أخبرنا محمد بن أحمد بن تَمِيم القَنْطري بها، حدَّثنا أبو قِلابة، حدَّثنا أبو عاصم، حدَّثنا ابن جُرَيج، أخبرني محمد بن علي بن رُكانة، أخبرني عِكْرمة، عن ابن عباس: أنَّ رسول الله ﷺ لم يَقِتْ في الخمرِ حدًّا. قال ابن عباس: شَرِبَ رجلٌ فَسَكِرَ، فلُقِي يَمِيلُ في الفجِّ، فانطلقنا به إلى النبيِّ ﷺ، فلمَّا حاذَى بدار العبّاس انفلَتَ فدخلَ على العباس فالتَزَمَه، فذُكِرَ ذلك للنبيِّ ﷺ فضَحِكَ، وقال: "أفعَلَها؟ " ولم يأمُرْ فيه بشيءٍ (1).
هذا حديث صحيح الإسناد، ولم يخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) had not fixed any (set) prescribed punishment for drinking wine. Ibn Abbas (may Allah be pleased with them both) said: A man drank wine and became intoxicated, and he was found staggering in the road, so we set off taking him to the Prophet (peace and blessings be upon him). When he came level with the house of Sayyiduna al-Abbas (may Allah be pleased with him), he broke free (from our hands), ran off and clung to Sayyiduna al-Abbas (may Allah be pleased with him). This was mentioned to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) smiled and said: "Did he do that?" And he (peace and blessings be upon him) gave no order (of punishment) concerning him.
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

أخبرنا أبو عبد الله محمد بن يعقوب الشَّيباني، حدَّثنا يحيى بن محمد بن يحيى الذُّهْلي، حدَّثنا مُسدَّد، حدَّثنا عبد الوهاب، حدَّثنا أيوب، عن عبد الله بن أبي مُلَيكة، عن عُقْبة بن الحارث قال: جِيءَ بالنُّعَيمان - أو بابن النُّعْيمان - شاربًا، فأَمَرَ رسولُ الله ﷺ مَن كان في البيت أن يَضرِبَه، قال: وكنتُ أنا فيمن ضربَه، فضَرَبناه بالنِّعال والجَريد (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه. وقد تابع عبدُ الوارث بن سعيد عبدَ الوهاب الثقفي على وَصْله بذكر عُقبة بن الحارث:

It is narrated from Sayyiduna Uqbah bin al-Harith (may Allah be pleased with him) that al-Nu'ayman (or his son) was brought having drunk wine, so the Messenger of Allah (peace and blessings be upon him) ordered those who were in the house to beat him. The narrator said: I was among those who beat him; we beat him with sandals and palm branches.
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

حدَّثَناه أبو سعيد أحمد بن يعقوب الثَّقفي، حدَّثنا يوسف بن يعقوب القاضي، حدَّثنا محمد بن أبي بكر، حدَّثنا عبد الوارث، حدَّثنا أيوب، عن ابن أبي مُلَيكة، قال: أخبرني عُقبة بن الحارث قال: جِيء بالنُّعيمان، فأمرَ رسول الله ﷺ مَن في البيت، فَضَرَبُوه بالأيدي والنِّعال، وكنت فيمن ضَرَبَه (2).

It is narrated from Sayyiduna Uqbah bin al-Harith (may Allah be pleased with him) that al-Nu'ayman was brought, and the Messenger of Allah (peace and blessings be upon him) gave an order to those who were in the house, so they beat him with their hands and sandals, and I was among those who beat him.

أخبرنا أبو أحمد بكر بن محمد بن حَمْدان الصَّيرَفي بمَرْو، حدَّثنا عبد الصمد بن الفضل البَلْخي، حدَّثنا مَكِّيُّ بن إبراهيم، حدَّثنا الجُعَيد (1) بن عبد الرحمن، عن يزيد بن خُصَيفة، عن السائب بن يزيد قال: كان يُؤتَى بالشارب في عهد رسولِ الله ﷺ وفي إمرة أبي بكر وصَدْرًا من إمرة عمر، فنقوم إليه فنضربُه بأيدينا ونعالِنا وأرديَتِنا حتى كان صَدْرًا من إمارة عمر، فجَلَدَ فيها أربعينَ، حتى إذا عاثُوا فيها وفَسَقُوا جَلَدَ فيها ثمانينَ (2).
هذا حديث صحيح على شرط الشيخين.

