Imam al-Shafi'i (may Allah have mercy on him) said: When someone passes by a man's crops, orchard, fruit or livestock, he should take nothing without permission, because neither the Qur'an nor any established Sunnah has come declaring it permissible. It is only possible with the owner's permission, and Allah knows best. He said: It has also been said that whoever passes by an orchard may eat, but should not carry off a lapful. A hadith has been narrated on this; had its like been established with us, we would not have opposed it. But the Qur'an and the established hadith show that it is not permissible to eat anyone's property without his permission.
The Shaykh said: The one who said this was Sayyiduna Umar bin al-Khattab (may Allah be pleased with him).

Zayd bin Wahb (may Allah have mercy on him) narrates that Sayyiduna Umar (may Allah be pleased with him) said: When you are three, appoint one of you as leader. When you pass by a herder of camels, call out: O herder of camels! If he hears your call and comes, ask him for milk to drink; otherwise, milk them and drink, and then tie up the she-camels' udders again. But this is for a time of necessity.
This report from Sayyiduna Umar (may Allah be pleased with him) is sahih (authentic) through both of its chains.

The hadith of Yahya bin Sulaym al-Ta'ifi, from Ubaydullah, about a man who passes by an orchard and eats from it, was mentioned to Abu Zakariyya Yahya bin Ma'in (may Allah have mercy on him), and he said: "This is a mistake." Imam Abu Isa al-Tirmidhi (may Allah have mercy on him) said: I asked Muhammad bin Isma'il (al-Bukhari) (may Allah have mercy on him) about this hadith, and he said: Yahya bin Sulaym narrates hadiths from Ubaydullah in which he makes errors.
The Shaykh said: It has also been narrated through other routes which are not strong.

A man from the tribe of Muzaynah asked the Messenger of Allah (peace and blessings be upon him) about a person who picks the fruit of an orchard. He (peace and blessings be upon him) said: "Whoever plucks from the date palm and carries it off must pay its price and as much again, and must be given an exemplary punishment. Whoever takes from the drying floor, if it reaches the value of a shield, his hand will be cut off; but if he only ate and did not carry anything away, there is no prescribed punishment (hadd) on him."
The Shaykh said: If this hadith is sahih, it means that there is no amputation for him, since he did not take the fruit out of a place of safekeeping.

Sayyiduna Samurah bin Jundub (may Allah be pleased with him) said that the Prophet (peace and blessings be upon him) said: "When you come upon livestock and their owner is there, take his permission, then milk and drink. If the owner is not there, call out three times. If the owner comes, take his permission; otherwise milk and drink, but do not carry any away."
The Shaykh said: Some of the hadith masters (huffaz) do not accept the hadiths of al-Hasan from Samurah as established, and claim that they come from a written book, except the hadith of the aqiqah in which hearing is mentioned. And if this hadith is sahih, then it applies to a time of necessity.

And when you come to someone's orchard, call out three times; if you get an answer, well and good, otherwise you may eat the fruit of the orchard, but you may not carry any away."
Only Sa'id bin Iyas al-Jurayri narrated it; he is among the trustworthy narrators (thiqat), except that his memory became confused in the last part of his life, and Yazid bin Harun heard from him after his confusion. Hammad bin Salamah also narrated it from al-Jurayri, and it is not strong. And something contrary to this has been narrated from Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) from the Prophet (peace and blessings be upon him).

In the hadiths of Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) and of Amr bin Shu'ayb there is a concession. Concerning a person who cannot buy anything, the Messenger of Allah (peace and blessings be upon him) said: "When he passes by an orchard, he may eat, but he should not carry off a lapful." In the hadith of Sayyiduna Umar (may Allah be pleased with him) it is mentioned that some of the Ansar passed by an Arab tribe, and when they asked them for hospitality, they refused. So they took some of their property. They told Sayyiduna Umar (may Allah be pleased with him), and he made a move against the Bedouins and said: Travellers are more entitled to the water spring at which they stop. Abu Ubayd (may Allah have mercy on him) explained that this is for one who cannot obtain hospitality or buy anything. He should call out to the herder three times so that he can first ask him for hospitality.
The Shaykh said: Al-Qasim bin Mukhawwal narrates from his father, who said: I asked the Messenger of Allah (peace and blessings be upon him): We come across camels while we are in need of milk, and their milk has been held back in their udders. He said: "Call out to the herder three times. If you get an answer, well and good; otherwise, milk them. Then leave some for those who milk them. Then tie up the udder and leave some milk so that the herders can milk."

Sayyiduna Abu Hurayrah (may Allah be pleased with him) said: We were with the Prophet (peace and blessings be upon him) when there were some camels by thorny trees with their udders tied up. Some people went to milk them. He (peace and blessings be upon him) called them back and said: "If people were to go for what is in your bags and take away your food, would they have betrayed you?" They replied: Yes! He said: "These too are like Muslim households; what is in their udders is like what is in your bags." The Companions (may Allah be pleased with them) asked about what is lawful for a man from his brother's property, and he said: "He may eat and drink, but he should not carry anything away."
This is an unknown (majhul) chain by which proof is not established, and al-Hajjaj bin Artah is not used as evidence. It has also been narrated from al-Hajjaj through another route which indicates that it concerns one in dire need.
