mut'ah marriage.

He said: Another man and I went to a woman of Banu Amir who was like a long-necked young she-camel. We offered ourselves to her. She said: What will you give me? I said: My cloak; and my companion also said his cloak. But my companion's cloak was finer than mine, and I was younger than him. When the woman looked at my companion's cloak she liked it, and when she looked at me I appealed to her. Then she said: You and your cloak are enough for me. I stayed with her for three days. He said: We stayed in Makkah for thirty-five (counting) nights and days, and the Messenger of Allah (peace and blessings be upon him) permitted mut'ah marriage. A man of my people and I went out; I was more handsome than him, and he was close to being ugly. We each had a cloak; my cloak was old, while my cousin's cloak was new. When we reached the upper or lower part of Makkah, we met a young woman. We said: "Would you let one of us enjoy you, that is, make a mut'ah marriage with you?" She said: "What will the two of you spend?" So both of them spread out their cloaks, and she looked at the two men. When she looked at my companion, her gaze turned away. He said: This man's cloak is old, and my cloak is new and fine. She said: "There is nothing wrong with his cloak." She said this two or three times. Then I made mut'ah with her, and I stayed with her until it was made unlawful.

Al-Rabi' bin Sabrah (may Allah have mercy on him) said that his father (may Allah be pleased with him) went out with the Messenger of Allah (peace and blessings be upon him) on the Farewell Hajj, and they camped at a place called Usfan. A man of Banu Mudlij stood up, Suraqah bin Malik or Malik bin Suraqah (may Allah be pleased with him), and said: O Messenger of Allah, give a ruling as though they had been born today. The Messenger of Allah (peace and blessings be upon him) said: "Allah has included Umrah in the Hajj. When you come to Makkah, after circling the House (tawaf) and going between Safa and Marwah you are released from ihram, except whoever has brought his sacrificial animal with him; he is not released." When we were released from ihram, he said: "Make mut'ah with women." And mut'ah, in our view, is marriage. We proposed it to the women, and they demanded a fixed term. We mentioned that to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Do so." He said: My cousin and I went out; we had cloaks, and his cloak was finer than mine, and I was more handsome than him. We came to a woman, and she liked my handsomeness and youth, and his cloak. She said: A cloak is like a cloak. So a term of ten days was fixed between me and her. I spent the night with her. In the morning I went to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) was standing between the Corner and the Station of Ibrahim, saying: "O people, I had permitted you mut'ah marriage with women, but now I make it unlawful until the Day of Resurrection. Iyas bin Salamah bin al-Akwa' (may Allah have mercy on him) narrates from his father (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him), in the year of Awtas, "permitted mut'ah marriage for three days, and then forbade it afterwards".
(b) The year of Awtas and the year of the conquest of Makkah are one and the same; Awtas, although it came after the Conquest, was in the year of the Conquest, shortly after it, so there is no harm in attributing the prohibition to the year of either one. In the narration of Sabrah bin Ma'bad (may Allah be pleased with him) it is that "after a permission of three days, there is then permanent prohibition", so the narrations of Sabrah bin Ma'bad and Salamah bin al-Akwa' (may Allah be pleased with them both) point to one and the same time. If the permission in the narration of Salamah bin al-Akwa' (may Allah be pleased with him) was after the Conquest, in the campaign of Awtas, then the prohibition is reported from him after the permission, and no permission is reported after the campaign of Awtas. In any case, the clear narrations carry more weight than an ambiguous narration.

He was alluding to a certain man. That man called out to him and said: You are crude and harsh. By my life, mut'ah marriage used to be practised in the time of the leader of the pious, meaning the Messenger of Allah (peace and blessings be upon him). Ibn al-Zubayr (may Allah be pleased with them both) said: Then try it on yourself. By Allah, if you do it, I will stone you with your stones.

When the people of knowledge criticised him for it, Ibn Abbas (may Allah be pleased with them both) refused to retract his fatwa, until some poets began reciting these verses about him: O companion, do you have any need among the young women of Ibn Abbas? Do you have any need of a soft, delicate one who will be your lodging until the people return? He said: Then the people of knowledge's disgust at it and their aversion to those women increased further, until these verses were composed.

"O crier, is there for you a fair, delicate woman, so that you may take lodging with her until the people move on?"
(b) Abu Khalid narrates from al-Minhal: I said to the Shaykh when the gathering grew long; and in the second verse he said: Have you permitted a young woman who is a close relative? Ibn Abbas (may Allah be pleased with them both) said: That was never my intention, nor did I give a fatwa for mut'ah. He said: The hadith passed before me: we practised mut'ah with the Prophet (peace and blessings be upon him) and with Abu Bakr (may Allah be pleased with him). But when Sayyiduna Umar (may Allah be pleased with him) became caliph, he addressed the people and said: Certainly this is the Messenger of Allah (peace and blessings be upon him), and this is the Qur'an. Mut'ah was permitted in the time of the Messenger of Allah (peace and blessings be upon him), but I forbid both these mut'ahs and I will punish for them: (1) mut'ah with women; any man I catch, I will stone to death. (2) And the other mut'ah, that is, benefiting (tamattu') in Hajj: separate your Hajj from your Umrah, for that is more complete for your Hajj and more complete for your Umrah.
Note: The Shaykh said: There is no doubt about their permissibility in the time of the Messenger of Allah (peace and blessings be upon him), but the Messenger of Allah (peace and blessings be upon him) forbade mut'ah marriage in the year of the conquest of Makkah after having permitted it, and the Messenger of Allah (peace and blessings be upon him) did not permit it again until his death. Sayyiduna Umar (may Allah be pleased with him) also forbade it in conformity with the Sunnah of the Messenger of Allah (peace and blessings be upon him). But the Messenger of Allah (peace and blessings be upon him) had not forbidden Hajj tamattu', and Sayyiduna Umar (may Allah be pleased with him) forbade Hajj tamattu' because in his view it is better to perform Hajj and Umrah separately, so that both are performed completely and in the best manner; but the prohibition of Hajj tamattu' is one of mere dislike (tanzihi), not of prohibition (tahrimi).
