أخبرنا أبو عبد الله محمد بن يعقوب الشَّيباني، حدَّثنا محمد بن عبد الوهاب، أخبرنا عفر بن عَوْن، أخبرنا الأعمش، عن أبي طَبْيان، عن ابن عباس قال: أُتِيَ عمرُ بمُبْتلاةٍ قد فَجَرَت، فأمَرَ برجمِها، فمرَّ بها عليُّ بن أبي طالب ومعها الصِّبيانُ يتبعونَها، فقال: ما هذه؟ قالوا: أَمَر بها عمرُ أن تُرجَمَ، قال: فردَّها وذهب معها إلى عمر، وقال: ألم تعلم أنَّ القلمَ رُفِعَ عن ثلاثٍ (2): عن المجنون حتى يَعقِل، وعن المُبتَلَى حتى يُفِيقَ، وعن النائم حتى يَستيقِظَ، وعن الصبيِّ حتى يَحتلِم؟ (3)
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه. ورواه شُعبة عن الأعمش بزيادة ألفاظٍ:

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a mentally afflicted woman who had committed fornication was brought to Sayyiduna Umar (may Allah be pleased with him), and he ordered that she be stoned. Meanwhile Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) passed by, while children were following behind the woman. He asked: What is this matter? The people said that Umar (may Allah be pleased with him) had ordered that she be stoned. The narrator said: So he took her back, went with her to Sayyiduna Umar (may Allah be pleased with him) and said: Do you not know that the pen has been lifted from three kinds of people? (They are): the insane until he regains his reason, the (mentally) afflicted until he recovers, the sleeper until he wakes up, and the child until he reaches puberty.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

حدَّثَناه علي بن حَمْشَاذ العَدْل وعبد الله بن الحسين القاضي، قالا: حدَّثنا الحارث بن أبي أسامة، حدَّثنا أبو النَّضر، حدَّثنا شُعبة، عن الأعمش، عن أبي ظَبْيان، عن ابن عباس قال: أُتِيَ عمرُ بامرأةٍ مجنونةٍ حُبْلَى، فأراد أن يرجُمَها، فقال له علي: أوَما علمتَ أنَّ القلم قد رُفِعَ عن ثلاثٍ: عن المجنون حتى يَعقِل، وعن الصبيِّ حتى يَحتلِم، وعن النائم حتى يَستيقِظ؟ فخلَّى عنها (1). وقد رُويَ هذا الحديثُ بإسناد صحيحٍ الرُّواة، مُرسَلٌ عن علي ﵁، عن النبيِّ ﷺ مُسنَدًا:

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that an insane woman who was pregnant was brought to Sayyiduna Umar (may Allah be pleased with him). He intended to stone her, but Sayyiduna Ali (may Allah be pleased with him) said to him: Do you not know that the pen has been lifted from three kinds of people? (They are): the insane until he becomes rational, the child until he reaches puberty, and the sleeper until he wakes up. So he let her go.

أخبرَناه الشيخ أبو بكر بن إسحاق، أخبرنا علي بن عبد العزيز، حدَّثنا عفان، حدَّثنا همَّام، عن قَتَادةَ، عن الحسن، عن علي، أَنَّ رسول الله ﷺ قال: "رُفِعَ القلمُ عن ثَلَاثَةٍ: عن النائم حتى يَستيقِظَ، وعن المَعتُوه حتى يَعقِلَ، وعن الصبيِّ حتى يَشِبَّ" (2).
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The pen has been lifted from three kinds of people: from the sleeper until he wakes up, from the ma'tuh (the feeble-minded or insane) until he regains his reason, and from the child until he grows up."

أخبرنا أبو جعفر محمد بن محمد البغدادي، حدَّثنا هاشم بن مَرْثَد الطَّبَراني، حدَّثنا عمرو بن الرَّبيع بن طارق، حدَّثنا عِكْرمة بن إبراهيم، حدثني سعيد بن أبي عَرُوبة، عن قَتَادةَ، عن عبد الله بن رَبَاح (1)، عن أبي قَتَادة: أنه كان مع النبيِّ ﷺ في سَفَر فأدلَجَ فتَقطَّع الناسُ عليه، قال: فقال النبيُّ ﷺ: "إِنَّه يُرفَعُ القلمُ عن ثلاثٍ: عن النائم حتى يَستيقِظَ، وعن المَعتُوه حتى يَصِحَّ، وعن الصبيِّ حتى يَحتِلِمَ" (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Qatadah (may Allah be pleased with him) that he was with the Prophet (peace and blessings be upon him) on a journey. He travelled in the last part of the night and the people became separated from him. Then the Prophet (peace and blessings be upon him) said: "Indeed, the pen has been lifted from three kinds of people: from the sleeper until he wakes up, from the ma'tuh (the mentally ill) until he becomes well, and from the child until he reaches puberty."
This hadith has an authentic (sahih) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

حدَّثنا أبو العباس محمد بن يعقوب، حدَّثنا بَحْر بن نصر الخَوْلاني، حدَّثنا ابن وهب، أخبرنا ابن جُرَيج، عن ابن أبي نَجِيحٍ، عن مجاهدٍ، عن عطية رجلٍ من بني قُريظة، أخبره أن أصحاب رسول الله ﷺ جرَّدُوه يومَ قُريظةَ، فلم يَرُوا المَواسِيَ جَرَتْ على شَعْره؛ يعني عانتَه، فتَرَكوه من القَتْل (3).
هذا حديث غريب صحيح، ولم يخرجاه، وإنما يُعرَف من حديث عبد الملك بن عُمَير عن عطيّة القُرَظي:

It is narrated from Atiyyah, a man from Banu Qurayzah, that the Companions of the Messenger of Allah (peace and blessings be upon him) examined him on the day (of the judgment) of Banu Qurayzah and saw that his pubic hair had not yet grown, so they spared him from being killed.
This hadith is gharib (unusual) and sahih (authentic), but the two Shaykhs (Bukhari and Muslim) did not record it; it is known through the narration of Abd al-Malik bin Umayr from Atiyyah al-Qurazi.

كما حدَّثَناه أبو بكر بن إسحاق، أخبرنا بشر بن موسى، حدَّثنا الحُميدي. وحدثنا أبو بكر، أخبرنا أبو مُسلِم، حدَّثنا علي بن المَدِيني؛ جميعًا عن سفيان، عن عبد الملك بن عُمَير، قال: سمعتُ عطية القُرَظي يقول: كنتُ غلامًا يومَ حَكَمَ سعدُ بنُ معاذ في بني قُريظة: أن تُقتَلَ مُقاتِلتُهم، وتُسبَى ذَرَارتُهم، فشكُوا فيَّ، فلم يَجِدوني أُنبِتُ الشَّعر، فها أنا ذا بين أظهُرِكم (1). آخر كتاب الحدود [كتاب تعبير الرؤيا] ﷽
It is narrated from Atiyyah al-Qurazi (may Allah be pleased with him) that he said: On the day Sayyiduna Sa'd bin Mu'adh (may Allah be pleased with him) gave his judgment concerning Banu Qurayzah, that their fighting men should be killed and their offspring taken captive, I was a boy. The people were in doubt about me (whether I was among the men or the children), and when they saw that my hair had not yet grown (I was spared), and now here I am among you.
