It is narrated from Jubayr bin Mut'im and Uthman bin Affan (may Allah be pleased with them both) that: I and Uthman bin Affan went to the Messenger of Allah (peace and blessings be upon him), and we said: "O Messenger of Allah! You have given to Banu al-Muttalib and left us out, while we and they are alike." The Messenger of Allah (peace and blessings be upon him) said: "Banu al-Muttalib and Banu Hashim are one and the same."

Jubayr bin Mut'im (may Allah be pleased with him) related that he and Uthman bin Affan (may Allah be pleased with them both) came to the Messenger of Allah (peace and blessings be upon him) to speak to him, when the Messenger of Allah (peace and blessings be upon him) had distributed the wealth of Khaybar among Banu Hashim and Banu al-Muttalib. They said: O Messenger of Allah! You have distributed to our brothers Banu al-Muttalib and given us nothing, although our kinship is like their kinship. The Messenger of Allah (peace and blessings be upon him) said to them: "Hashim and al-Muttalib are one and the same."
Jubayr bin Mut'im (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) gave nothing from that one-fifth to Banu Abd Shams and Banu Nawfal, as he had given to Banu Hashim and Banu al-Muttalib.

It is narrated from Sayyiduna Jubayr bin Mut'im (may Allah be pleased with him) that when the Messenger of Allah (peace and blessings be upon him) gave the relatives' share from Khaybar to Banu Hashim and Banu al-Muttalib, I and Uthman bin Affan (may Allah be pleased with them both) went, and I said: O Messenger of Allah! These are your brothers from Banu Hashim. We do not deny their virtue, because of the position that Allah has given you; but what is your view about our brothers from Banu al-Muttalib? You have given to them and left us out, while we and they are of the same standing. He (peace and blessings be upon him) said: "They did not abandon us, in the Jahiliyyah or in Islam. Indeed, Banu Hashim and Banu al-Muttalib are one and the same." Then the Messenger of Allah (peace and blessings be upon him) interlaced his hands one within the other.

Muhammad bin Jubayr bin Mut'im narrates from his father Sayyiduna Jubayr bin Mut'im (may Allah be pleased with him) that when the Messenger of Allah (peace and blessings be upon him) gave the relatives' share to Banu Hashim and Banu al-Muttalib, I and Uthman (may Allah be pleased with them both) came to him (peace and blessings be upon him). Then he narrated a hadith with the same meaning, except that he did not mention his (peace and blessings be upon him) saying: "They did not abandon us in the Jahiliyyah or in Islam"; and he (peace and blessings be upon him) said: "Banu Hashim and Banu al-Muttalib are one and the same, like this," and he (peace and blessings be upon him) interlaced his fingers.

Sayyiduna Jubayr bin Mut'im (may Allah be pleased with him) said: I and so-and-so went to the Prophet (peace and blessings be upon him), and we said: "O Messenger of Allah! You have given to Banu al-Muttalib and left us out, although they and we are of the same rank in your sight." The Messenger of Allah (peace and blessings be upon him) said: "Banu Hashim and Banu al-Muttalib are one and the same."
Ibrahim bin Isma'il and Mutarrif bin Mazin are both da'if (weak), and the narration of the group from al-Zuhri, from Ibn al-Musayyib, from Jubayr suffices.

