Imam al-Shafi'i (may Allah have mercy on him) said: "Because the Messenger of Allah (peace and blessings be upon him) permitted some people in Makkah to remain there after they accepted Islam, among them Sayyiduna al-Abbas bin Abd al-Muttalib (may Allah be pleased with him) and others, since they did not fear trial (regarding their religion)."

Urwah bin al-Zubayr (may Allah have mercy on him) says that Sayyiduna al-Abbas (may Allah be pleased with him) accepted Islam, continued in his office of giving water to the pilgrims in Makkah, and did not emigrate.

Muhammad bin Ishaq (may Allah have mercy on him) says that Abu al-As (may Allah be pleased with him), after accepting Islam, returned to Makkah and did not take part in any battle with the Prophet (peace and blessings be upon him). After that he came to Madinah and died in Dhu al-Hijjah of the year 12 AH during the caliphate of Abu Bakr (may Allah be pleased with him), and he made al-Zubayr bin al-Awwam (may Allah be pleased with him) the executor of his will. Imam al-Shafi'i (may Allah have mercy on him) says that he used to order his armies to say to those who accepted Islam: "If you emigrate, you will receive what the Muhajirun receive, and if you do not emigrate, you will be like the Bedouin Muslims." And he gave them a choice only in what was lawful for them.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب السير / 17763
Sulayman bin Buraydah (may Allah have mercy on him) narrates from his father (Sayyiduna Buraydah, may Allah be pleased with him) that whenever the Prophet (peace and blessings be upon him) sent someone as commander over an army, he would specially command him to adopt taqwa (fear of Allah), and to treat well the Muslims who were with him, and he would also command him: "When you meet your polytheist enemies, first invite them to three things. If they accept any one of the three, accept that from them and do not fight them. First of all invite them to accept Islam. If they accept, then you too accept their Islam from them and do not fight them. Then command them to change that place, and command them to emigrate to the abode of Islam, and also tell them that if they do this, their rights and duties will be the same as those of the other Muhajirun. And if they refuse to emigrate and prefer their homeland and town, then tell them that in that case their rights and duties will be like those of the Bedouin Muslims, and they will have no share in the fay' or the spoils of war, unless they wage jihad along with the Muslims."
Hadith Referenceالسنن الكبرى للبيهقي / كتاب السير / 17764
Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) says that a Bedouin came to the Prophet (peace and blessings be upon him) and asked about emigration. He (peace and blessings be upon him) said: "The matter of emigration is very hard. Do you have camels?" He said: Yes! He (peace and blessings be upon him) said: "Do you lend any of them (for their milk)?" He said: Yes! He (peace and blessings be upon him) said: "Do you milk them on the day they come to water and distribute (the milk)?" He said: Yes! He (peace and blessings be upon him) said: "Then do good deeds from beyond the seas (wherever you are), for Allah Almighty will not diminish anything of your deeds."
Hadith Referenceالسنن الكبرى للبيهقي / كتاب السير / 17765
Sayyiduna Abu Hurayrah (may Allah be pleased with him) says that the Messenger of Allah (peace and blessings be upon him) said: "Whoever believes in Allah and His Messenger, establishes the prayer and fasts in Ramadan, Allah will surely admit him into Paradise, whether he emigrates or stays in the very land where he was born." The Companions (may Allah be pleased with them) said: O Messenger of Allah! Shall we not inform the people of this? He (peace and blessings be upon him) said: "Indeed, in Paradise there are one hundred levels which Allah Almighty has prepared for the mujahidin who strive in His way, and the distance between every two levels is like that between the heaven and the earth. So when you ask Allah, ask Him for Paradise al-Firdaws, for it is the middle and the highest Paradise, above it is the Throne of Allah Almighty, and from it the rivers of Paradise gush forth."
Hadith Referenceالسنن الكبرى للبيهقي / كتاب السير / 17766
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) says that the Messenger of Allah (peace and blessings be upon him) said on the day of the conquest of Makkah: "(After today) there is no emigration, but jihad and intention remain; and when you are called out (for jihad), then go forth."
The meaning of his (peace and blessings be upon him) statement 'la hijrah' (there is no emigration) is (and Allah knows best) that emigration is not obligatory upon anyone of the people of Makkah who accepted Islam after the conquest of Makkah, because it has become the abode of Islam and the abode of safety, and no one in this city fears being put to trial regarding his religion; and likewise other places besides Makkah when, after being conquered, they become havens of peace and security (emigration from there is not obligatory either).
Hadith Referenceالسنن الكبرى للبيهقي / كتاب السير / 17767
Sayyiduna Mujashi' bin Mas'ud al-Sulami (may Allah be pleased with him) says: I brought my brother Sayyiduna Abu Ma'bad (may Allah be pleased with him) to the Messenger of Allah (peace and blessings be upon him) after the conquest of Makkah and said: "O Messenger of Allah! Take his pledge of allegiance on emigration." He (peace and blessings be upon him) said: "Those who had to emigrate have done so (and now there is no emigration)." I said: "O Messenger of Allah! Then on what will you take his pledge?" He (peace and blessings be upon him) said: "On Islam, jihad and goodness." Then he (peace and blessings be upon him) took his pledge. Abu Uthman (may Allah have mercy on him) says: I met Sayyiduna Abu Ma'bad (may Allah be pleased with him) and told him what Sayyiduna Mujashi' (may Allah be pleased with him) had said, and he said: Mujashi' spoke the truth.

