وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، فِي آخَرِينَ قَالُوا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ سُفْيَانُ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ، عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ قَالَ: سَمِعْتُ عَبْدَ اللهِ بْنَ مَسْعُودٍ رَضِيَ اللهُ عَنْهُ يَقُولُ: كُنَّا نَغْزُو مَعَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَلَيْسَ مَعَنَا نِسَاءٌ فَأَرَدْنَا أَنْ نَخْتَصِيَ " فَنَهَانَا عَنْ ذَلِكَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ ثُمَّ رَخَّصَ لَنَا أَنْ نَنْكِحَ الْمَرْأَةَ إِلَى أَجَلٍ بِالشَّيْءِ، زَادَ أَبُو عَبْدِ اللهِ فِي رِوَايَتِهِ بِإِسْنَادِهِ قَالَ: قَالَ الشَّافِعِيُّ ذَكَرَ ابْنُ مَسْعُودٍ الْإِرْخَاصَ فِي نِكَاحِ الْمُتْعَةِ وَلَمْ يُوَقِّتْ شَيْئًا يَدُلُّ أَهُوَ قَبْلَ خَيْبَرَ أَوْ بَعْدَهَا، وَأَشْبَهَ حَدِيثُ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللهُ عَنْهُ فِي نَهْيِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنِ الْمُتْعَةِ أَنْ يَكُونَ، وَاللهُ أَعْلَمُ، نَاسِخًا لَهُ، قَالَ الشَّيْخُ رَحِمَهُ اللهُ: وَقَدْ رُوِيَ فِي حَدِيثِ ابْنِ مَسْعُودٍ أَنَّهُ قَالَ: كُنَّا وَنَحْنُ شَبَابٌ.
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: We were on a military expedition with the Messenger of Allah (peace and blessings be upon him), and we had no women with us, so we wished to castrate ourselves. The Messenger of Allah (peace and blessings be upon him) forbade that, and then granted us permission "to marry a woman for a fixed period in exchange for a fixed thing."
Imam al-Shafi'i (may Allah have mercy on him) said: Ibn Mas'ud (may Allah be pleased with him) mentioned the permission for mut'ah marriage, but he did not specify anything showing whether it was before Khaybar or after it. The hadith of Sayyiduna Ali bin Abi Talib (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) "forbade mut'ah marriage", is the more fitting to be, and Allah knows best, the abrogator of it.
