Mustadrak al-Hakim — Hadith 8331

أخبرنا أبو جعفر محمد بن محمد بن عبد الله البغدادي، حدَّثنا يحيى بن عثمان بن صالح، حدَّثنا سعيدٌ بن كثير بن عُفَير، حدَّثنا يحيى بن فُليح أبو المغيرة الخُزاعي، حدَّثنا ثَوْر بن زيد الدِّيلي، عن عِكْرمة، عن ابن عباس قال: إِنَّ الشُّرَّاب كانوا يُضرَبون على عهد رسول الله ﷺ بالأيدي والنِّعالِ والعِصيِّ حتى تُوفِّيَ رسولُ الله ﷺ، وكانوا في خلافة أبي بكر أكثرَ منهم في عهدِ رسول الله ﷺ، فقال أبو بكر: لو فَرَضْنا لهم حدًا، فتَوخَّى نحوًا ممّا كانوا يُضرَبون في عهد رسول الله ﷺ، فكان أبو بكر يَجلِدُهم أربعين حتى تُوفَّى، ثم قام من بعدِه عمرُ، فجلدَهم كذلك أربعينَ حتى أُتِيَ برجلٍ من المهاجرين الأوَّلين وقد كان شَرِبَ، فَأَمَرَ بهِ أَن يُجلَد، فقال: لِمَ تَجلِدُني؟ بيني وبينَك كتابُ الله! فقال عمر: في أيِّ كتاب الله تَجِدُ أني لا أجلِدُك؟ فقال: إِنَّ الله تعالى يقول في كتابه: ﴿لَيْسَ عَلَى الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ جُنَاحٌ فِيمَا طَعِمُوا﴾ الآية [المائدة: 93]، فأنا من الذين آمنوا وعملوا الصالحات، ثم اتَّقَوا وآمنوا، ثم اتَّقَوا وأحسَنُوا؛ شهدتُ معَ رسول الله ﷺ بدرًا والحُديبيَةَ والخندقَ والمشاهدَ. فقال عمر: ألا تَردُّون عليه ما يقول؟ فقال ابن عباس: إِنَّ هؤلاء الآياتِ أُنزلت عُذرًا للماضِينَ، وَحُجّةً على الباقين، فعَذَرَ الماضين، فإنهم لَقُوا الله قبلَ أن تُحرَّمَ عليهم الخمرُ، وهي حُجَّةٌ على الباقين (1) لأنَّ الله ﷿ يقول: ﴿يَاأَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصَابُ وَالْأَزْلَامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ﴾ [المائدة: 90]، ثم قرأ حتى أنفَدَ الآية الأخرى، ومَن كان من الذين آمنوا وعَمِلوا الصالحاتِ ثم اتَّقَوا وآمنوا ثم اتَّقَوا وأحسَنوا، فإنَّ الله ﷿ قد نَهَى أن يُشرَبَ الخمرُ، فقال عمرُ: صدقتَ، فماذا ترونَ؟ فقال عليٌّ: نَرَى أنه إذا شَرِبَ سَكِرَ، وإذا سَكِرَ هَذَى، وإذا هَذَى افترى، وعلى المُفتري ثمانونَ جلدةً، فأمَرَ عمرُ فَجُلِدَ ثمانينَ (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that in the time of the Messenger of Allah (peace and blessings be upon him), those who drank wine used to be beaten with hands, sandals and sticks until the Messenger of Allah (peace and blessings be upon him) passed away. During the caliphate of Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) the number of such people grew compared with the era of the Messenger of Allah (peace and blessings be upon him), so Sayyiduna Abu Bakr (may Allah be pleased with him) said: "Would that we fixed a (set) prescribed punishment for them." So he adopted the same manner in which they used to be beaten in the time of the Messenger of Allah (peace and blessings be upon him), and Sayyiduna Abu Bakr (may Allah be pleased with him) continued giving them forty lashes until his death. Then after him Sayyiduna Umar al-Faruq (may Allah be pleased with him) became caliph, and he too continued giving forty lashes in the same way, until a man from the earliest Muhajirun who had drunk wine was brought. He ordered him to be flogged, and the man said: "Why are you flogging me? Between me and you is the Book of Allah!" Sayyiduna Umar (may Allah be pleased with him) asked: "Where in the Book of Allah do you find that I should not flog you?" He said: "Indeed, Allah Almighty says in His Book: 'There is no sin upon those who believe and do righteous deeds for what they have eaten (or drunk)' [Surah al-Ma'idah: 93], and I am of those who believed and did righteous deeds, then feared (Allah) and believed, then feared (Allah) and did good; I was present with the Messenger of Allah (peace and blessings be upon him) at Badr, Hudaybiyah, the Trench and the other battles." At this Sayyiduna Umar (may Allah be pleased with him) said (to the Companions): "Will you not answer what he says?" So Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: "These verses were revealed as an excuse for those who had passed away and as a proof against those who remain. Allah excused those who had gone before, because they met Allah before the prohibition of wine was revealed, while it is a proof against those who remain, because Allah Almighty says: 'O you who believe, wine, gambling, idols and divining arrows are only an abomination from the work of Satan' [Surah al-Ma'idah: 90]." Then he recited until he completed the next verse (and said) that as for those who believed, did righteous deeds, then feared (Allah), believed and did good, Allah Almighty has forbidden (them too) from drinking wine. Sayyiduna Umar (may Allah be pleased with him) said: "You have spoken the truth. Now what is your view?" Sayyiduna Ali (may Allah be pleased with him) said: "Our view is that when he drinks he becomes intoxicated, when he becomes intoxicated he raves, and when he raves he fabricates slander (against people), and upon the slanderer are eighty lashes." So Sayyiduna Umar (may Allah be pleased with him) gave the order, and he was given eighty lashes.