Sayyiduna Ya'la bin Umayyah (may Allah be pleased with him) says: I brought my father to the Messenger of Allah (peace and blessings be upon him) on the second day of the conquest of Makkah and said to him (peace and blessings be upon him): O Messenger of Allah! Take my father's pledge of allegiance on emigration. He (peace and blessings be upon him) said: "No, rather I will take his pledge on jihad, for emigration came to an end on the day of the conquest of Makkah."

Sayyiduna Ya'la (may Allah be pleased with him) says: On the day of the conquest of Makkah I spoke to the Messenger of Allah (peace and blessings be upon him) about Umayyah, and said to him (peace and blessings be upon him): O Messenger of Allah! Take my father's pledge of allegiance on emigration. He (peace and blessings be upon him) said: "Emigration has come to an end, but I will take his pledge on jihad."

Sayyiduna Ibn Abbas (may Allah be pleased with them both) says that it was said to Sayyiduna Safwan bin Umayyah (may Allah be pleased with him), while he was in the upper part of Makkah, that whoever does not emigrate has no religion. He said: I will not enter my house until I go to Madinah. He says: So he came to Madinah and stayed with Sayyiduna al-Abbas bin Abd al-Muttalib (may Allah be pleased with him). Then he came to the Messenger of Allah (peace and blessings be upon him), who said: "O Abu Wahb! What has brought you?" He said: I have heard that whoever has not emigrated has no religion. So the Prophet (peace and blessings be upon him) said: "O Abu Wahb! Go back to the valleys (Batha) of Makkah and settle down in your homes, for emigration has come to an end, but jihad and intention remain; and when you are called out (for jihad and the like), do not delay." (Apart from the story.)

Sayyiduna Jubayr bin Mut'im (may Allah be pleased with him) says: I said: O Messenger of Allah! Some people say that we have no reward while living in Makkah. He (peace and blessings be upon him) said: "You will surely receive your reward, even if you were in a fox's hole."

Sayyiduna Fudayk (may Allah be pleased with him) came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah! Some people claim that whoever did not emigrate is ruined. So the Messenger of Allah (peace and blessings be upon him) said: "O Fudayk! Establish the prayer, pay the zakah and abandon evil, then live in the land of your people wherever you wish." The narrator says: I think that he (peace and blessings be upon him) said: "When you become one who does these things, you will be an emigrant."
Hadith Referenceالسنن الكبرى للبيهقي / كتاب السير / 17773
Sayyiduna Abu Hurayrah (may Allah be pleased with him) says that some people from the desert came to the Messenger of Allah (peace and blessings be upon him) and said: O Messenger of Allah! Some of our relatives came to us and claimed that no deed is of benefit without emigration and jihad. He (peace and blessings be upon him) said: "Wherever you are, worship Allah in an excellent manner, and receive the glad tidings of Paradise for it."

Ata (may Allah have mercy on him) says: I came with Ubayd bin Umayr to Sayyidah Aishah (may Allah be pleased with her) while she was in i'tikaf - or, another translation of 'mujawarah' is that she was living in the neighbourhood (of the Ka'bah). Ubayd said to her: O 'Hantah' (i.e., O lady)! I ask you about emigration. Sayyidah Aishah (may Allah be pleased with her) said: "There is no emigration after the conquest of Makkah." Emigration was only before the conquest of Makkah, when a man would emigrate for the sake of his religion to the Prophet (peace and blessings be upon him). Now that the conquest has taken place, a man can worship Allah wherever he wishes, and he will not be prevented from worship.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب السير / 17776
Ata (may Allah have mercy on him) says: I met Sayyidah Aishah (may Allah be pleased with her) together with Ubayd bin Umayr, and he asked her about emigration. She said: There is no emigration today; emigration used to be to Allah and His Messenger. When the believers were put to trial regarding their religion, they would come to the Noble Messenger (peace and blessings be upon him) to save their religion. Now Allah Almighty has spread Islam so widely that a man can worship his Lord wherever he wishes. Now "jihad and intention remain".
All these hadiths refer to the ending of the obligation of emigration for the people of Makkah, or for other towns besides it which have become the abode of Islam or the abode of safety. But if a man is in the abode of war and it is difficult for him to practise Islam there, then emigration remains for him: he should emigrate from there to the abode of Islam and save his religion.

Abu Hind narrates from Sayyiduna Mu'awiyah (may Allah be pleased with him), who said: I heard the Messenger of Allah (peace and blessings be upon him) saying: "As long as the door of repentance is not closed, the door of emigration will not be closed either; and the door of repentance will be closed when the sun rises from the west."

Sayyiduna Abdullah bin al-Sa'di (may Allah be pleased with him), who belonged to the tribe of Malik bin Hisl, says: I came to the Noble Messenger (peace and blessings be upon him) with a few of my companions. When they dismounted from their riding animals, they said: You guard the mounts; when we have fulfilled our need, you go to the Noble Messenger (peace and blessings be upon him) and fulfil your need. And I was the youngest. When they came back having fulfilled their need, they said to me: Now you go. He says: When I went to the Noble Messenger (peace and blessings be upon him), he (peace and blessings be upon him) said: "What is your need?" I said: My need and request is that you tell me about emigration: has emigration come to an end? He (peace and blessings be upon him) said: "Your need is among the best of their needs. Emigration will not come to an end as long as the enemy is being fought."