It is narrated from Sayyiduna al-Sa'ib bin Yazid (may Allah be pleased with him) that in the time of the Messenger of Allah (peace and blessings be upon him), during the caliphate of Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) and in the early part of the caliphate of Sayyiduna Umar al-Faruq (may Allah be pleased with him), when a drinker of wine was brought, we would get up and beat him with our hands, our sandals and our cloaks, until, in the early part of the era of Sayyiduna Umar (may Allah be pleased with him), he fixed forty lashes for it; then, when people went to excess in it and wickedness increased, he fixed eighty lashes for it.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim).

أخبرني عبد الله بن الحسين القاضي بمَرْو، حدَّثنا الحارث بن أبي أسامة، حدَّثنا يزيد بن هارون، أخبرنا محمد بن عمرو، عن أبي سَلَمة ويحيى بن عبد الرحمن بن حاطب، عن عبد الرحمن بن أزهَرَ قال: أُتي النبيُّ ﷺ بشاربٍ فقال: "قوموا إليه فاضربُوه"، فقاموا إليه فخَفَقُوه بنعالِهم (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abd al-Rahman bin Azhar (may Allah be pleased with him) that a drinker of wine was brought to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "All of you, get up and beat him." So the people went to him and beat him with their sandals.
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

حدَّثنا أبو العباس محمد بن يعقوب، حدَّثنا إبراهيم بن مرزوق، حدَّثنا وهب بن جَرير، حدَّثنا شُعْبة، عن أبي التَّيّاح، عن أبي الوَدَّاك، عن أبي سعيد الخُدْري قال: لا أشربُ نبيذَ الجرِّ بعد إذ أتي النبيُّ ﷺ بنَشْوانَ، فقال: يا رسولَ الله، ما شربتُ خمرًا، لكني شربتُ نبيذَ زبيبٍ وتمرٍ في دُبَّاء، فأُمر به فبُهِزَ بالأيدي، وخُفِقَ بالنِّعال، ونَهَى عن الزَّبيب والتمر وعن الدُّبَّاء (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him); he said: I have not drunk the nabidh of earthenware jars since a man in a stupor was brought to the Prophet (peace and blessings be upon him). He said: O Messenger of Allah, I did not drink wine; rather, I drank nabidh of raisins and dates in a gourd vessel. So at his (peace and blessings be upon him) order he was prodded with hands and beaten with sandals, and he (peace and blessings be upon him) forbade soaking raisins and dates together and using the gourd vessel (dubba').
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

حدَّثنا أبو العباس محمد بن يعقوب، حدَّثنا بكَّار بن قُتَيبة القاضي، حدَّثنا صفوان بن عيسى القاضي، أخبرنا أسامة بن زيد، عن الزُّهْري، قال: حدثني عبد الرحمن بن أزهَرَ قال: رأيتُ رسول الله ﷺ يومَ حُنين وهو يتخلَّلُ الناس، يسألُ عن منزل خالدِ بن الوليد، فأُتِيَ بسكرانَ، فأَمر رسولُ الله ﷺ مَن كان عندَه أَن يَضربوه بما كان في أيديهم. قال: وحَثَا رسولُ الله ﷺ الترابَ في وجهه. قال: ثم أُتِيَ أبو بكر بسكرانَ، قال: فتوخَّى الذين كان مِن ضربهم يومَئِذٍ، فَضَرَبَ أربعينَ، وضَرَبَ عمرُ أربعين (1).
It is narrated from Sayyiduna Abd al-Rahman bin Azhar (may Allah be pleased with him); he said: I saw the Messenger of Allah (peace and blessings be upon him) on the day of the Battle of Hunayn passing among the people, asking about the camp of Sayyiduna Khalid bin al-Walid (may Allah be pleased with him). Meanwhile a drunkard was brought, so the Messenger of Allah (peace and blessings be upon him) ordered those who were with him to beat him with whatever they had in their hands. The narrator said: And the Messenger of Allah (peace and blessings be upon him) also threw dust in his face. Then a drunkard was brought to Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him), and, keeping in view the beating of that day, he gave him forty lashes, and Sayyiduna Umar (may Allah be pleased with him) also gave forty lashes.

