Bayhaqi 19648 — Reports on one who passes by someone's orchard

Imam al-Shafi'i (may Allah have mercy on him) said: When someone passes by a man's crops, orchard, fruit or livestock, he should take nothing without permission, because neither the Qur'an nor any established Sunnah has come declaring it permissible. It is only possible with the owner's permission, and Allah knows best. He said: It has also been said that whoever passes by an orchard may eat, but should not carry off a lapful. A hadith has been narrated on this; had its like been established with us, we would not have opposed it. But the Qur'an and the established hadith show that it is not permissible to eat anyone's property without his permission.
The Shaykh said: The one who said this was Sayyiduna Umar bin al-Khattab (may Allah be pleased with him).
