حدثنا محمد بن صالح بن هانئ، حدثنا الفضل بن محمد بن المسيّب، حدثنا نُعَيم بن حماد، حدثنا عبد العزيز بن محمد، عن رَبيعَة بن أبي عبد الرحمن، عن الحارث بن بلال بن الحارث، عن أبيه: أنَّ رسول الله ﷺ أَخَذَ في المَعادن القَبَلِيَّةِ الصَّدقةَ، وأنه أقطَعَ بلالَ بن الحارث العَقِيقَ أجمَعَ، فلمَّا كان عمرُ قال لبلال: إنَّ رسول الله ﷺ لم يُقطِعْكَ لتَحْتَجِرَه عن الناس، لم يُقطِعْكَ إلّا لتعمَلَ. قال: فأقطَعَ عمرُ بن الخطاب للناس العَقِيقَ (2). قد احتجَّ البخاري بنُعَيم بن حماد، ومسلمٌ بالدَّراوَرْدي، و هذا حديث صحيح ولم يُخرجاه.
Al-Harith bin Bilal narrates from his father (Sayyiduna Bilal bin al-Harith, may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) collected zakah from the mines of al-Qabaliyyah, and he (peace and blessings be upon him) had granted Bilal bin al-Harith the entire area of al-Aqiq as a land grant. When the time of Sayyiduna Umar (may Allah be pleased with him) came, he said to Bilal: "The Messenger of Allah (peace and blessings be upon him) did not give you this land so that you would hold it back from the people; rather, he gave it to you so that you would work it." So Umar (may Allah be pleased with him) took that area of al-Aqiq (which Bilal was unable to work) and distributed it among the people.
Bukhari used Nu'aym bin Hammad as evidence, and Muslim used al-Darawardi as evidence. This hadith is sahih, and the two Shaykhs did not record it.

Grading: There is some weakness (lin) in its chain. Criticism of a narrator: Only Rabi'ah bin Abi Abd al-Rahman narrates from al-Harith bin Bilal. Imam Ahmad said: I do not hold by this hadith, because its chain is not well known. قلنا: إلّا أنَّ لقصة إقطاع النبي ﷺ بلال بن الحارث شاهدًا من حديث عمرو بن عوف وابن عباس، أخرجه أحمد 5/ (2785) و (2786) وأبو داود (3062) و (3063) بإسناد ضعيف، يعضد قصة الإقطاع دون زكاة المعادن، وانظر بسط الكلام على الحديث في التعليق على "سنن أبي داود" (3061). ¤ ¤ وأخرجه البيهقي في "السنن الكبرى" 4/ 152 و 6/ 148، وفي "المعرفة" (1212) و (8357) عن أبي عبد الله الحاكم، بهذا الإسناد. وقد جاء في "المعرفة" مختصرًا: أنَّ رسول الله ﷺ أخذ من معادن القبلية الصدقة. Corroborating chains and supporting reports: However, the story of the Prophet (peace and blessings be upon him) granting land (iqta') to Bilal bin al-Harith has supporting reports from the hadith of Amr bin Awf and Ibn Abbas, narrated by Ahmad (5/ 2785 and 2786) and Abu Dawud (3062 and 3063) with a weak chain, which support the story of the grant but not the zakah on mines. Al-Bayhaqi narrated it in "al-Sunan al-Kubra" (4/ 152 and 6/ 148) and "al-Ma'rifah" (1212 and 8357) via Abu Abdullah al-Hakim, and in "al-Ma'rifah" he mentioned in brief that he (peace and blessings be upon him) collected zakah from the mines of "al-Qabaliyyah". وأخرجه تامًا ومختصرًا أبو عبيد القاسم بن سلام في "الأموال" (679) و (713)، وابن زنجويه في "الأموال" (1012) و (1069)، وابن شبة في "تاريخ المدينة "1/ 150، وابن الجارود