Abu Ubaydah bin Abdullah bin Mas'ud narrates: Sayyiduna Uthman (may Allah be pleased with him) sent (someone) to my father (Sayyiduna Ibn Mas'ud, may Allah be pleased with him) to ask him about this issue. My father said: "How can a hypocrite give a fatwa?" Sayyiduna Uthman (may Allah be pleased with him) said: We seek refuge in Allah from your being a hypocrite, and we seek refuge in Allah from calling you a hypocrite, and we commend you to Allah's protection from an issue like this arising in Islam and then you dying without having made it clear. My father said: "My view is that he (the husband) has more right to her until she takes the ritual bath from the third menstrual period and the prayer becomes lawful for her." The narrator said: I know that Sayyiduna Uthman (may Allah be pleased with him) adopted this very view.

Abu al-Bakhtari narrates that a man gave his wife one divorce, and then she had three menstrual periods. When she sat down to take her ritual bath, her husband came and took her back. She said: You have no such right. The two of them went to Sayyiduna Ibn Mas'ud (may Allah be pleased with him), and he made the woman swear by the One besides whom there is no god: had her husband taken her back at a time when the prayer had already become lawful for her? She did not take the oath, so he returned her to (her husband).

Abu Wa'il narrates from Sayyiduna Ibn Mas'ud (may Allah be pleased with him) concerning a woman who is given three divorces before consummation: "She is not lawful for him until she marries another husband."
Al-Thawri narrated it through Asim from Zirr, and Zirr from Sayyiduna Ibn Mas'ud (may Allah be pleased with him), thus: He said: "When someone gives three divorces before consummation, he used to regard her as being like a woman with whom the marriage had been consummated."

It is narrated from the students of Sayyiduna Ibn Mas'ud (may Allah be pleased with him) that the fatwa of Sayyiduna Ibn Mas'ud (may Allah be pleased with him) was this: when a woman is divorced and people think that her menstruation has ceased, but this is not clear, she should wait for one year. If she does not menstruate during that time, then after the year she observes a waiting period of three months. If she menstruates during those three months, she observes the waiting period by menstruation; and if she (then) menstruates but that menstruation is not completed after she has observed those three months that followed the year, he said: "Do not be hasty concerning her until it is known whether her menstruation has been completed or not."
