Nafi' bin Ujayr bin Abd Yazid said that Rukanah bin Abd Yazid (may Allah be pleased with him) gave his wife Suhaymah al-Muzaniyyah the battah divorce (a final, irrevocable divorce). Then he came to the Messenger of Allah (peace and blessings be upon him) and said: "I have given my wife Suhaymah the battah divorce, but I intended only one divorce." The Messenger of Allah (peace and blessings be upon him) said to Rukanah (may Allah be pleased with him): "By Allah, did you intend only one?" Rukanah (may Allah be pleased with him) said: "By Allah, I intended only one." So the Messenger of Allah (peace and blessings be upon him) returned his wife to him. Then Rukanah (may Allah be pleased with him) gave the second divorce in the time of Sayyiduna Umar (may Allah be pleased with him) and the third in the time of Sayyiduna Uthman (may Allah be pleased with him).

Sayyiduna Rukanah bin Abd Yazid (may Allah be pleased with him) said: I had a wife called Suhaymah, and I gave her the battah divorce (a final, irrevocable divorce). Then I came to the Messenger of Allah (peace and blessings be upon him) and said: "O Messenger of Allah (peace and blessings be upon him), I have given my wife Suhaymah the battah divorce, and by Allah, I intended only one." He (peace and blessings be upon him) asked: "By Allah, did you intend only one?" I said: "Yes, by Allah, I intended only one." So he (peace and blessings be upon him) returned my wife to me on the basis of one divorce.

Then he came and told the Prophet (peace and blessings be upon him) that he had intended only one divorce. He (peace and blessings be upon him) asked: "By Allah, did you intend only one?" He said: Yes, by Allah. He (peace and blessings be upon him) said: "It is as you intended."

Al-Awza'i said: I asked al-Zuhri: Which wife of the Prophet (peace and blessings be upon him) sought refuge from him (peace and blessings be upon him)? He said: Urwah told me from Aishah (may Allah be pleased with her) that when the daughter of al-Jawn was brought in to the Messenger of Allah (peace and blessings be upon him) and he (peace and blessings be upon him) came near her, she said: "I seek refuge with Allah from you." The Messenger of Allah (peace and blessings be upon him) said: "You have sought refuge with the Great One; go back to your family."

Ibn Abi Dhi'b (may Allah have mercy on him) narrates from al-Zuhri (may Allah have mercy on him) that he (peace and blessings be upon him) said: "Go back to your family," as if he (peace and blessings be upon him) gave her a divorce.

Sayyiduna Ka'b bin Malik (may Allah be pleased with him) relates his story of when he stayed behind from the Prophet (peace and blessings be upon him) in the Battle of Tabuk. It is a long hadith, in which the messenger of the Messenger of Allah (peace and blessings be upon him) came and said: "The Messenger of Allah (peace and blessings be upon him) has commanded that you keep away from your wife." I said: Shall I divorce her, or what shall I do? He said: "You are to stay apart from her and not go near her." And he (peace and blessings be upon him) also sent someone to my two companions; so I said to my wife: "Go to your family and stay with them until Allah decides this matter."
'Ilhaqi bi-ahliki' (Go to your family) are words that are an indirect expression for divorce: if divorce is meant by them, divorce takes place, and if divorce is not intended, divorce does not take place.

Abu Hurayrah (may Allah be pleased with him) said that the Messenger of Allah (peace and blessings be upon him) said to Sawdah bint Zam'ah (may Allah be pleased with her): "Observe your waiting period." Muhammad bin Abbad bin Ja'far said that al-Muttalib bin Hantab told him that he gave his wife the battah divorce (a final, irrevocable divorce), then came to Umar bin al-Khattab (may Allah be pleased with him) and mentioned it. He asked: What led you to that? He said: I have done it. Then he recited this verse: "And if they had done what they were instructed, it would have been better for them and a firmer establishment" [Surah al-Nisa': 66]. What led you to that? He said: I have done it. He said: Keep your wife, for a single divorce separates her.

Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) said that when he says these words: 'khaliyyah' (free), 'bariyyah' (quit), 'al-battah' (definitive) and 'al-ba'inah' (separated), it is one divorce, and he has more right to her.

