حدثنا علي بن حَمْشاذَ العدلُ، حدثنا أبو المُثنَّى ومحمد بن أيوب، قالا: حدثنا أبو الوليد الطَّيالسي، حدثنا سليمان بن كثير، عن الزُّهري، عن أبي أُمامةَ بن سهل بن حُنيف، عن أبيه: أنَّ النبيَّ ﷺ نهى عن لَونَينِ من التمر: الجُعْرُورِ، ولونِ الحُبَيْق، قال: وكان ناسٌ يَتَيَمَّمُون شرَّ ثمارِهم فيُخرِجونَها في الصدقة، فنُهُوا عن لَونَينِ من التَّمر، فنزلت: ﴿وَلَا تَيَمَّمُوا الْخَبِيثَ مِنْهُ تُنْفِقُونَ﴾ [البقرة: 267] (1).
هذا حديث صحيح على شرط البخاري، ولم يُخرجاه. وقد تابعه سفيان بن حسين ومحمد بن أبي حَفْصة عن الزهري. فأما حديث سفيان بن حسين:
Abu Umamah bin Sahl bin Hunayf narrates from his father (Sayyiduna Sahl, may Allah be pleased with him) that the Prophet (peace and blessings be upon him) forbade taking two kinds of dates, 'ju'rur' and 'lawn hubayq' (which are of inferior quality), in zakah. The narrator says: Some people would pick out their inferior fruit and give it in zakah, so they were forbidden these two kinds of dates, and this verse was revealed: "And do not aim at the bad of it to spend from" [Surah al-Baqarah: 267].
This hadith is sahih on the condition of Bukhari, but the two Shaykhs did not record it. Sufyan bin Husayn and Muhammad bin Abi Hafsah have also corroborated it from al-Zuhri.

فأخبرَناه جعفر بن محمد بن نُصَير الخُلْدي، حدثنا علي بن عبد العزيز، حدثنا سعيد بن سليمان، حدثنا عبَّاد بن العَوَّام، عن سفيان بن الحسين، عن الزُّهري، عن أبي أُمامة بن سَهْل، عن أبيه قال: أَمَرَ رسول الله ﷺ بصَدَقةٍ، فجاء رجلٌ من هذا السُّخَّل بكَبائِسَ - فقال سفيان: يعني: الشِّيص - فقال رسولُ الله ﷺ: "مَن جاء بهذا؟ " وكان لا يجيءُ أحدٌ بشيءٍ إلّا نُسِب إلى الذي جَلَبَه، فنزلت: ﴿وَلَا تَيَمَّمُوا الْخَبِيثَ مِنْهُ تُنْفِقُونَ﴾، قال: ونهى رسولُ الله ﷺ عن الجُعْرُور ولونِ الحُبَيق أن يُؤخَذَا في الصدقة. قال الزُّهري: لونانِ من تمرِ الصَّدقة (1). وأما حديث محمد بن أبي حَفْصة:
Sayyiduna Sahl bin Hunayf (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) ordered that charity (zakah) be given, and a man brought some bunches of poor-quality dates (shis). The Messenger of Allah (peace and blessings be upon him) asked: "Who brought this?" At that time, whatever anyone brought was attributed to the one who brought it. Then this verse was revealed: "And do not aim at the bad of it to spend from." The narrator said: And the Messenger of Allah (peace and blessings be upon him) forbade that the dates called 'ju'rur' and 'lawn hubayq' be taken in zakah. Al-Zuhri said: These are two (inferior) kinds of the dates of charity.

فأخبرَناه الحسن بن حَلِيم المَروَزي، أخبرنا أبو الموجِّه، أخبرنا عَبْدان، أخبرنا عبد الله بن المبارك، عن محمد بن أبي حَفْصة، عن الزُّهري، عن أبي أُمامةَ بن سَهْل بن حُنَيف، عن أبيه قال: كان أناسٌ يَتلاوَمُون شِرارَ ثِمارِهم، فأنزل الله ﷿: ﴿وَلَا تَيَمَّمُوا الْخَبِيثَ مِنْهُ تُنْفِقُونَ وَلَسْتُمْ بِآخِذِيهِ إِلَّا أَنْ تُغْمِضُوا فِيهِ﴾، قال: فنهى رسول الله ﷺ عن لونين: عن الجُعْرور وعن لونِ حُبَيق (1).
It is narrated from Sayyiduna Sahl bin Hunayf (may Allah be pleased with him) that some people had begun to give out the inferior dates of their harvest, so Allah, the Mighty and Majestic, revealed this verse: "And do not aim at the bad of it to spend from, while you would not take it yourselves except with closed eyes." The narrator says: So the Messenger of Allah (peace and blessings be upon him) forbade two kinds of dates, 'ju'rur' and 'lawn hubayq'.