Hadith Takhrij «حديث حسن، وهذا إسناد منقطع، فالزهري لم يسمع هذا الحديث من عبد الرحمن بن الأزهر، بينهما عبدُ الله بن عبد الرحمن بن الأزهر، وقد روى عنه غير واحد، وذكره ابن حبان في "الثقات"، فمثلُه حسن الحديث إن شاء الله، فهو تابعي ويروي الخبر عن أبيه أيضًا» [ترقيم الرساله 8329] [ترقيم الشركة 8230]
قال الزُّهْري هذا: فحدَّثني حُمَيد بن عبد الرحمن عن وَبَرة الكَلْبي قال: أرسَلَني خالدُ بن الوليد إلى عمر، فأتيتُه وهو في المسجد معه عثمانُ بن عفان وعليٌّ وعبدُ الرحمن بن عوف وطلحةُ والزُّبيرُ متَّكئون معه في المسجد، فقلت: إنَّ خالد بن الوليد أرسَلَني إليك، وهو يقرأ عليك السلامَ، ويقول: إنَّ الناس قد انهمَكُوا (1) في الخمر، وتَحاقَرُوا العقوبة. فقال عمر: هم هؤلاء عندك فسَلْهم، فقال عليٌّ: نَراه إذا سَكِرَ هَذَى، وإذا هَذَى افترى، وعلى المفتري ثمانونَ. فقال عمرُ: أبلِغْ صاحبَك ما قال. فجَلَدَ خالدٌ ثمانينَ، وجَلَدَ عمرُ ثمانينَ، فكان عمرُ إذا أُتِيَ بالرجل القوي المُنهمِك في الشُّرْب جَلَدَه ثمانينَ، وإذا أُتِي بالرجل الضعيف الذي كانت منه الزَّلّة جَلَدَه أربعين، ثم جَلَدَ عثمانُ ثمانين وأربعينَ (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Wabarah al-Kalbi; he said: Sayyiduna Khalid bin al-Walid (may Allah be pleased with him) sent me to Sayyiduna Umar al-Faruq (may Allah be pleased with him). I came to him while he was in the mosque, and with him were Sayyiduna Uthman bin Affan, Sayyiduna Ali, Sayyiduna Abd al-Rahman bin Awf, Sayyiduna Talhah and Sayyiduna al-Zubayr (may Allah be pleased with them), reclining in the mosque. I said: Khalid bin al-Walid has sent me to you; he conveys his greetings of peace to you and says that the people have become heavily given to drinking wine and have come to regard the punishment as trivial. Sayyiduna Umar (may Allah be pleased with him) said: These people are here before you; consult them. So Sayyiduna Ali (may Allah be pleased with him) said: Our view is that "when he becomes intoxicated he raves, and when he raves he fabricates slander, and the punishment of the slanderer is eighty lashes." Sayyiduna Umar (may Allah be pleased with him) said: Convey to your companion (Khalid) what he has said. So Sayyiduna Khalid (may Allah be pleased with him) gave eighty lashes, and Sayyiduna Umar (may Allah be pleased with him) also gave eighty lashes. Thereafter it was the practice of Sayyiduna Umar (may Allah be pleased with him) that when a strong man addicted to drink was brought, he would give him eighty lashes, and when a weak man was brought who had made a slip, he would give him forty lashes. Then Sayyiduna Uthman (may Allah be pleased with him) also gave eighty and forty lashes.