Imam Malik (may Allah have mercy on him) said that a letter was written to Umar bin al-Khattab (may Allah be pleased with him) from Iraq stating that a man had said to his wife: 'Habluki ala gharibiki' (your rope is on your withers). Umar (may Allah be pleased with him) wrote to his governor to order him to meet him during the Hajj season. He met Umar (may Allah be pleased with him) while he was performing tawaf and greeted him. Umar (may Allah be pleased with him) asked: Who are you? He said: I am the one whom you ordered to appear. Umar (may Allah be pleased with him) said: I adjure you by the Lord of this building, what did you intend by your saying 'Habluki ala gharibiki'? Did you intend divorce? The man said: Had you put me under oath anywhere other than this place, I would not have told you the truth; I intended separation. Umar (may Allah be pleased with him) said: It is as you intended.

Abu al-Hallal al-Ataki (may Allah have mercy on him) said: A man came to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) who had said to his wife: 'Habluki ala gharibiki' (your rope is on your withers). Sayyiduna Umar (may Allah be pleased with him) said: "Meet us during the Hajj season." So the man related his story at the House of Allah, and he said: "Do you see that bald man who is performing tawaf around the House of Allah? Go to him and ask him, then come back and tell me." When the man went to him, it was Sayyiduna Ali (may Allah be pleased with him). Sayyiduna Ali (may Allah be pleased with him) asked: "Who sent you to me?" The man said: "The Commander of the Believers; (the matter is) that he said to his wife: 'Habluki ala gharibiki'." Sayyiduna Ali (may Allah be pleased with him) said: "Face the House of Allah and swear by Allah that you did not intend divorce." The man said: "By Allah, I did intend divorce." Sayyiduna Ali (may Allah be pleased with him) said: "Your wife has become separated from you."

Ata bin Abi Rabah (may Allah have mercy on him) said: A man said to his wife: 'Habluki ala gharibiki' (your rope is on your withers). He said these words repeatedly, then came to Sayyiduna Umar (may Allah be pleased with him). He asked him to take an oath between the Corner (al-Rukn) and the Station of Ibrahim: What did you intend by this saying? He said: I intended divorce. So Sayyiduna Umar (may Allah be pleased with him) separated the two of them.
The Shaykh said: He asked him for the oath only for confirmation, so that he would acknowledge that he had intended divorce each time; then he separated the two of them.

Ata (may Allah have mercy on him) said: A man who had said to his wife 'Habluki ala gharibiki' (your rope is on your withers) was brought to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him). He said to Sayyiduna Ali (may Allah be pleased with him): Judge between them. So Sayyiduna Ali (may Allah be pleased with him) ruled it as three divorces.
The Shaykh said: This does not contradict the narration of Malik; it is as though Sayyiduna Umar (may Allah be pleased with him) counted it as one, as he did with al-battah, while Sayyiduna Ali (may Allah be pleased with him) counted it as three. It is also possible that they all considered it three, for a wife with whom the marriage had been consummated.

Abu Husayn narrates from Nu'aym bin Dajajah that a man gave his wife two divorces, then said to her: You are forbidden to me. He went to Sayyiduna Umar (may Allah be pleased with him) and mentioned it, and Sayyiduna Umar (may Allah be pleased with him) said to the man: Do you think these are insignificant in my sight? Then he separated the woman from the man.
The Shaykh said: So the man's intention was separation.
(b) It has been narrated from Shurayh and Ata bin Abi Rabah (may Allah have mercy on them) regarding al-battah that the husband is taken at his word (as to his intention) in it; and from Ata (may Allah have mercy on him) regarding the husband's saying 'khaliyyah wa khalawti minni, wa bariyyah wa bari'ti minni, wa ba'inah wa binti minni' (You are free and have become free of me, you are quit and have become quit of me, you are separated and have become separated from me) that he is taken at his word in them; and likewise from Amr bin Dinar.

The same has been narrated from Masruq (may Allah have mercy on him), Ibrahim (may Allah have mercy on him) and others, and what they meant by this is when he utters words resembling divorce.