Husayn bin Ali (may Allah be pleased with them both) related that Ali (may Allah be pleased with him) said: From the spoils of the Battle of Badr I received a she-camel, from the spoils of that very battle. He (peace and blessings be upon him) had also given me a she-camel from the one-fifth. When I intended to marry his (peace and blessings be upon him) daughter Fatimah (may Allah be pleased with her), I spoke to a goldsmith of Banu Qaynuqa' that he should go with me and we would bring idhkhir, so that I could sell this grass to the goldsmiths and spend its price on the walimah feast. I was still gathering the saddles, baskets and ropes for my she-camels, and the she-camels were sitting near the room of an Ansari Companion. When I came back having completed the arrangements, I saw that someone had cut off their humps, ripped open their flanks and taken out the livers from inside. Seeing this state, I could not hold back my tears. I asked: Who has done this? The people said: Hamzah bin Abd al-Muttalib (may Allah be pleased with him), and he is right now in this very room with the Ansar, taking part in drinking wine; with him is a singing girl and his friends. When the singing girl recited the verse: 'Ho, O Hamzah! These are fine, fat she-camels, and they are tied in the courtyard,' Hamzah (may Allah be pleased with him) took up his sword, cut off the humps of both these she-camels, ripped open their flanks and took out the livers from inside. Ali (may Allah be pleased with him) said: From there I came to the Prophet (peace and blessings be upon him), and Zayd bin Harithah (may Allah be pleased with him) was also with the Prophet (peace and blessings be upon him). The Messenger of Allah (peace and blessings be upon him) recognised the distress on my face; he (peace and blessings be upon him) asked: "What is it?" I said: O Messenger of Allah! Never before has anything as painful as today happened. Hamzah (may Allah be pleased with him) has seized both my she-camels, cut off their humps and ripped open their flanks, and he is right there in a house at a drinking gathering. He (peace and blessings be upon him) called for his cloak, put it on and set off. I and Zayd bin Harithah (may Allah be pleased with him) were also with him. He (peace and blessings be upon him) went near that house and reproached Hamzah (may Allah be pleased with him) for what he had done. Hamzah (may Allah be pleased with him) was intoxicated with wine and his eyes were red. He raised his gaze towards the Prophet (peace and blessings be upon him), then raised it a little higher and looked at his knees, then raised his gaze and looked at his face, and then said: You are all slaves of my father and mother. The Prophet (peace and blessings be upon him) understood that he was not in his senses, so he (peace and blessings be upon him) at once stepped backwards out of that house, and we were also with him (peace and blessings be upon him).

Abdullah bin Buraydah narrates from his father Sayyiduna Buraydah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) sent Ali (may Allah be pleased with him) to Khalid bin al-Walid (may Allah be pleased with him) to bring the one-fifth. He took a slave girl from it. In the morning, drops were falling from the head of Ali (may Allah be pleased with him). Khalid (may Allah be pleased with him) said to Buraydah (may Allah be pleased with him): Have you seen what he has done? I said: I bear a grudge against Ali (may Allah be pleased with him). I mentioned this to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) said: "O Buraydah! Do you bear a grudge against Ali?" I said: Yes. He (peace and blessings be upon him) said: "Love Ali, for his due in the one-fifth is even more than that."

I said: O Messenger of Allah! You have given a share to our brothers from Banu al-Muttalib and left us out, although our kin and their kin are the same. Al-Hasan bin Muhammad bin al-Hanafiyyah (may Allah have mercy on him) said: After the death of the Messenger of Allah (peace and blessings be upon him) the people differed about these two shares. Some said: The relatives' share belongs to the relatives of the Messenger of Allah (peace and blessings be upon him). Some said: It belongs to the relatives of the Caliph. And some said: After him (peace and blessings be upon him), his share belongs to the Caliph. Their opinion came together on spending both shares in the path of Allah on horses and war equipment, and during the caliphate of Abu Bakr and Umar (may Allah be pleased with them both) both were spent in this way.