حدثنا أبو العباس محمد بن يعقوب، حدثنا إبراهيم بن مرزوق، حدثنا وَهْب بن جَرِير، حدثنا شُعبة. وأخبرنا أحمد بن جعفر القَطِيعي، حدثنا عبد الله بن أحمد بن حنبل، حدثني أبي، حدثنا يحيى وعبد الرحمن، قالا: حدثنا شعبة، قال: سمعت خُبَيب بن عبد الرحمن يحدِّث عن عبد الرحمن بن مسعود بن نِيَار، عن سهل بن أبي حَثْمة؛ قال: أتانا ونحن في السُّوق فقال: قال رسول الله ﷺ: "إذا خَرَصْتُم فَخُذُوا ودَعُوا الثلث، فإن لم تأخُذُوا أو تَدَعُوا الثلث - شَكَّ شعبةُ في الثلث - فدَعُوا الرُّبع" (2). قال الحاكم: أنا جمعتُ بين يحيى وعبد الرحمن، وليس في حديث وَهْب بن جرير شَكُّ شعبة.
هذا حديث صحيح الإسناد. وله شاهدٌ بإسنادٍ متفق على صحته: أنَّ عمر بن الخطاب أَمرَ به.
Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him) narrates that he came to us while we were in the market and said that the Messenger of Allah (peace and blessings be upon him) said: "When you make an estimate (khars) (of the fruit), take the zakah and leave a third (for the owner); and if you do not leave a third, then leave a quarter" (so that they can use it for their own needs and for hospitality). Shu'bah had a doubt about the word 'third'. Al-Hakim says: I have combined the narrations of Yahya and Abdurrahman, whereas in the hadith of Wahb bin Jarir, Shu'bah had no doubt.
This hadith has a sahih chain, and it has a supporting narration whose authenticity is agreed upon, that Sayyiduna Umar (may Allah be pleased with him) also ordered the same.

أخبرَناه أبو بكر بن إسحاق، أخبرنا أبو المثنَّى، حدثنا مُسدَّد، حدثنا حماد بن زيد، عن يحيى بن سعيد، عن بُشَير بن يسار، عن سَهْل بن أبي حَثْمة: أنَّ عمر بن الخطاب بَعَثَه على خَرْصِ التمر، وقال: إذا أتيتَ أرضًا فاخْرُصْها ودَعْ لهم قَدْرَ ما يأكلون (1).
It is narrated from Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him) that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) sent him to estimate (khars) the dates and instructed: "When you come to a piece of land, estimate its fruit (for zakah) and leave for them (the owners) a share sufficient for what they eat."