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) إسناده ضعيف، يحيى بن فليح مع أنه من رجال النسائي لم يترجم له المزيُّ ولا ابن حجر، وترجم له في "اللسان"، فقال: قال ابن حزم: مجهول، وقال مرة: ليس بالقوي، وحديثه في "الكبرى" للنسائي وأغفله (يعني المزي) في "التهذيب". قلنا: وقد خولف في وصله كما سيأتي.
Grading: Its isnad is 'da'if' (weak).
Technical note / Defect ('illah): Although the narrator Yahya bin Fulayh is among the narrators of al-Nasa'i's Sunan, neither al-Mizzi nor al-Hafiz Ibn Hajar gave him a biography (in the Tahdhib); however, Ibn Hajar mentioned him in 'al-Lisan'. There it is written: Ibn Hazm called him 'majhul' (unknown), and once said: 'He is not strong'. His hadith is in al-Nasa'i's al-Sunan al-Kubra, but al-Mizzi overlooked him in 'al-Tahdhib'. We say: he has also been contradicted in narrating it as connected, as will come.
وأخرجه النسائي (5269) عن محمد بن عبد الله بن عبد الرحيم بن البرقي، عن سعيد بن كثير بن عُفير، بهذا الإسناد.
Reference / Source: It was recorded by al-Nasa'i (5269) with the chain Muhammad bin Abd Allah bin Abd al-Rahim al-Barqi from Sa'id bin Kathir bin Ufayr.
وأخرجه النسائي (5270) من طريق سعيد بن أبي مريم، عن يحيى بن فليح، به. وسمى الرجل المهاجري قُدامةَ بن مظعون.

Details of the narration: In this narration the name of the Muhajir man is given as 'Qudamah bin Maz'un'.
وخالف معمرٌ يحيى بنَ فليح عند عبد الرزاق (13542)، فرواه عن أيوب السختياني، عن عكرمة مرسلًا: أنَّ عمر بن الخطاب شاور الناس في جلد الخمر، وقال: إنَّ الناس قد شربوها واجترؤوا عليها! فقال له علي: إنَّ السكران إذا سكر هذى، وإذا هذى افترى، فاجعله حدَّ الفِرْية، فجعله عمر حدَّ الفِرية ثمانينَ. ورجاله ثقات.
Technical note / Defect ('illah): Ma'mar contradicted Yahya bin Fulayh, as found in the Musannaf of Abd al-Razzaq (13542). He narrated it via Ayyub al-Sakhtiyani from Ikrimah as 'mursal': Umar bin al-Khattab consulted the people about the punishment for wine and said: The people have begun drinking it and have become emboldened towards it! Ali (may Allah be pleased with him) said: When the intoxicated person becomes drunk he raves, and when he raves he fabricates slander, so make it the hadd for slander. So Umar fixed it as the hadd for slander, that is, eighty (80) lashes.
Grading: All of its narrators are 'thiqah' (trustworthy).
وخالفهما مالك بن أنس، فرواه في "الموطأ" 2/ 842 عن ثور بن زيد: أنَّ عمر، فذكره معضلًا.
Technical note / Defect ('illah): Malik bin Anas contradicted both of them. He narrated it in 'al-Muwatta'' (2/ 842) from Thawr bin Zayd: "That Umar" (and then mentioned the hadith).
Grading: This narration is 'mu'dal' (with two or more consecutive narrators missing from the chain).
وقد صحَّت قصة جلد عمر لقُدامة بغير هذا السياق، أخرجها عبد الرزاق (17076) عن معمر، عن الزهري قال: أخبرني عبد الله بن عامر بن ربيعة - وكان أبوه شهد بدرًا -: أن عمر بن الخطاب استعمل قدامة بن مظعون على البحرين … وذكر قصة. وسلف أول هذا الخبر عند الحاكم برقم (5719).
Important point: The story of Umar flogging Qudamah is authentically established in a context other than this one. Abd al-Razzaq (17076) recorded it via Ma'mar from al-Zuhri. Al-Zuhri said: Abd Allah bin Amir bin Rabi'ah informed me (whose father was present at Badr) that Umar bin al-Khattab appointed Qudamah bin Maz'un as governor over Bahrain … (and he mentioned the whole story).