Muhammad bin Ishaq said: I asked Abu Ja'far (meaning al-Baqir) what Ali (may Allah be pleased with him) used to do regarding the relatives' share. He said: Ali followed the way of Abu Bakr and Umar (may Allah be pleased with them both). I said: What do you (people) say? He said: They acted by his opinion, but he disliked going against Abu Bakr and Umar (may Allah be pleased with them both).
Imam al-Shafi'i (may Allah have mercy on him) declared this narration weak, because Ali (may Allah be pleased with him) held a view different from that of Abu Bakr (may Allah be pleased with him) in not giving slaves anything in the distribution, held a view different from that of Umar (may Allah be pleased with him) in treating people equally and in the sale of umm al-walad (slave mothers of their masters' children), and differed from Abu Bakr (may Allah be pleased with him) regarding (the inheritance of) the grandfather; and his saying "he followed the way of Abu Bakr and Umar" is a statement open to several meanings.
The narration of Muhammad bin Ali from Abu Bakr, Umar and Ali (may Allah be pleased with them) is mursal, and likewise the narration of al-Hasan bin Muhammad bin al-Hanafiyyah is mursal. As for the narration of Yunus from al-Zuhri, I do not yet know whether what was placed at its end is the saying of Jubayr bin Mut'im, making it mawsul (connected), or the saying of Ibn al-Musayyib or al-Zuhri, making it mursal. Muhammad bin Yahya al-Dhuhli narrated it from Abu Salih, from al-Layth bin Sa'd, from Yunus, and separated out the practice of Abu Bakr and Umar (may Allah be pleased with them both), making it the saying of Ibn Shihab al-Zuhri; so it is then munqati' (broken).

Abd al-Rahman bin Abi Layla said: I heard Ali (may Allah be pleased with him) saying: The Messenger of Allah (peace and blessings be upon him) gave me charge of the fifth of the one-fifth, and I placed it in its proper places in the lifetime of Abu Bakr and Umar (may Allah be pleased with them both) and in the lifetime of the Messenger of Allah (peace and blessings be upon him) as well. In one narration: Some wealth was brought; he called me and said: "Take it." I said: I do not want it. He said again: "Take it; you are more entitled to it." I said: We have no need of it; so he put it into the public treasury (bayt al-mal).

Abd al-Rahman bin Abi Layla said that he heard Ali (may Allah be pleased with him) saying: I, Abbas, Fatimah and Zayd bin Harithah (may Allah be pleased with them) were gathered with the Messenger of Allah (peace and blessings be upon him). Abbas (may Allah be pleased with him) asked the Messenger of Allah (peace and blessings be upon him): O Messenger of Allah (peace and blessings be upon him)! I have grown old, my bones have become weak, and hardship has overtaken me. If you see fit, order such-and-such wasqs of food for me. So the Messenger of Allah (peace and blessings be upon him) ordered it. Then Fatimah (may Allah be pleased with her) said: O Messenger of Allah (peace and blessings be upon him)! You know my position and my condition; if you see fit, give me something too, as you did for your uncle. He (peace and blessings be upon him) gave to Fatimah (may Allah be pleased with her) as well. Then Zayd bin Harithah (may Allah be pleased with him) said: O Messenger of Allah (peace and blessings be upon him)! You had given me land to live on, then you took it back from me; if you would return it to me. And he (peace and blessings be upon him) returned it. Ali (may Allah be pleased with him) said: I said: O Messenger of Allah (peace and blessings be upon him)! If you would make me the custodian of our right in the one-fifth, so that no one disputes it after you. And he (peace and blessings be upon him) did that as well. Then the Messenger of Allah (peace and blessings be upon him) looked at Abbas (may Allah be pleased with him), and he (peace and blessings be upon him) said: "O Abu al-Fadl! Will you not ask me what Ali has asked me?" He said: O Messenger of Allah (peace and blessings be upon him)! My request has reached its limit with what I have already asked of you. Ali (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) made me its custodian, and I distributed it in the lifetime of the Messenger of Allah (peace and blessings be upon him); and Abu Bakr (may Allah be pleased with him) made me its custodian, and I distributed it in the lifetime of Abu Bakr (may Allah be pleased with him) as well; then Umar (may Allah be pleased with him) made me its custodian, and I distributed it in the lifetime of Umar (may Allah be pleased with him) as well. Until, in the last year of Umar's (may Allah be pleased with him) life, a great deal of wealth came to him. He (may Allah be pleased with him) set aside our right, then sent word to me and said: This is your wealth; take it and distribute it wherever you wish. I said: O Commander of the Believers! This year we have no need of it; spend it on the needs of the Muslims. Then after Umar (may Allah be pleased with him) no one called us to it, until I became the Caliph. After coming away from Umar (may Allah be pleased with him) I met Abbas (may Allah be pleased with him). He said: O Ali! This morning you have deprived us of something that will never be returned to us until the Day of Resurrection. And he was a shrewd man.