أخبرنا أبو العباس محمد بن أحمد المحبوبي، حدثنا سعيد بن مسعود، حدثنا يزيد بن هارون، أخبرنا شُعبة، عن قتادة، عن أبي عمر الغُدَاني، عن أبي هريرة: أنه مَرَّ عليه رجلٌ من بني عامر، فقيل: هذا من أكثر الناس مالًا، فدعاه أبو هريرةَ فسأله عن ذلك، فقال: نَعَم، لي مئةٌ حمراءُ، ولي منةٌ أَدْماءُ، ولي كذا وكذا من الغَنَم، فقال أبو هريرة: إياكَ وأَخفافَ الإبل، إياكَ وأظلافَ الغَنَم؛ إنِّي سمعتُ رسول الله ﷺ يقول: "ما مِن رجلٍ يكون له إبلٌ لا يؤدِّي حقَّها في نَجْدَتِها ورِسْلِها - قال رسول الله ﷺ: ونَجْدتُها ورِسْلُها: عُسْرُها ويُسْرُها - إلّا بَرَزَ له بقاعٍ قَرقَرٍ، فجاءته كأَغذِّ (1) ما تكون وأَسَرِّهِ وأسمَنِه أو أعظمِه (2) - شعبةُ شَكَّ - فتَطَؤُه بأخفافِها وتَنطِحُه بقرونها، كلَّما جازت عليه أُخراها أُعيدتْ عليه أُولاها، في يومٍ كان مقدارُه خمسين ألفَ سنة، حتى يُقضَى بين الناس فيُرى سَبيلَه. وما من عبدٍ يكون له بقرٌ لا يُؤدِّي حقَّها في نَجْدَتِها ورِسْلِها - قال رسولُ الله ﷺ: ونَجْدَتها ورِسْلُها، عُسْرُها ويُسْرُها - إلّا بَرَزَ له بِقاعٍ قَرْقَرٍ كأغَذِّ ما تكونُ وأسرِّه واسمَنِه وأعظَمِه، فتطؤُه بأظلافها، وتَنْطِحُه بقُرونِها، كلما جازَتْ عليه أُولاها أُعيدَتْ عليه أُخراها، في يومٍ كان مِقدارُه خمسينَ ألفَ سنة، حتى يُقضَى بين الناس، فيُرَى سبيلَه". فقال له العباس: وما حقُّ الإبل يا أبا هريرة؟ قال: تُعطي الكريمةَ، وتَمنحُ الغَزيرةَ، وتُفقِرُ الظَّهرَ، وتُطرِقُ الفَحْل، وتَسقِي اللَّبَن (3)
هذا حديث صحيح الإسناد، ولم يُخرجاه، إنما خرَّج مسلم بعض هذه الألفاظ من حديث سُهيل عن أبيه عن أبي هريرة (1). وأبو عمر الغُدَاني يقال: إنه يحيى بن عُبيد البَهْراني، فإن كان كذلك، فقد احتجَّ به مسلم. ولا أعلم أحدًا حدَّث به عن شعبة غيرَ يزيد بن هارون، ولم نكتبه عاليًا إلّا عن أبي العباس المحبوبي.
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that a man from Banu Amir passed by him, and it was said: "This is one of the wealthiest of people." Abu Hurayrah called him and asked him about that, and he said: "Yes, I have a hundred red camels, a hundred tawny camels, and such-and-such a number of sheep and goats." Abu Hurayrah said: "Beware of the hooves of camels, and beware of the hooves of sheep; for I heard the Messenger of Allah (peace and blessings be upon him) say: 'There is no man who has camels and does not pay their due in their hardship and their ease (najdah and risl)' - the Messenger of Allah (peace and blessings be upon him) said: 'Their najdah and risl means their difficulty and their ease' - 'except that he will be laid out for them on a wide, level plain, and they will come to him as swift, as lively and as fat, or as large, as they ever were' - Shu'bah was in doubt - 'and they will trample him with their hooves and butt him with their horns. Whenever the last of them passes over him, the first of them is brought back to him, on a Day whose length is fifty thousand years, until judgement is passed between the people and he sees his path. And there is no servant who has cattle and does not pay their due in their hardship and their ease' - the Messenger of Allah (peace and blessings be upon him) said: 'Their najdah and risl means their difficulty and their ease' - 'except that he will be laid out for them on a wide, level plain, and they will come as swift, as lively, as fat and as large as they ever were, and they will trample him with their hooves and butt him with their horns. Whenever the first of them passes over him, the last of them is brought back to him, on a Day whose length is fifty thousand years, until judgement is passed between the people and he sees his path.'" Al-Abbas said to him: "And what is the due of camels, O Abu Hurayrah?" He said: "That you give the finest of them (in zakah), lend out the abundant milker, lend out its back for riding, lend the stud for mating, and give milk to drink."
This hadith has a sahih chain, but the two Shaykhs did not record it; Muslim only recorded some of these wordings from the hadith of Suhayl from his father from Abu Hurayrah. It is said that Abu Umar al-Ghudani is Yahya bin Ubayd al-Bahrani; if that is so, Muslim used him as evidence. I do not know anyone who narrated it from Shu'bah other than Yazid bin Harun, and we did not write it with a high chain except from Abu al-Abbas al-Mahbubi.

