Mustadrak al-Hakim — Hadith 8326

أخبرنا أبو أحمد بكر بن محمد بن حَمْدان الصَّيرَفي بمَرْو، حدَّثنا عبد الصمد بن الفضل البَلْخي، حدَّثنا مَكِّيُّ بن إبراهيم، حدَّثنا الجُعَيد (1) بن عبد الرحمن، عن يزيد بن خُصَيفة، عن السائب بن يزيد قال: كان يُؤتَى بالشارب في عهد رسولِ الله ﷺ وفي إمرة أبي بكر وصَدْرًا من إمرة عمر، فنقوم إليه فنضربُه بأيدينا ونعالِنا وأرديَتِنا حتى كان صَدْرًا من إمارة عمر، فجَلَدَ فيها أربعينَ، حتى إذا عاثُوا فيها وفَسَقُوا جَلَدَ فيها ثمانينَ (2).
هذا حديث صحيح على شرط الشيخين.

It is narrated from Sayyiduna al-Sa'ib bin Yazid (may Allah be pleased with him) that in the time of the Messenger of Allah (peace and blessings be upon him), during the caliphate of Sayyiduna Abu Bakr al-Siddiq (may Allah be pleased with him) and in the early part of the caliphate of Sayyiduna Umar al-Faruq (may Allah be pleased with him), when a drinker of wine was brought, we would get up and beat him with our hands, our sandals and our cloaks, until, in the early part of the era of Sayyiduna Umar (may Allah be pleased with him), he fixed forty lashes for it; then, when people went to excess in it and wickedness increased, he fixed eighty lashes for it.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim).

Technical note / Defect ('illah): (1) In the manuscripts this name has been corrupted into "al-Ju'aydi".

(2) إسناده صحيح، الجعيد - ويقال: الجعد - بن عبد الرحمن: هو ابن أوس الكندي، سمع هذا الحديث من السائب مباشرة، ومرة بواسطة يزيد بن خصيفة.
Grading: (2) Its isnad is sahih.
Technical note / Defect ('illah): Al-Ju'ayd - he is also called al-Ja'd - bin Abd al-Rahman: he is Ibn Aws al-Kindi. He heard this hadith from al-Sa'ib directly, and once through the intermediary of Yazid bin Khusayfah.
وقال الحافظ ابن حجر في "الفتح" 21/ 426: فعلى هذا فإدخال يزيد بن خصيفة بينهما إما من المزيد في متصل الأسانيد، وإما أن يكون الجعيد سمعه من السائب، وثَبَّتَه فيه يزيد، ثم ظهر لي السبب في ذلك، وهو أنَّ رواية الجعيد المذكورة عن السائب مختصرة، فكأنه سمع الحديث تامًّا من يزيد عن السائب، فحدَّث بما سمعه من السائب عنه من غير ذكر يزيد، وحدث أيضًا بالتامِّ، فذكر الواسطة.
Technical note / Defect ('illah): Al-Hafiz Ibn Hajar said in "al-Fath" 21/ 426: "On this basis, the insertion of Yazid bin Khusayfah between the two is either of the type 'al-mazid fi muttasil al-asanid' (an extra narrator added within connected chains), or else al-Ju'ayd heard it from al-Sa'ib and Yazid made him more certain of it. Then the reason for this became clear to me, namely that the aforementioned narration of al-Ju'ayd from al-Sa'ib is abridged; it is as though he heard the complete hadith from Yazid, from al-Sa'ib, so he narrated the part he had heard (directly) from al-Sa'ib without mentioning Yazid, and he also narrated the complete hadith, in which he mentioned the intermediary (Yazid)."
وأخرجه أحمد 24/ (15719)، والبخاري (6779)، والنسائي (5261) من طرق عن مكي بن إبراهيم، بهذا الإسناد.
Reference / Source: It was also recorded by Ahmad 24/ (15719), al-Bukhari (6779) and al-Nasa'i (5261) via several routes from Makki bin Ibrahim, with this same isnad.
وأخرجه النسائي (5259) من طريق حاتم بن إسماعيل، و (5260) من طريق المغيرة بن عبد الرحمن، كلاهما عن الجعيد بن عبد الرحمن، قال: سمعت السائب، فذكره. ليس فيه يزيد بن خصيفة، وصرح الجعيد فيه بالسماع من السائب، وكان الجعيد قد لقي السائب، فقد روى البخاري (3540) أنَّ الجعيد قال: رأيت السائب بن يزيد ابن أربع وتسعين جَلْدًا معتدلًا.
Reference / Source: It was also recorded by al-Nasa'i (5259) via Hatim bin Isma'il, and (5260) via al-Mughirah bin Abd al-Rahman, both of them from al-Ju'ayd bin Abd al-Rahman, who said: "I heard al-Sa'ib", and then he mentioned the hadith. Yazid bin Khusayfah is not mentioned in it, and al-Ju'ayd explicitly states in it that he heard from al-Sa'ib.
Technical note / Defect ('illah): And al-Ju'ayd's meeting with al-Sa'ib is established, for al-Bukhari (3540) narrated that al-Ju'ayd said: "I saw al-Sa'ib bin Yazid at the age of ninety-four (94), sturdy and well-proportioned."
