Mustadrak al-Hakim — Hadith 8330

قال الزُّهْري هذا: فحدَّثني حُمَيد بن عبد الرحمن عن وَبَرة الكَلْبي قال: أرسَلَني خالدُ بن الوليد إلى عمر، فأتيتُه وهو في المسجد معه عثمانُ بن عفان وعليٌّ وعبدُ الرحمن بن عوف وطلحةُ والزُّبيرُ متَّكئون معه في المسجد، فقلت: إنَّ خالد بن الوليد أرسَلَني إليك، وهو يقرأ عليك السلامَ، ويقول: إنَّ الناس قد انهمَكُوا (1) في الخمر، وتَحاقَرُوا العقوبة. فقال عمر: هم هؤلاء عندك فسَلْهم، فقال عليٌّ: نَراه إذا سَكِرَ هَذَى، وإذا هَذَى افترى، وعلى المفتري ثمانونَ. فقال عمرُ: أبلِغْ صاحبَك ما قال. فجَلَدَ خالدٌ ثمانينَ، وجَلَدَ عمرُ ثمانينَ، فكان عمرُ إذا أُتِيَ بالرجل القوي المُنهمِك في الشُّرْب جَلَدَه ثمانينَ، وإذا أُتِي بالرجل الضعيف الذي كانت منه الزَّلّة جَلَدَه أربعين، ثم جَلَدَ عثمانُ ثمانين وأربعينَ (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Wabarah al-Kalbi; he said: Sayyiduna Khalid bin al-Walid (may Allah be pleased with him) sent me to Sayyiduna Umar al-Faruq (may Allah be pleased with him). I came to him while he was in the mosque, and with him were Sayyiduna Uthman bin Affan, Sayyiduna Ali, Sayyiduna Abd al-Rahman bin Awf, Sayyiduna Talhah and Sayyiduna al-Zubayr (may Allah be pleased with them), reclining in the mosque. I said: Khalid bin al-Walid has sent me to you; he conveys his greetings of peace to you and says that the people have become heavily given to drinking wine and have come to regard the punishment as trivial. Sayyiduna Umar (may Allah be pleased with him) said: These people are here before you; consult them. So Sayyiduna Ali (may Allah be pleased with him) said: Our view is that "when he becomes intoxicated he raves, and when he raves he fabricates slander, and the punishment of the slanderer is eighty lashes." Sayyiduna Umar (may Allah be pleased with him) said: Convey to your companion (Khalid) what he has said. So Sayyiduna Khalid (may Allah be pleased with him) gave eighty lashes, and Sayyiduna Umar (may Allah be pleased with him) also gave eighty lashes. Thereafter it was the practice of Sayyiduna Umar (may Allah be pleased with him) that when a strong man addicted to drink was brought, he would give him eighty lashes, and when a weak man was brought who had made a slip, he would give him forty lashes. Then Sayyiduna Uthman (may Allah be pleased with him) also gave eighty and forty lashes.
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

Note / Clarification: In manuscripts (Z), (K) and (B) this word has been corrupted into "ittahamuka", whereas the wording adopted from manuscript (M) is correct.

(2) إسناده ضعيف، وَبَرة الكلبي مجهول، قال الحافظ ابن حجر في "لسان الميزان" 8/ 373 قال ابن حزم في "الإيصال": مجهول. ثم ذكر ابن حجر أنه ترجم له في "تهذيب التهذيب" لأنه وقعت له رواية عند النسائي في "الكبرى" لهذا الحديث الذي ذكره ابن حزم. ولم نجد له ترجمة فيه! ولم نجد ذكرًا لوبرة الكلبي في "سننه"، وإنما ذكر النسائيُّ وَبَرة بن عبد الرحمن الحارثي، وهو غير الكلبي.
Grading: Its isnad is 'da'if' (weak).
Technical note / Defect ('illah): The narrator 'Wabarah al-Kalbi' is majhul (unknown). Al-Hafiz Ibn Hajar said in 'Lisan al-Mizan' (8/ 373) that Ibn Hazm called him majhul in 'al-Isal'. Then Ibn Hajar mentioned that he had included a biography of him in 'Tahdhib al-Tahdhib', because a narration of his occurs in al-Nasa'i's al-Sunan al-Kubra for this hadith which Ibn Hazm mentioned. (The editors say:) We did not find a biography of him in the Tahdhib! Nor did we find any mention of 'Wabarah al-Kalbi' in al-Nasa'i's Sunan; rather, al-Nasa'i mentioned 'Wabarah bin Abd al-Rahman al-Harithi', and he is a different person (from al-Kalbi).
وأخرجه الدارقطني (3321) - ومن طريقه البيهقي 8/ 320 - من طريق يعقوب بن إبراهيم الدَّورقي، عن صفوان بن عيسى، بهذا الإسناد. وقال فيه ابن وَبَرة، وكذا ترجم له ابن حجر في "إتحاف المهرة" 12/ 420.
Corroborating chains and supporting reports: It was recorded by al-Daraqutni (3321), and via him by al-Bayhaqi (8/ 320), with the chain Ya'qub bin Ibrahim al-Dawraqi from Safwan bin Isa, with this same isnad. In this narration the narrator's name is given as 'Ibn Wabarah', and al-Hafiz Ibn Hajar gave him an entry under this name in 'Ithaf al-Maharah' (12/ 420).
وأخرجه الطحاوي في "شرح معاني الآثار" 3/ 153 من طريق عبد الله بن وهب وروح بن عبادة، عن أسامة بن زيد به. وعنده: وَبَرة.
Reference / Source: It was recorded by al-Tahawi in 'Sharh Ma'ani al-Athar' (3/ 153) via Abd Allah bin Wahb and Rawh bin Ubadah from Usamah bin Zayd, and in his version the narrator's name is 'Wabarah' (without "Ibn").
وفي "صحيح مسلم" (1706) من حديث أنس: أنَّ الذي أشار على عمر بالأربعين هو عبد الرحمن بن عوف، ولفظه: أن النبي ﷺ جلد في الخمر بالجريد والنعال، ثم جلد أبو بكر أربعين، فلما كان عمر، ودنا الناس من الريف والقرى، قال: ما ترون في جلد الخمر؟ فقال عبد الرحمن بن عوف: أرى أن تجعلها كأخفّ الحدود، قال: فجلد عمر ثمانين.
Corroborating chains and supporting reports: In Sahih Muslim (1706), in the hadith of Anas (may Allah be pleased with him), it is stated that the one who advised Umar (may Allah be pleased with him) to go from forty lashes to eighty (80) was Abd al-Rahman bin Awf. Its wording is: The Prophet (peace and blessings be upon him) used to flog for wine with palm stalks and sandals, then Abu Bakr (may Allah be pleased with him) had forty lashes given. When it was the time of Umar, and the people had come close to the countryside and villages (and wine became widespread), he said: What is your opinion about the flogging for wine? Abd al-Rahman bin Awf said: My opinion is that you make it like the lightest of the hadd punishments (i.e. the hadd for slander). So Umar had eighty (80) lashes given.