في "المنتقى" (371)، وابن خزيمة (2323) من طريق نعيم بن حماد، به. قال ابن خزيمة: إنَّ في القلب من اتصال هذا الإسناد. Reference / Source: Abu Ubayd in "al-Amwal" (679 and 713), Ibn Zanjawayh in "al-Amwal" (1012 and 1069), Ibn Shabbah in "Tarikh al-Madinah" (1/ 150), Ibn al-Jarud in "al-Muntaqa" (371) and Ibn Khuzaymah (2323) narrated it in full and in abridged form through Nu'aym bin Hammad. Ibn Khuzaymah expressed doubt about whether this chain is connected (muttasil). وأخرج يحيى بن آدم في "الخراج" (294)، ومن طريقه البيهقي في "الكبرى" 6/ 149 عن يونس، عن محمد بن إسحاق، عن عبد الله بن أبي بكر بن محمد بن عمرو بن حزم - مرسلًا - قال: جاء بلال بن الحارث المزني إلى رسول الله ﷺ فاستقطعه أرضًا … فذكر نحوه. Reference / Source: Yahya bin Adam (294) and al-Bayhaqi (6/ 149) narrated it mursal through Muhammad bin Ishaq, that Bilal bin al-Harith al-Muzani came to the Prophet (peace and blessings be upon him) and asked for a piece of land (and he mentioned the full hadith). وأخرج البيهقي 6/ 149 من طريق عبد الرزاق، عن معمر، عن ابن طاووس، عن أبيه، عن رجل من أهل المدينة قال: قطع النبي ﷺ العقيق رجلًا واحدًا، فلما كان عمر كثر عليه فأعطاه بعضه وقطع سائره الناس. ويغلب على الظن أنَّ الرجل المدني صحابي، لأنَّ طاووسًا جل روايته عن الصحابة، والله أعلم. Reference / Source: Al-Bayhaqi (6/ 149) narrated through Abd al-Razzaq, from Ma'mar, from a man of Madinah, that the Prophet (peace and blessings be upon him) gave the valley of "al-Aqiq" to one man; then in the time of Umar (may Allah be pleased with him), when people increased, he took part of it from him and distributed it among others. وأخرج أبو داود (3061) عن عبد الله بن مسلمة، عن مالك، عن ربيعة بن أبي عبد الرحمن، عن غير واحد: أنَّ رسول الله ﷺ أقطع بلال بن الحارث المزني معادن القبلية، وهي من ناحية الفُرُع، فتلك المعادن لا يؤخذ منها إلّا الزكاة إلى اليوم. وهذا مرسل كما قال المنذري في "مختصر السنن". Reference / Source: Abu Dawud (3061) narrated it through Imam Malik, from Rabi'ah, that the Messenger of Allah (peace and blessings be upon him) granted Bilal bin al-Harith the mines of "al-Qabaliyyah", and to this day nothing but zakah is taken from them. (6324) further on. قوله: المعادن القَبَلية، قال ابن الأثير: القَبَلية: منسوبة على قَبَل - بفتح القاف والباء - وهي ناحية من ساحل البحر، بينها وبين المدينة خمسة أيام، وقيل: هي من ناحية الفُرع، وهو موضع بين نخلة والمدينة، هذا هو المحفوظ في الحديث. Important point: "Al-ma'adin al-qabaliyyah": this is a place on the seacoast five days' journey from Madinah; it is also said to be a place in the direction of "al-Fur'". وقوله: أقطَعَ، قال السندي في حاشيته على "مسند أحمد": من أقطعه الإمام أرضًا: إذا أعطاه أرضًا، وهو يكون تمليكًا وغيره. Important point: "Aqta'a": when the ruler makes someone the owner of land or gives it to him for use. والعقيق: وادٍ من أودية المدينة، مَسيلٌ للماء. Important point: "Al-Aqiq": a famous valley of Madinah through which rainwater flows.
