Sayyiduna Shurahbil bin Aws (may Allah be pleased with him), who was one of the Companions, narrates: The Prophet (peace and blessings be upon him) said: "Whoever drinks wine, flog him; if he does it again, flog him again; if he does it yet again, kill him."

Yazid bin Abi Kabshah narrates that he heard one of the Companions narrating this hadith to Abd al-Malik bin Marwan concerning drinking wine: The Prophet (peace and blessings be upon him) said about wine: "If a man drinks it, flog him; then if he does it again, flog him; if he does it yet again, flog him; then if he does it a fourth time, kill him."
Ahmad recorded it; Ibn Hibban declared Yazid bin Abi Kabshah thiqah (trustworthy), and the rest of its narrators are the narrators of the Sahih.

The narrator says: Sayyiduna Abdullah (may Allah be pleased with him) used to say: "Bring me a man who has drunk wine three times, and you have my word that I will have his neck struck."

Sayyidah Umm Habibah bint Abi Sufyan (may Allah be pleased with her) narrates: Some people from Yemen came to the Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) taught them the prayer, the Sunnahs and the obligations. Then they said: "O Messenger of Allah! We have a drink that we make from wheat and barley." The Prophet (peace and blessings be upon him) asked: "Ghubayra'?" They said: "Yes." The Prophet (peace and blessings be upon him) said: "Do not consume it." Then, when they intended to leave, they asked the Prophet (peace and blessings be upon him) about it, and the Prophet (peace and blessings be upon him) said: "Ghubayra'?" They said: "Yes!" The Prophet (peace and blessings be upon him) said: "Do not consume it." They said: "The people will not give it up." The Prophet (peace and blessings be upon him) said: "Whoever does not give it up, strike his neck."
Ahmad, Abu Ya'la and al-Tabarani recorded it; its chain contains Ibn Lahi'ah, whose hadith is hasan (good) though there is weakness in him, and the rest of Ahmad's narrators are thiqat (trustworthy).

Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) reports this saying of the Prophet (peace and blessings be upon him): "Whoever drinks wine, flog him; if he drinks again, flog him; if he drinks again, flog him; if he drinks a fourth time, kill him." The narrator says: Then a man named al-Nu'ayman was brought, who had drunk wine for the fourth time, and the Prophet (peace and blessings be upon him) had him flogged and did not kill him; so this ruling abrogates the ruling of killing. (Al-Haythami says:) I say:
Al-Tirmidhi recorded it, but he did not record the words "so this abrogates the ruling of killing", nor did he mention the name of al-Nu'ayman.
Al-Bazzar recorded it.

Sayyiduna Azhar (may Allah be pleased with him), the father of Abd al-Rahman, narrates: A drunkard was brought to the Prophet (peace and blessings be upon him) while he was at Khaybar. The Prophet (peace and blessings be upon him) threw dust in his face, then he ordered his Companions, and they beat him with their sandals and with whatever was in their hands, until the Prophet (peace and blessings be upon him) said to them: "Hold back now." They raised their hands. The Prophet (peace and blessings be upon him) passed away, and this remained the practice until then. Then Sayyiduna Abu Bakr (may Allah be pleased with him) gave forty lashes for drinking wine; then Sayyiduna Umar (may Allah be pleased with him) gave forty lashes in the early period of his caliphate; then he gave eighty lashes in the later period of his caliphate; then Sayyiduna Uthman (may Allah be pleased with him) gave forty lashes; then Sayyiduna Mu'awiyah (may Allah be pleased with him) gave eighty lashes.
Al-Tabarani recorded it as a narration of Abu al-Tahir bin al-Sarh, who said: "I found in the writing of my maternal uncle that this is reported from the narrator Uqayl." His maternal uncle is Abd al-Rahman bin Abd al-Hamid bin Salim, and he is thiqah (trustworthy); the rest of its narrators are the narrators of the Sahih.
