The people of knowledge of Quraysh and the people of the military expeditions (maghazi) said that Abu Sufyan bin Harb (may Allah be pleased with him) accepted Islam, and the Messenger of Allah (peace and blessings be upon him) had gained the upper hand over them, and he was in the abode of Islam, while his wife Hind bint Utbah (may Allah be pleased with her) was in Makkah, that is, in the abode of war. Then Abu Sufyan bin Harb (may Allah be pleased with him) came to Makkah and invited her to Islam, but she seized Abu Sufyan's (may Allah be pleased with him) beard and said: "Kill this misguided old man!" Then for several days she did not accept Islam; then she accepted Islam and gave her pledge of allegiance to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) kept Abu Sufyan (may Allah be pleased with him) and Hind bint Utbah (may Allah be pleased with her) in that same marriage. And we were informed that the Messenger of Allah (peace and blessings be upon him) entered Makkah, and a great many people accepted Islam, and Makkah became the abode of Islam. The wives of Ikrimah and Safwan (may Allah be pleased with them both) also accepted Islam, while their husbands fled towards Yemen in a state of disbelief. Then, after a period, both of them accepted Islam. Safwan (may Allah be pleased with him) was present at Hunayn in a state of disbelief; he had entered the abode of Islam after his flight, having left in a state of disbelief, and they remained in that same marriage. The wives of all of them had consummated marriages, and their waiting periods had not ended.

Ibn Shihab (may Allah have mercy on him) said that in the time of the Messenger of Allah (peace and blessings be upon him), women accepted Islam in their own lands without emigrating, while their husbands at that time were non-Muslims. Among them was the daughter of al-Walid bin al-Mughirah, who was married to Safwan bin Umayyah (may Allah be pleased with him). She accepted Islam on the day of the Conquest of Makkah, and Safwan bin Umayyah fled (from Islam). So the Messenger of Allah (peace and blessings be upon him) sent his cousin Wahb bin Umayr (may Allah be pleased with him) with his own cloak as a token of safe conduct, and the Messenger of Allah (peace and blessings be upon him) invited him to Islam and to come to him: if he was pleased with a matter, he would accept it; otherwise he (peace and blessings be upon him) would give him leave to travel freely for two months. When Safwan bin Umayyah (may Allah be pleased with him) came with the cloak of the Messenger of Allah (peace and blessings be upon him) and called out, (the narrator) mentioned the hadith, that is, his travelling about and his return, and that Safwan bin Umayyah (may Allah be pleased with him) went with the Messenger of Allah (peace and blessings be upon him) to Hunayn and Ta'if in a state of disbelief while his wife was a Muslim, and the Messenger of Allah (peace and blessings be upon him) did not separate the husband and wife. Then Safwan (may Allah be pleased with him) accepted Islam, and his wife remained with him in that marriage. Ibn Shihab (may Allah have mercy on him) said: Between the Islam of Safwan (may Allah be pleased with him) and the Islam of his wife there was a gap of about one month.

Ibn Shihab (may Allah have mercy on him) said that Umm Hakim bint al-Harith bin Hisham (may Allah be pleased with her) was married to Ikrimah bin Abi Jahl (may Allah be pleased with him). She accepted Islam on the occasion of the Conquest of Makkah, and her husband fled towards Yemen. So Umm Hakim (may Allah be pleased with her) went to Yemen and invited him to Islam, and he accepted Islam. When he came to the Messenger of Allah (peace and blessings be upon him) in the year of the Conquest, the Messenger of Allah (peace and blessings be upon him) met him joyfully, not even having a cloak on him, until he took his pledge of allegiance. Then he (peace and blessings be upon him) kept the two of them (husband and wife) (may Allah be pleased with them both) in that same marriage.

Ibn Shihab (may Allah have mercy on him) said: It has not reached me of any woman who emigrated to Allah and His Messenger (peace and blessings be upon him) while her husband remained a disbeliever residing in the abode of disbelief, except that her emigration separated her from her husband, unless her husband comes as an emigrant before her waiting period ends, in which case there is no separation. And it has not reached us that a woman was separated from her husband when he came while she was still in her waiting period.

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: For the Prophet (peace and blessings be upon him) and the believers, the polytheists were of two kinds: first, the polytheists who fought the Muslims and whom the Muslims fought; second, the polytheists with whom there was a treaty, who did not fight the Muslims and whom the Muslims did not fight. When a woman from among the polytheists at war emigrated, she could be married after one menstrual period, in her state of purity. If her husband emigrated before she was married, she would be returned to him. In this hadith there is evidence that the abode is not a cause of separation.

Ikrimah narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) returned his daughter Zaynab (may Allah be pleased with her) to Abu al-As (may Allah be pleased with him) after two years on the basis of the first marriage.

Ikrimah narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) returned his daughter Sayyidah Zaynab (may Allah be pleased with her) to Abu al-As on the basis of the first marriage after six years. In the narration of Yunus: on the basis of the first marriage; nothing new (no new marriage contract) was done after six years. This is because, with Sayyidah Zaynab's (may Allah be pleased with her) acceptance of Islam, then her emigration to Madinah, and Abu al-As's refusal of Islam, her marriage did not become dependent on the end of the waiting period, until, after the Truce of Hudaybiyyah, the verse was revealed making Muslim women unlawful for the polytheists: "They are not lawful for them, nor are they lawful for them." [Surah al-Mumtahanah: 10] After this verse was revealed, her marriage became dependent on the end of her waiting period. Only a short time had passed when Abu Basir and others took Abu al-As captive and sent him to Madinah, and Sayyidah Zaynab (may Allah be pleased with her) gave him protection. Then he returned to Makkah, gave back all the deposits he held, and declared his Islam. So between her marriage becoming dependent on the end of the waiting period and his acceptance of Islam there was only a short interval.

Abu al-Hasan al-Daraqutni (may Allah have mercy on him) said: This is not established, and Hajjaj is not used as evidence; the correct one is the hadith of Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both).
It reached me from Abu Isa al-Tirmidhi (may Allah have mercy on him) that he said: I asked al-Bukhari (may Allah have mercy on him) about it, and he said: The hadith of Ibn Abbas is more authentic in this chapter than the hadith of Amr bin Shu'ayb.
Abu Ubayd related from Yahya bin Sa'id al-Qattan that Hajjaj did not hear it from Amr, and that it is from the hadith of Muhammad bin Abdullah al-Arzami from Amr. So this is a route to which no one who understands hadith pays any attention.

Ikrimah narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that in the time of the Messenger of Allah (peace and blessings be upon him) a woman accepted Islam and then married. Her husband came and said: "O Messenger of Allah, I accepted Islam along with her, and she knows of my acceptance of Islam." So the Messenger of Allah (peace and blessings be upon him) took her from the second husband and returned her to the first.
