باب: من قال: لا ينفسخ النكاح بينهما بإسلام أحدهما، إذا كانت مدخولا بها حتى تنقضي عدتها قبل إسلام المتخلف منهما

وَبِهَذَا الْإِسْنَادِ عَنِ ابْنِ شِهَابٍ، أَنَّ أُمَّ حَكِيمٍ بِنْتَ الْحَارِثِ بْنِ هِشَامٍ وَكَانَتْ تَحْتَ عِكْرِمَةَ بْنِ أَبِي جَهْلٍ أَسْلَمَتْ يَوْمَ الْفَتْحِ بِمَكَّةَ، وَهَرَبَ زَوْجُهَا عِكْرِمَةُ بْنُ أَبِي جَهْلٍ مِنَ الْإِسْلَامِ حَتَّى قَدِمَ الْيَمَنَ، فَارْتَحَلَتْ أُمُّ حَكِيمٍ حَتَّى قَدِمَتْ عَلَيْهِ بِالْيَمَنِ وَدَعَتْهُ إِلَى الْإِسْلَامِ، فَأَسْلَمَ وَقَدِمَ عَلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَامَ الْفَتْحِ، فَلَمَّا رَآهُ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَثَبَ عَلَيْهِ فَرَحًا، وَمَا عَلَيْهِ رِدَاءٌ حَتَّى بَايَعَهُ فَثَبَتَا عَلَى نِكَاحِهِمَا ".
Ibn Shihab (may Allah have mercy on him) said that Umm Hakim bint al-Harith bin Hisham (may Allah be pleased with her) was married to Ikrimah bin Abi Jahl (may Allah be pleased with him). She accepted Islam on the occasion of the Conquest of Makkah, and her husband fled towards Yemen. So Umm Hakim (may Allah be pleased with her) went to Yemen and invited him to Islam, and he accepted Islam. When he came to the Messenger of Allah (peace and blessings be upon him) in the year of the Conquest, the Messenger of Allah (peace and blessings be upon him) met him joyfully, not even having a cloak on him, until he took his pledge of allegiance. Then he (peace and blessings be upon him) kept the two of them (husband and wife) (may Allah be pleased with them both) in that same marriage.
