أخبرنا أبو عبد الله محمد بن يعقوب الشَّيباني، حدَّثنا محمد بن عبد الوهاب، أخبرنا عفر بن عَوْن، أخبرنا الأعمش، عن أبي طَبْيان، عن ابن عباس قال: أُتِيَ عمرُ بمُبْتلاةٍ قد فَجَرَت، فأمَرَ برجمِها، فمرَّ بها عليُّ بن أبي طالب ومعها الصِّبيانُ يتبعونَها، فقال: ما هذه؟ قالوا: أَمَر بها عمرُ أن تُرجَمَ، قال: فردَّها وذهب معها إلى عمر، وقال: ألم تعلم أنَّ القلمَ رُفِعَ عن ثلاثٍ (2): عن المجنون حتى يَعقِل، وعن المُبتَلَى حتى يُفِيقَ، وعن النائم حتى يَستيقِظَ، وعن الصبيِّ حتى يَحتلِم؟ (3) هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه. ورواه شُعبة عن الأعمش بزيادة ألفاظٍ: [التعليق - من تلخيص الذهبي] ترقيم العلميه 8168 - على شرط البخاري ومسلم
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a mentally afflicted woman who had committed fornication was brought to Sayyiduna Umar (may Allah be pleased with him), and he ordered that she be stoned. Meanwhile Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) passed by, while children were following behind the woman. He asked: What is this matter? The people said that Umar (may Allah be pleased with him) had ordered that she be stoned. The narrator said: So he took her back, went with her to Sayyiduna Umar (may Allah be pleased with him) and said: Do you not know that the pen has been lifted from three kinds of people? (They are): the insane until he regains his reason, the (mentally) afflicted until he recovers, the sleeper until he wakes up, and the child until he reaches puberty.
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.
(2) كذا في النسخ الخطية: ثلاث، والمذكور بعدها أربع، وسلف الحديث مرتين من طريق جرير بن حازم عن الأعمش، ليس فيه ذكر المبتلى.
Note / Clarification: (2) The manuscripts have "three" (thalath), whereas what is mentioned after it is "four". This hadith passed twice before via Jarir bin Hazim from al-A'mash, and it did not mention the "mubtala" (the one afflicted).
(3) إسناده صحيح. أبو ظَبيان: هو حصين بن جندب. وسلف مرفوعًا برقمي (962) و (2327) من طريق جرير بن حازم عن الأعمش.
Grading: (3) Its isnad is sahih. Technical note / Defect ('illah): Abu Zabyan is "Husayn bin Jundab". This narration passed as marfu' as numbers (962) and (2327) via Jarir bin Hazim from al-A'mash.