Abd al-Rahman bin Abi Layla said: I met Ali (may Allah be pleased with him) at Ahjar al-Zayt and said: May my father and mother be sacrificed for you! What did Abu Bakr and Umar (may Allah be pleased with them both) do regarding the one-fifth for the Ahl al-Bayt? Ali (may Allah be pleased with him) said: In the time of Abu Bakr (may Allah be pleased with him) there was no one-fifth; whatever there was, he gave to us in full. And Umar (may Allah be pleased with him) kept giving it to us, until the wealth of Sus and Ahwaz came, or of Persia. He said: The Muslims are in need; if you like, give up your right, and we will devote it to the Muslims until wealth comes, then I will give you your right in full. Abbas (may Allah be pleased with him) said to Sayyiduna Ali (may Allah be pleased with him): Do not give away our right. I said: O Abu al-Fadl! Do we not have the right to accept the word of the Commander of the Believers and to help the Muslims? Then Umar (may Allah be pleased with him) died before wealth came to him so that he could pay us our right.
Al-Hakam said: In the narration of Matar and the other man, Umar (may Allah be pleased with him) said: You have a right, but when it becomes a lot, my knowledge does not extend to it all being yours; if you wish, I will give you from it as much as I consider due to you. We refused to take anything but all of it, so he refused to give us all of it.

Yazid bin Hurmuz related that when Najdah al-Haruri performed Hajj during the fitnah of Ibn al-Zubayr, he sent someone to Ibn Abbas (may Allah be pleased with them both), asking about the relatives' share, and said: What is your view? Ibn Abbas (may Allah be pleased with them both) said: "(It is) for the relatives of the Messenger of Allah (peace and blessings be upon him); he himself gave them their share. And Umar (may Allah be pleased with him) gave us (something), and we considered it short of our right, so we returned it and refused to accept it."

It is narrated from Yazid bin Hurmuz that Najdah al-Haruri asked Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) about the relatives' share: whom is it for? He said: "You have written to me asking about the share of the relatives, whom it is for. It is for us. Sayyiduna Umar (may Allah be pleased with him) used to invite us (to agree) that from it he would arrange the marriages of our unmarried men and women, provide servants from it for our needy, and pay off from it the debts of our debtors. But we refused, insisting only that he hand it over to us; he refused, so we left it."

It is narrated from Yazid bin Hurmuz that Najdah al-Haruri asked Ibn Abbas (may Allah be pleased with them both) about the relatives: who are they? And he asked about a slave and a woman who are present at the place of the spoils: should they be given anything from the spoils? And he asked about killing children. So he said: "O Yazid, write! Were it not for (fear of) a foolish deed, I would not write. You asked about the relatives, who they are; in our view it is we ourselves, but our people refused us that. And you asked about the slave and the woman who are present at the time of the spoils: there is no fixed share for them, but they may be given something as a reward. And you asked about killing children: the Messenger of Allah (peace and blessings be upon him) did not kill them, so you should not either, unless you come to know about them what the companion of Musa came to know. And you asked about the orphan, when his orphanhood ends: his orphanhood ends when he reaches maturity and right guidance."
Imam al-Shafi'i (may Allah have mercy on him) said: It is possible that by the words of Ibn Abbas (may Allah be pleased with them both), "our people refused us," he meant people other than the Companions of the Prophet (peace and blessings be upon him): Yazid bin Mu'awiyah and his family. [Sahih]
