Book of Marriage
باب: من قال: لا ينفسخ النكاح بينهما بإسلام أحدهما، إذا كانت مدخولا بها حتى تنقضي عدتها قبل إسلام المتخلف منهما
Chapter: One who said: the marriage between them is not annulled by one of them accepting Islam, if it had been consummated, until her waiting period ends before the other accepts Islam

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ أَحْمَدَ الْمَحْبُوبِيُّ بِمَرْوَ، ثنا سَعِيدُ بْنُ مَسْعُودٍ، ثنا عُبَيْدُ اللهِ بْنُ مُوسَى، أنبأ إِسْرَائِيلُ، عَنْ سِمَاكٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُ قَالَ: " أَسْلَمَتِ امْرَأَةٌ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَتَزَوَّجَتْ فَجَاءَ زَوْجُهَا إِلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: إِنِّي قَدْ أَسْلَمْتُ مَعَهَا وَعَلِمَتْ بِإِسْلَامِي مَعَهَا، فَنَزَعَهَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مِنْ زَوْجِهَا الْآخَرِ وَرَدَّهَا إِلَى زَوْجِهَا الْأَوَّلِ ".
Ikrimah narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that in the time of the Messenger of Allah (peace and blessings be upon him) a woman accepted Islam and then married. Her husband came and said: "O Messenger of Allah, I accepted Islam along with her, and she knows of my acceptance of Islam." So the Messenger of Allah (peace and blessings be upon him) took her from the second husband and returned her to the first.