إنما حدَّثَناه أبو زكريا العَنْبري، حدثنا إبراهيم بن أبي طالب، حدثنا عَبْدَةُ بن عبد الله الخُزَاعي. وحدثنا أبو عليٍّ الحافظ، حدثنا أبو عبد الرحمن النَّسائي، حدثنا محمد بن عليّ بن سَهْل؛ قالا: حدثنا يزيد بن هارون، نحوه.
Abu Zakariya al-Anbari, Ibrahim bin Abi Talib and Abdah bin Abdullah al-Khuza'i narrated this hadith to us; likewise Abu Ali al-Hafiz, Abu Abdurrahman al-Nasa'i and Muhammad bin Ali bin Sahl also transmitted it; all of them say that Yazid bin Harun narrated to us a hadith similar to it (like the previous narration).

حدثنا محمد بن صالح بن هانئ، حدثنا الفضل بن محمد بن المسيّب، حدثنا نُعَيم بن حماد، حدثنا عبد العزيز بن محمد، عن رَبيعَة بن أبي عبد الرحمن، عن الحارث بن بلال بن الحارث، عن أبيه: أنَّ رسول الله ﷺ أَخَذَ في المَعادن القَبَلِيَّةِ الصَّدقةَ، وأنه أقطَعَ بلالَ بن الحارث العَقِيقَ أجمَعَ، فلمَّا كان عمرُ قال لبلال: إنَّ رسول الله ﷺ لم يُقطِعْكَ لتَحْتَجِرَه عن الناس، لم يُقطِعْكَ إلّا لتعمَلَ. قال: فأقطَعَ عمرُ بن الخطاب للناس العَقِيقَ (2). قد احتجَّ البخاري بنُعَيم بن حماد، ومسلمٌ بالدَّراوَرْدي، و
هذا حديث صحيح ولم يُخرجاه.
Al-Harith bin Bilal narrates from his father (Sayyiduna Bilal bin al-Harith, may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) collected zakah from the mines of al-Qabaliyyah, and he (peace and blessings be upon him) had granted Bilal bin al-Harith the entire area of al-Aqiq as a land grant. When the time of Sayyiduna Umar (may Allah be pleased with him) came, he said to Bilal: "The Messenger of Allah (peace and blessings be upon him) did not give you this land so that you would hold it back from the people; rather, he gave it to you so that you would work it." So Umar (may Allah be pleased with him) took that area of al-Aqiq (which Bilal was unable to work) and distributed it among the people.
Bukhari used Nu'aym bin Hammad as evidence, and Muslim used al-Darawardi as evidence. This hadith is sahih, and the two Shaykhs did not record it.

حدثنا أبو بكر محمد بن أحمد بن بالَوَيهِ، حدثنا إسحاق بن الحسن بن مَيمُون، حدثنا عفّان بن مُسلِم، حدثنا شُعبة. وأخبرنا أحمد بن جعفر القَطِيعي، حدثنا عبد الله بن أحمد بن حنبل، حدثني أبي، حدثنا محمد بن جعفر، حدثنا شعبة، عن الحَكَم، عن ابن أبي رافع، عن أبي رافع: أنَّ رسول الله ﷺ بَعَثَ رجلًا من بني مَخزُوم على الصَّدقة، فقال لأبي رافع: اصحَبْني كَيْما تُصيبَ منها، فقال: لا، حتى آتيَ رسولَ الله ﷺ، فانطَلَقَ إلى النبي ﷺ فسأله، فقال: "إنَّ الصَّدقةَ لا تَحِلُّ لنا، وإنَّ مَواليَ القوم من أنفُسِهم" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.
It is narrated from Sayyiduna Abu Rafi' (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) appointed a man from Banu Makhzum to collect zakah. He said to Abu Rafi': "Come with me so that you too may get a share of it." He said: "No, not until I ask the Messenger of Allah (peace and blessings be upon him)." So he came to him (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Indeed, charity (zakah) is not lawful for us, and the freed slaves of a people are counted as (coming under the same ruling as) the people themselves."
This hadith is sahih on the condition of the two Shaykhs, but they did not record it.
