Mustadrak al-Hakim — Hadith 1480

حدثنا أبو العباس محمد بن يعقوب، حدثنا إبراهيم بن مرزوق، حدثنا وَهْب بن جَرِير، حدثنا شُعبة. وأخبرنا أحمد بن جعفر القَطِيعي، حدثنا عبد الله بن أحمد بن حنبل، حدثني أبي، حدثنا يحيى وعبد الرحمن، قالا: حدثنا شعبة، قال: سمعت خُبَيب بن عبد الرحمن يحدِّث عن عبد الرحمن بن مسعود بن نِيَار، عن سهل بن أبي حَثْمة؛ قال: أتانا ونحن في السُّوق فقال: قال رسول الله ﷺ: "إذا خَرَصْتُم فَخُذُوا ودَعُوا الثلث، فإن لم تأخُذُوا أو تَدَعُوا الثلث - شَكَّ شعبةُ في الثلث - فدَعُوا الرُّبع" (2). قال الحاكم: أنا جمعتُ بين يحيى وعبد الرحمن، وليس في حديث وَهْب بن جرير شَكُّ شعبة.
هذا حديث صحيح الإسناد. وله شاهدٌ بإسنادٍ متفق على صحته: أنَّ عمر بن الخطاب أَمرَ به.
Sayyiduna Sahl bin Abi Hathmah (may Allah be pleased with him) narrates that he came to us while we were in the market and said that the Messenger of Allah (peace and blessings be upon him) said: "When you make an estimate (khars) (of the fruit), take the zakah and leave a third (for the owner); and if you do not leave a third, then leave a quarter" (so that they can use it for their own needs and for hospitality). Shu'bah had a doubt about the word 'third'. Al-Hakim says: I have combined the narrations of Yahya and Abdurrahman, whereas in the hadith of Wahb bin Jarir, Shu'bah had no doubt.
This hadith has a sahih chain, and it has a supporting narration whose authenticity is agreed upon, that Sayyiduna Umar (may Allah be pleased with him) also ordered the same.

Grading: Its chain is possibly hasan. Abd al-Rahman bin Mas'ud bin Niyar is a Tabi'i; Khubayb bin Abd al-Rahman is the only one who narrates from him. Ibn Hibban mentioned him in "al-Thiqat", and no one criticised him.
Criticism of a narrator: Yahya is al-Qattan and Abd al-Rahman is Ibn Mahdi.
وهو في "مسند أحمد" 26/ (16094) عن يحيى القطان وحده، بهذا الإسناد.
Reference / Source: It is in "Musnad Ahmad" (26/ 16094) through Yahya al-Qattan alone.
ومن طريق يحيى أيضًا أخرجه النسائي (2282). ¤ ¤ وأخرجه أحمد 24/ (15713) و 26/ (16093)، وأبو داود (1605)، والترمذي (643)، والنسائي (2282)، وابن حبان (3280) من طرق عن شعبة، به. وليس عندهم شك شعبة.
Reference / Source: Imam al-Nasa'i (2282) also narrated it via Yahya. Ahmad (24/ 15713 and 26/ 16093), Abu Dawud (1605), al-Tirmidhi (643), al-Nasa'i (2282) and Ibn Hibban (3280) narrated it via Shu'bah, and Shu'bah's "doubt" is not present in their versions.
قال الترمذي: وفي الباب عن عائشة وعتاب بن أسيد وابن عباس، ثم قال: والعمل على حديث سهل بن أبي حثمة عند أكثر أهل العلم في الخَرْص، وبحديث سهل بن أبي حثمة يقول أحمد وإسحاق.
General principle: Imam al-Tirmidhi says that on this topic there are also narrations from A'ishah, Attab bin Asid and Ibn Abbas. Most of the people of knowledge act upon the hadith of Sahl bin Abi Hathmah regarding "khars" (estimating the yield of fruit), and Imam Ahmad and Ishaq also hold this view.
ثم قال: والخرصُ إذا أدركتِ الثمارُ من الرُّطب والعنب مما فيه الزكاة، بعث السلطان خارصًا فخرص عليهم، والخَرْصُ أن يَنظُر من يُبصِر ذلك فيقول: يخرج من هذا من الزبيب كذا، ومن التمر كذا وكذا، فيحصي عليهم، ويَنظرُ مبلغَ العُشر من ذلك، فيُثبِت عليهم، ثم يخلِّي بينهم وبين الثمار، فيصنعون ما أحبوا، فإذا أدركتِ الثمارُ أُخذ منهم العُشر، هكذا فسَّره بعض أهل العلم، وبهذا يقول مالك والشافعي وأحمد وإسحاق.
Important point: "Khars" is that when the fruit (fresh dates and grapes) ripens, the ruler sends an experienced person who estimates how much dried dates or raisins it will yield. He calculates its tithe ('ushr, one tenth) and records it as owed by them, then leaves them free to use the fruit as they wish, and at harvest time that tithe is collected from them. This is the view of Imam Malik, al-Shafi'i, Ahmad and Ishaq.
وقال ابن حبان: لهذا الخبر معنيان: أحدهما: أن يُترَك الثلث أو الربع من العُشر. والثاني: أن يُترَك ذلك من نفس التمر قبل أن يُعشَّر إذا كان ذلك حائطًا كبيرًا يحتمله.
General principle: Ibn Hibban says that it has two meanings: one is that a third or a quarter of the tithe is left (for the owner). The second is that, before the tithe is taken, that much of the produce is left for the owner's eating and the like.
